studying in I PUC andvpshewas. healthy prior to<\/p>\n

Bangalore, When”the’ claimant was proceeding as a<\/p>\n
   i:<1_Va Motorcycle bearing N0.KA\u00bb05~EG 9312,<\/p>\n
the  KSRTC bus bearing No.KA~01~F'~ 1769<\/p>\n
V _ droife the 'vehicle in a high speed and in a rash and<\/p>\n
  \u00bb.rnarr1.ner," so as to endanger human life. dashed against<\/p>\n
 theiltnotorcycle, due to which, the Claimant fell down<\/p>\n
 Ema the rear wheel of the bus ran over the hip of the<\/p>\n
Claimant, thereby, she sustained grievous injuries such<\/p>\n

 and  charges and has lost one academic year.<\/p>\n

‘v.,pdisabilityi. on account of the injuries sustained persist<\/p>\n
“ilth.rou_gh0ut her future life and it affects her marriage<\/p>\n
 prospects and further, she has to take medical<\/p>\n
 treatment throughout. her life. ‘faking these relevant<\/p>\n
aspects. she filed the claim petition under Section 166<\/p>\n
of the M.V.Ac~.t claiming <:~.on1pe1'1sai:ion against the<\/p>\n

\nconsideration before the Tribunal and the Tribunal after<\/p>\n
assessing the oral and documentary evidence and other<\/p>\n

and suffering. Conveyance, nourishing food and<\/p>\n
“.attendant charges, loss of amenitties. future medical<\/p>\n
expenses and marriage prospects and not awarding any<\/p>\n
compensation towards of e<;lucation for one<\/p>\n

academic year. She has taken us through the evidence
\nof the doctors PWS 2 and 3 wherein the disability to the<\/p>\n
Claimant is stated as, 28% to the right: lower 1imvb;a',__32%<\/p>\n
to the pelvic portion and 30% to the whole boofy,'  g<\/p>\n
Tribunal has assessed the whole body   <\/p>\n
claimant at 20%. She further .'<\/p>\n
Claimant is a young bright   at <\/p>\n
the time of accident and Ori:2V'\u00a2;\u00a5il(:'C)\\L1I1t.h'01%l_:'th\u20ac VfiiI1_jL11'i\u20acS
\nsustained, she is  _a'iposition;\u00abtgo'rlead a satisfied
\nmarried life as. there"'wo:u1d'*"  in getting<\/p>\n
conCeit'_ed–.  delivery. Though the<\/p>\n
material on i'evcoi'd'revea'_.l the above said problems, the<\/p>\n
 Trib1in1a1~ has 'neither. considered. nor appreciated nor<\/p>\n
 'a:Wa1'ded*ju\u00absVt""a_nd reasonable Compensation. Therefore,<\/p>\n
that the judgnient and award of the<\/p>\n
 Triblnnala is liable to be modified. awarding just and<\/p>\n

4. As against this, the leamed counsel for the<\/p>\n
Corporation, interalia, sL1b1nitt’ed that”: the Tribunal has<\/p>\n
Committed grave error in not fasiei’ii1’1g the contributory
\nnegligence on the driver ofizhe motor cycle and erred in<\/p>\n

fastening the entire liability only on the Corporation.
\nFurther. he submitted that the Tribunal is not justified
\nin awarding compensation towards the head loss of<\/p>\n
future income. since the question of a'<2_'v"ar_'Cii_Ii'g<\/p>\n
compensation under the said head does-'.'':r'1ot-._ar'ise;_'"1 "<\/p>\n
However, he submitted that the :c\u00e9oi11'pen:iati:on'l:a'warded'–wA<\/p>\n
under the other heads are on i.heu'low-ear' sidieiarid it<\/p>\n

5. After careful c’0nsideratiorl ofathe submission of<\/p>\n
the learned counsel appe.ariiigl’ir\u00a7n__.li\u00a7oth.,nsi.des, the only<\/p>\n
point that -.ariSe'” for A consicderatioii is,<\/p>\n

  “1”‘i1.:e””occurre11ce of the accident, the disability<\/p>\n
caused Vdue-. totlie injuries fsustained by the claimant<\/p>\n
 are not in dispute. It emerges from the records that the<\/p>\n
 claimant was aged about 17 years. studying 1 year PUC.<\/p>\n
‘  She was in the hospital for 33 days  inpatient. out of<\/p>\n
 which 14 days she was in ICU and underwent three<\/p>\n
surgeries. Doctor has assessed disability at 28% to the<\/p>\n
right lower limb, 32% to the pelvic portion arid 30% to<\/p>\n

\nthe whole body. The ‘E’ribunal has rightly assessed the<\/p>\n
whole body disability at 20% and we accept the same.<\/p>\n
The income assessed by the Tribunal at $300\/– <\/p>\n
also just and reasonable. The claimant <\/p>\n
spent considerable amount towards med_.i.ca,1_:”e;{pe’nses,’ ”<\/p>\n
conveyance. nourishing food and[attei:1df:;1ri–i.\u00bb  .’<\/p>\n
