PW25 m Doctor has categoricaily stated ~ jt1ra_'t\u00ab.:ti1,e\n\ninjured was in a position to speak and give stat-ement\"' '\n\nfurther he has signed Ex.P.22. Underathese  It 'A it\n\ncouid be gathered that PW25 M th\u00e9:.Me'a1c'ar officer \n\nonly a person present when i;\":2__&lt;&#039;.P,.22 was recoitde\ufb02&#039;.4.1&#039;;-Istfaiso * it\n\nasserted that the patient was__&#039;_iri\u00bbv:a&#039;vposition.to give such\nstatement. However, on&quot;&#039;car*efd.I  of Ex.P.22, it is\nseen that the name &#039;No.5 has been\nadded    of any officer by\nthe sideof  the colour of the ink\ndiffers  afiandw\ufb01ting. In View of the foregoing\ndiscussionsdwe dying deciaration of deceased\n\nPradeep _--  &#039;genuine and has been recorded by\n\n   in the presence of PW25 --\n\n  the deceased was in fit condition to\n\ngive&#039;~.._statern_er\u00bb1t and hence, a conviction can be based on the\n\n &#039; &quot; --  &quot;said  deciaration.\n\nH 17. So far as the capacity of the deceased to narrate\n\n&quot; the incident regarding the cause of his injuries is concerned,\n\non perusal of Ex.P.3 the accident register it is clear that\n\n \n\n\n\n \n\n16\n\nPW1. no where it is brought out that accident \n\nEx.P.3 has been tampered regarding the name ,of~~theg &#039;\n\nWho gave the statement. Further,_ it is evidentiifthat Vibothu if\n\nVyramudi and Urnesh were positively p;\u00a5fesent&#039;ffin&quot;&#039;the \n\nwhen Pradeep was taken to the&#039;llospitallwhichv&#039;is\u00a7._evi.denced r L&#039;\n\nby their signature in the registerk Under the\ncircumstances, we haveknio the version\nas per Ex.P.3  names of \ufb01ve\npersons narn_eiv    and Gunda are\nclearly  writing or correction. In\nview  it above, we hold that the\nprosecutionihasfprovedbthefigpgufilt of Accused No. 1 to Accused\n\nNo.4 a11dA.Accaused&#039;N&#039;o.6x&#039;for the offence U\/s.302 {PC and they\n\n&#039;V&#039;are&#039;Iiab1{e&#039;for conviction for the said offence. However, in View\n\n   PW15 not supporting the case of the\n\nprosecuti&#039;on_t~he offences U\/s.307 of IPC and 326 of PC are\n\n proved beyond reasonable doubt against the accused\n\nA   persons. Therefore, the acquittal for the said offences by the\n\n   Willfi\u00e9al Court does not call for interference. In the result, the\n\n&#039; following\n\n \n\n\n\n \n\n17\n\nORDER\n<\/pre>\n<p>The appeal is allowed in part.\n<\/p>\n<p>The order of acquittal passed,against.&#8217;Acclu&#8217;s.&amp;gd :1_ to All<\/p>\n<p>Accused No.4 and Accused No.6  the <\/p>\n<p>and 302 r\/W.
