PATTANAIK\n\n\n\n\nACT:\n\n\n\nHEADNOTE:\n\n\n\nJUDGMENT:\n<\/pre>\n<p>\t\t\t O R D E R<br \/>\n     In this appeal, the order dated 21st April, 1997 passed<br \/>\nby the\tlearned Addl.  Designated Judge, Ahmedabad rejecting<br \/>\nthe application\t made by  the  appellant  for  dropping\t the<br \/>\ncharge under  Sections 3  and 5 of Terrorists and Disruptive<br \/>\nActivities  (Prevention)   Act,\t 1987  (in  short  TADA)  in<br \/>\nTerrorist Criminal  Case, No. 3\/96 arising out of I.C.R. No.<br \/>\n4\/3 of\tthe police  station Rakhiyal.  District Ahmedabad on<br \/>\naccount of non compliance of mandatory provisions of Section<br \/>\n20A of TADA, is under challenge.\n<\/p>\n<p>     The learned  counsel for  the appellant has referred to<br \/>\nthe decision  of  three\t judges&#8217;  Bench\t of  this  court  in<br \/>\nAnirudhssinji Karansinhji  Jadeja  and\tAnr.  vs.  State  of<br \/>\nGujarat (AIR  1995 (5) Sc 239). It has been held in the said<br \/>\ndecision that  cognizance of  the offence  under TADA can be<br \/>\ntaken on  compliance of the provisions of sub-section (1) of<br \/>\nSection 20A  and sub-section  (2) of  Section 20A  of  TADa.<br \/>\nSub-section (2)\t of Section 20A of TADA.  Sub-section (1) of<br \/>\nsection 20 A of TADA provides:\n<\/p>\n<blockquote><p>     20-A (1)  &#8216;Notwithstanding anything<br \/>\n     contained\t in    the   code,    no<br \/>\n     information  this\t Act  shall   be<br \/>\n     recorded by  the police without the<br \/>\n     prior  approval   of  the\tDistrict<br \/>\n     Superintendent of Police.&#8217;<br \/>\n     The learned  counsel has  contended that  in this case,<br \/>\nthe statutory  authority as  referred to  sub-section (1) of<br \/>\nSection 20A  of TADa  has not  given any  prior approval for<br \/>\ninitiating the\tcriminal proceedings  under TADA.  Therefore<br \/>\ncharges under TADA cannot be invoked.<\/p><\/blockquote>\n<p>     It is,  however, contended\t by the\t prosecution that on<br \/>\nthe very date when investigation had been made in this case,<br \/>\nthe Commissioner  of Police.   Ahmedabad  was present and he<br \/>\nhad given oral permission under Section 20A (1) of TADA.  We<br \/>\nmay indicate  here that considering the serious consequences<br \/>\nin &amp;  criminal case  initiated under the provisions of TADA,<br \/>\noral permission\t cannot be  accepted.\tIn our view, Section<br \/>\n20A (1)\t must be construed authority referred to in the said<br \/>\nsub section must be in writing so that there is transparency<br \/>\nin the\taction of  the statutory  authority and\t there is no<br \/>\noccasion for any subterfuge subsequently by introducing oral<br \/>\npermission.\n<\/p>\n<p>     That apart,  in the  facts\t of  the  case\twe  have  no<br \/>\nhesitation to  hold that  even oral  permission had not been<br \/>\ngranted.  Dr.\tGhatate,  the\tlearned\t counsel   for\tthat<br \/>\nrespondent has drawn our attention to two documents, namely,<br \/>\nthe latter  addressed by  the ACP Crime Branch, Ahmedabad to<br \/>\nthe Deputy  Commissioner, Crime\t Branch, Ahmedabad city, for<br \/>\ninvoking Sections  3 and  5 of\tTADA in\t respect of  Rakhial<br \/>\nPolice Station\tCR 1-94\/93.    This  letter  is\t dated\t11th<br \/>\nAugust, 1994.\tIn  the said letter, a request was made that<br \/>\nin the\tfacts indicated\t in the\t letter, it was necessary to<br \/>\ninvoke sections\t 3 and\t5 of  TADA and a request was made to<br \/>\ngrant approval\taccordingly.\tThe  other  document  placed<br \/>\nbefore us  by Dr.  Ghatate is the permission given by D.C.P.<br \/>\non the\tbasis of  request made\tby the\tA.C.P. Crime  Branch<br \/>\nAhmedabad.   It appears\t that on 11.8.94 such permission had<br \/>\nbeen granted  by Mr. A.K. Surolia the Deputy Commissioner of<br \/>\nPolice Crime  Branch,  Ahmedabad  city\tand  such  grant  of<br \/>\npermission is to the following effect:\n<\/p>\n<p>     &#8216;Therefore, after a careful consideration I deem it fit<br \/>\nthat in\t this case  relevant provisions of the Terrorist and<br \/>\nDisruptive Activities (Prevention) Act, 1987 (in short TADA)<br \/>\nare to\tbe applied  in the  FIR and hence I grant permission<br \/>\nfor the same.&#8217;<br \/>\n     Such letter  on the  face\tof  it\tindicates  that\t the<br \/>\nalleged\t oral\tpermission  had\t not  been  granted  by\t the<br \/>\nCommissioner of\t Police otherwise  there would not have been<br \/>\nany  occasion  for  seeking  permission\t from  an  authority<br \/>\nsubordinate to the Commissioner of Police namely, the Deputy<br \/>\nCommissioner of Police and consequential grant of permission<br \/>\nby such\t subordinate authority.\t As the mandatory provisions<br \/>\nof Section  20A (1)  of TADA has not been complied with, the<br \/>\ncharge under  the provisions  of Sections  3 and  5 of\tTADA<br \/>\ncannot be  sustained in\t the said criminal case.  Therefore,<br \/>\nsuch invocation\t of the\t provisions of\tTADA stands quashed.<br \/>\nit is however made clear that  will be open to the concerned<br \/>\nauthority to  proceed in accordance with law as indicated in<br \/>\nparagraph  16\tof   the   decision   of   this\t  Court\t  in<br \/>\nAnirudhsinhji&#8217;s case  for invoking  provisions of  TADA.  We<br \/>\nmake it\t clear that  we have not considered as to whether or<br \/>\nnot in\tthe facts  of the case, a case under Section 3 and 5<br \/>\nof TADa\t has been  made out  because the condition precedent<br \/>\nfor invoking  such provisions  had not\tbeen complied  with.<br \/>\nSuch question is therefore kept open to be considered at the<br \/>\nappropriate stage.
