3. In order to prove the case against the respondent,
\nthe prosecution has examined 14 witnesses and got<\/p>\n
marked Ex.P’–1 to F’-8. The defence of the Icspondent<\/p>\n
being true of total cieniai, he has examined DW-1 to .L”i”\\”.\u00a5-4<\/p>\n
and got marked EXJI)-1 and B-2 in his defence.<\/p>\n

   by the accused. He has further stated that his<\/p>\n
‘  hyvgrifc has i\ufb02icit iratixnacy with the accused and themfore,<\/p>\n
 the deceased was objecting to the accused coming to his<\/p>\n
house. The said iliicit relationship continued fear about<\/p>\n
4 to 5 years and in this connection, them was some<\/p>\n
panchayath and panchayathdars had <\/p>\n
respondent not to continue: such relationshgi\ufb01.’ ‘   _<\/p>\n

 that  after hearing regarding the death<\/p>\n
 of  the water pond, he went near the place<\/p>\n
  father was dead. Thereafter, after comm’ g<\/p>\n
to  ‘ai:;bi1t the incident, they have gone to thc police<\/p>\n
  given complaint. PW–4 Sanjcevaraju is the<\/p>\n
   eye: witness in this case. it is his case that on<\/p>\n
    at about 6.45 a.m., he had gone to irxigatc the<\/p>\n
 land and his grand father the deceased was sitting for<\/p>\n
answcxing naturc’s cail near the water pond. He has<\/p>\n
a..\n<\/p>\n
further stated that the respondent came near his <\/p>\n
father and pushed his grand father into the water <\/p>\n
being afraid, he ran away and informed the-em:   ‘<\/p>\n

H  PW–7 Ramalingaiah is a witness to EXP-3<\/p>\n
 ‘Wig-rcunder the clothes of the deceased were seized by the<\/p>\n
U ___5Poliee. PW-8 Hanaumaiah is a relative of the deceased who<\/p>\n
has stated that PW-1 told that the accused was loving his<\/p>\n
daughter.\n<\/p>\n

post mortem examinairion on the dead body of the <\/p>\n

of drowning. PW~1O Hannmaiah is another: ‘  <\/p>\n

 The leamed Sessions Judge has found fault<\/p>\n
   me; such delay in lodging the complaint before the police.<\/p>\n

the sense that if he heard the noise of the deceased while<\/p>\n
he was irrigaizing the land, nothing prevented him from<\/p>\n

bringing it to the notice of other neighbouring <\/p>\n
working in the \ufb01eld and also by summoning <\/p>\n
relative to the scene of offence by shouting.  K<\/p>\n

PW–4 being the grandson of the  found

\nthat PW–1 w1}o_is.son  e   son of the
\ndeceased,   Vt  court that there
\nwas a ;,:_    in this regard, but
\nnone  the  who held panchayath were
\n and on these three major<\/p>\n
points; the leaned’ Sessions Judge, has disbelieved the<\/p>\n
  ‘version and has passed the order of acquittal.<\/p>\n
  through the material on record, we<\/p>\n
are’~._of the ofxinion that the reasons given by the leaxned<\/p>\n
‘.   Sessions” Judge is neither capricious nor without any<\/p>\n
evidence on record, but it is in accordance with the<\/p>\n
VA  V.  evidence adduced by the prosecution. Under the<\/p>\n
circumstances, the well considered order of the acquittal<\/p>\n
passed by the learned Sessions Judge does not warrant<\/p>\n
