         The accused in C.C.611\/2004 on the files of<\/p>\n
Judicial First Class Magistrate Court, Vadakara is the<\/p>\n
petitioner in   this  petition under Section 482 of<\/p>\n
Cr.P.C. The first accused\/petitioner seeks to quash the<\/p>\n
proceedings in C.C.611\/2004.\n<\/p>\n<\/p>\n
2.  Annexure   B   is   the   complaint   leading    to<\/p>\n
C.C.611\/2004. A perusal of the complaint shows that the<\/p>\n
case of the complainant, broadly, was that she had<\/p>\n
joined  as  a  subscriber   in  a  chit  conducted   by<\/p>\n
M\/s.Sudarsan Chits (India) Limited. The fourth accused<\/p>\n
was the Branch Manager of the said company at Vadakara.<\/p>\n
The fourth accused approached the complainant at her<\/p>\n
house. Her husband was also present at that time in<\/p>\n
their house. The complainant agreed to join the chit.<\/p>\n
Accordingly, the complainant became a subscriber of the<\/p>\n
Crl.M.C. No.3227\/2005\n<\/p>\n

\nchit. Instalments were remitted. The tenure of the chit<\/p>\n
was later completed and the complainant made demand to<\/p>\n
the second respondent for the sala amount. This was not<\/p>\n
given. Thereafter, complainant made several requests.<\/p>\n
3.    The accused 2 and 3 had, on several occasions,<\/p>\n
agreed to pay the amount; but that was not done. In so<\/p>\n
far as the first accused is concerned, the specific<\/p>\n
allegation seems to be that on 27-7-2001, the second<\/p>\n
accused had told the complainant that accused 1 and 3<\/p>\n
had sanctioned the payment due to the complainant, the<\/p>\n
first accused had been intimated about this and the<\/p>\n
first accused paid the amount to the second accused for<\/p>\n
onward payment to the complainant. The complaint does<\/p>\n
not contain any specific allegation that the first<\/p>\n
accused had, at any point of time, specifically agreed<\/p>\n
to pay the amount to the complainant, while at the time<\/p>\n
of joining the chit or in the course of demanding<\/p>\n
payment of the amount due to the complainant after the<\/p>\n
completion of the chit. Apparently, the first accused<\/p>\n

\nseems to have been arrayed as an accused on the premise<\/p>\n
of the complaint that he was the Managing Director of<\/p>\n
the company, which had conducted the chit.<\/p>\n
4.    In this application under Section 482 of Cr.P.C.,<\/p>\n
two grounds have been essentially taken up in seeking<\/p>\n
to quash the proceedings of court below, so far as the<\/p>\n
first accused is concerned. Firstly, it is contended<\/p>\n
that the first accused was not the Managing Director of<\/p>\n
the Company at the relevant point of time. Reference is<\/p>\n
made to Annexure C, which seems to be the list of<\/p>\n
Directors from 1999 onwards. Secondly, it is contended<\/p>\n
that a reading of the entire complaint will not reveal<\/p>\n
any allegations against the first accused making out an<\/p>\n
offence under Section 420 of the Indial Penal Code.<\/p>\n
5.    I heard learned Senior counsel Sri.K.Dandapani<\/p>\n
appearing on behalf of the petitioner. There is no<\/p>\n
appearance on behalf of the complainant.<\/p>\n

6.    I have gone through Annexure B complaint. In so<\/p>\n
far as the contention that the first accused has<\/p>\n
nothing to do in the chit company is concerned, I am of<\/p>\n
the view that it may not be possible, under Section 482<\/p>\n
of Cr.P.C. to decide the said aspect. But in so far as<\/p>\n
the second contention is concerned, I find force in the<\/p>\n
submission       made by Mr.Dandapani that there is  no<\/p>\n
allegation in the complaint, which will specifically<\/p>\n
make out a case against the first accused under Section<\/p>\n
420 of the Indian Penal Code. Mere non-payment or delay<\/p>\n
in the payment of amounts payable to the subscriber of<\/p>\n
a chit by the foreman will not constitute an offence<\/p>\n
under Section 420 of Indian Penal Code. The offence<\/p>\n
punishable under Section 420 would be made, if there<\/p>\n
are allegations and prima facie material to show that<\/p>\n
the subscriber\/complainant was compelled to join the<\/p>\n
chit on a false promise, and that the complainant would<\/p>\n
not have joined the chit, but for the said promise. It<\/p>\n
is also necessary to allege that the complainant had<\/p>\n
suffered detriment or wrongful loss on account of the<\/p>\n

\nfalse promise made by the accused.\n<\/p>\n<\/p>\n
7.    The     allegation   broadly    answering  the  above<\/p>\n
description, seems to be made in the complaint against<\/p>\n
the    fourth      accused.  At    any rate,  there is   no<\/p>\n
allegation, whatsoever, of the above nature or which<\/p>\n
would satisfy the ingredients of Section 420 of the<\/p>\n
Indian     Penal     Code, as  regards  the  first accused.<\/p>\n
Apparently, the complainant has unnecessarily dragged<\/p>\n
the    first      accused  into    the proceedings, without<\/p>\n
identifying the person who is responsible for the chit<\/p>\n
company possibly for the purpose of more expeditious<\/p>\n
settlement of her claim. But it will not satisfy the<\/p>\n
requirements in the court.\n<\/p>\n<\/p>\n
8.    I am satisfied that it would be abuse of process<\/p>\n
of the Court, if the criminal proceedings is continued,<\/p>\n
in so far as the first accused is concerned.<\/p>\n
9.    Mr. Dandapani submits that, as a matter of fact,<\/p>\n
payments which are due to the complainant and other<\/p>\n

\naggrieved subscribers have been made and is being made<\/p>\n
on a pari passu basis. He submits that the Supreme<\/p>\n
Court appointed Justice Mr.Thulasidas (a former Judge<\/p>\n
of this Court) as Additional Director of the company<\/p>\n
and due payments have been made to the complainant<\/p>\n
through the office of Justice Mr. Thulasidas. Recently,<\/p>\n
she has accepted the same. I would have gone into more<\/p>\n
details of this matter, had there been a representation<\/p>\n
on behalf of the complainant. But I take note of the<\/p>\n
fact that there is no representation on behalf of the<\/p>\n
complainant and accept this as probabilising the case<\/p>\n
of the accused in this regard.\n<\/p>\n<\/p>\n
             For all these reasons, the Criminal M.C. is<\/p>\n
allowed. The proceedings in C.C.611\/2004 on the files<\/p>\n
of the Judicial First Class Magistrate, Vadakara are<\/p>\n
quashed, in so far as the first accused is concerned.<\/p>\n
