(C) No.24036 of 2010\n                      --------------------------\n             Dated this the 20th October, 2010\n\n                        J U D G M E N T\n<\/pre>\n<p>      Finding that name of the petitioner is included in the<\/p>\n<p>Rowdy List prepared by Nallalam Police, this petition is<\/p>\n<p>filed under Article 227 of Constitution of India for a writ of<\/p>\n<p>mandamus to quash Ext.P1 rowdy list to the extent of<\/p>\n<p>including the name of the petitioner therein. Petitioner<\/p>\n<p>would contend that though CC No.249\/2006, was taken<\/p>\n<p>cognizance for the offences under Section 341 and 294 (b)<\/p>\n<p>of Indian Penal Code against the petitioner, by Ext.P2<\/p>\n<p>judgment Judicial Magistrate of the First Class -V,<\/p>\n<p>Kozhikode acquitted the petitioner of the offences. Though<\/p>\n<p>CC No.701\/2008 was taken cognizance on the report<\/p>\n<p>submitted by the police alleging that petitioner committed<\/p>\n<p>an offence under Section 10 of Unlawful Activities<\/p>\n<p>(Prevention) Act, 1967, by Ext.P3 order, this Court has<\/p>\n<p>already quashed the cognizance taken. According to the<\/p>\n<p>petitioner, he is not involved in any other case. It is<\/p>\n<p>contended that there is no provision in the Code of<\/p>\n<p>Criminal Procedure or in the Kerala Police Act to prepare a<\/p>\n<p> W.P. (C) No.24036 of 2010<br \/>\n<span class=\"hidden_text\">                                2<\/span><\/p>\n<p>rowdy list and the criterion adopted by the police for<\/p>\n<p>including petitioner in the rowdy list is not mentioned<\/p>\n<p>anywhere in the notice and inclusion of the name of the<\/p>\n<p>petitioner in the rowdy list is in violation of the fundamental<\/p>\n<p>rights of the petitioner and therefore a writ of mandamus is<\/p>\n<p>to be issued quashing Ext.P1 rowdy list so far it relates to<\/p>\n<p>the petitioner..\n<\/p>\n<p>      2.    The Sub Inspector of Police, Nallalam Police<\/p>\n<p>Station filed a statement to the effect that though crime<\/p>\n<p>No.236\/2001 and 140\/2006 were registered against the<\/p>\n<p>petitioner, in crime No.140\/2006 petitioner was acquitted<\/p>\n<p>and crime No.236\/2001 was quashed by this Court and the<\/p>\n<p>name of the petitioner was included in the rowdy list as he<\/p>\n<p>was engaged in unlawful activities and creating nuisance to<\/p>\n<p>the general public and also to his relatives as per the<\/p>\n<p>orders of the Assistant Commissioner of Police, South<\/p>\n<p>Kozhikode City, dated 15.8.2006.         It is also stated that<\/p>\n<p>subsequently on the acquittal and quashing of the cases,<\/p>\n<p>finding that activities of the petitioner are good, a report<\/p>\n<p>was sent to the Assistant Commissioner of Police, South<\/p>\n<p> W.P. (C) No.24036 of 2010<br \/>\n<span class=\"hidden_text\">                              3<\/span><\/p>\n<p>Kozhikode City to delete the name of the petitioner, from<\/p>\n<p>the rowdy list on 21.8.2010. It is contended that while<\/p>\n<p>opening the rowdy list in the name of the petitioner there<\/p>\n<p>was no violation of the norms and conditions and therefore<\/p>\n<p>the petition is to be dismissed.\n<\/p>\n<p>      3.    Learned counsel appearing for the petitioner and<\/p>\n<p>learned Public Prosecutor were heard.<\/p>\n<p>      4.    Though the Code of Criminal Procedure and<\/p>\n<p>Kerala Police Act do not provide for preparation of a rowdy<\/p>\n<p>list, Kerala Police Manual, 1970 Vol-II in Clause 259 of<\/p>\n<p>Chapter-III provides for preparation of rowdy history sheet.<\/p>\n<p>Chapter-III relates to Records of Crimes and Criminals and<\/p>\n<p>Surveillance     of    Bad  Characters.  Clause   250    the<\/p>\n<p>introduction to the Chapter reads &#8221; in order to facilitate<\/p>\n<p>the study of property crimes reported in Police Stations and<\/p>\n<p>of criminals involved in such cases, with a view to<\/p>\n<p>effectively deal with them, it is necessary to maintain a<\/p>\n<p>continuous record of the criminal history of such<\/p>\n<p>individuals and localities in all police stations. A careful<\/p>\n<p>study of these records will in a large measure help in crime<\/p>\n<p> W.P. (C) No.24036 of 2010<br \/>\n<span class=\"hidden_text\">                                4<\/span><\/p>\n<p>prevention work by taking due action in time against<\/p>\n<p>appropriate bad characters.       The headings in the forms<\/p>\n<p>comprising the registers are self explanatory and do not<\/p>\n<p>call for individual elucidation&#8221;. Clause 251 provides for<\/p>\n<p>maintenance of Station Crime History. Under the section,<\/p>\n<p>Station Crime History will be maintained in all Police<\/p>\n<p>Stations in six parts and it will be treated as a confidential<\/p>\n<p>record. Modifications necessary in respect of this record in<\/p>\n<p>Railway Police Stations are indicated in the chapter on<\/p>\n<p>Railway Police. It shows that Station Crime History is a<\/p>\n<p>record which is of great help to a new Station House<\/p>\n<p>Officer, an Investigating officer and also an Inspecting<\/p>\n<p>officer; the first for a proper study of crime and criminals in<\/p>\n<p>his new charge, the second for locating a criminal who<\/p>\n<p>would     probably     have  committed     the  crime   under<\/p>\n<p>investigation and the third for ascertaining whether the<\/p>\n<p>record is kept properly and utilised intelligently by the<\/p>\n<p>investigating and Station House Officers. Station Crime<\/p>\n<p>History Part-VI (Rowdy History Sheet) is provided under<\/p>\n<p>Clause 259. Clause 259 reads thus:\n<\/p>\n<p>W.P. (C) No.24036 of 2010<br \/>\n<span class=\"hidden_text\">                                5<\/span><\/p>\n<p>           &#8220;259 (1). This is a record maintained<br \/>\n     individually in      KPF      174 (D) to keep a<br \/>\n     progressive record and watch of the activities of<br \/>\n     persons found to be indulging in rowdyism.<br \/>\n     These sheets will be opened on the orders of the<br \/>\n     Sub Divisional      Police Officer or any higher<br \/>\n     authority on the basis of reports from the local<br \/>\n     police officer or from other sources-<\/p>\n<p>     (2)   The main forms of rowdyism are:-\n<\/p>\n<p>           (1)   Indecent behaviour towards women<br \/>\n     and girls at educational centres, bus stands<br \/>\n     parks, Railway Stations, running trains etc.., by<br \/>\n     passing obscene remarks etc. This is popularly<br \/>\n     known as &#8220;Eve-teasing&#8221;.\n<\/p>\n<p>           (2)   Habitually    committing    affray  and<br \/>\n     rioting.<\/p>\n<pre>\n           (3)   Habitually       committing     offences\n     involving stabbing (324 IPC)\n           (4)   Threatening       and     beating    up\n<\/pre>\n<p>     prosecution witnesses in court premises and<br \/>\n     forcing them to turn hostile, by hirelings<br \/>\n     employed by political parties, moneyed people<br \/>\n     etc.\n<\/p>\n<p>           (5)   Intimidation of peace loving people by<br \/>\n     acts of violence or by show of force or by abusive<br \/>\n     language.\n<\/p>\n<p>           (6)   Rowdyism in Cinema Halls, theatres,<br \/>\n     sports stadiums, milk booths, bus stands, toddy<br \/>\n     shops, running trains etc.<br \/>\n           (7)   Habitual gambling, smuggling of food<br \/>\n     grains and illicit distillation.\n<\/p>\n<p>           (8)   Forcible collection of subscriptions.<br \/>\n           (9)   Drunken and disorderly behaviour.<br \/>\n           (10) Decoying persons to houses of ill<br \/>\n     repute by pimps.\n<\/p>\n<p>           (11) Snatching of gold chains etc.<br \/>\n           (12) Any      other      anti-social  activity<br \/>\n     associated with violence<\/p>\n<p>W.P. (C) No.24036 of 2010<br \/>\n<span class=\"hidden_text\">                              6<\/span><\/p>\n<p>     (3)   The History Sheets will be maintained as<br \/>\n     shown below separately for each individual.<\/p>\n<p>           Section I.\n<\/p>\n<p>           (1)   Police Station<br \/>\n           (2)   District<br \/>\n           (3)   Date of opening, with reference to the<br \/>\n                 orders under which opened.\n<\/p>\n<p>           (4)   Date of closing, with the name and<br \/>\n                 designation of the officer passing the<br \/>\n                 order, and the reference number and<br \/>\n                 date of the order.\n<\/p>\n<p>           Section II.\n<\/p>\n<p>           (1)   Name of rowdy with aliases if any.<br \/>\n           (2)   Age (approx) and year<br \/>\n           (3)   Descriptive Roll (with photo if<br \/>\n                 available)<br \/>\n           (4)   Father&#8217;s name<br \/>\n           (5)   Address<br \/>\n           (6)   Profession or occupation if any of the<br \/>\n                 rowdy.\n<\/p>\n<p>           (7)   Probable haunts and resource.\n<\/p>\n<p>           (8)   Names of other Police Stations within<br \/>\n                 whose jurisdiction also he may be<br \/>\n                 active.\n<\/p>\n<p>           (9)   Associates with address.\n<\/p>\n<p>           (10) Near relatives with their address.<br \/>\n           (11) Short biography and circumstances<br \/>\n                 under which the sheet is opened.\n<\/p>\n<p>           (12) Running History.\n<\/p>\n<p>     N.B.:In    the running history all the criminal<br \/>\n     activities of the rowdy including reasonable<br \/>\n     suspicion of his complicity in cases and\/or<br \/>\n     complaints against him with crime numbers if<br \/>\n     any    and result of the cases etc.;, should be<br \/>\n     mentioned in separate paragraphs which should<br \/>\n     be numbered chronologically.         Against each<br \/>\n     entry in the running history there should be<\/p>\n<p>W.P. (C) No.24036 of 2010<br \/>\n<span class=\"hidden_text\">                                7<\/span><\/p>\n<p>     references to G.D entries, crime Nos. mass<br \/>\n     petitions, petty cases etc.<\/p>\n<p>     Section III.\n<\/p>\n<p>           Petitions and enquiry reports which may be<br \/>\n           of relevant in future security proceedings.<br \/>\n           Section IV.\n<\/p>\n<p>           Record of Check by C.Is and Instructions.<\/p>\n<p>     (4)   Rowdy history sheets in a Station shall be<br \/>\n     numbered serially in the following manner:-<\/p>\n<blockquote><p>           (1)   Separately for those resident in the<br \/>\n                 Station limits.\n<\/p><\/blockquote>\n<blockquote><p>           (2)   For non-residents separately for each<br \/>\n                 Station. Serial number will be written<br \/>\n                 in red ink and will be preceded by<br \/>\n                 abbreviation letters denoting the<br \/>\n                 particular Station.\n<\/p><\/blockquote>\n<p>      Note: The S.H.O of the Station in which the<br \/>\n             person for whom a Rowdy History Sheet<br \/>\n             is opened resides, shall furnish a copy of<br \/>\n             the sheet to the S.H.O of any other station<br \/>\n             in which also he may be active (ref. item 8<br \/>\n             Section ii) of the sheet.\n<\/p>\n<p>     (5)   The Sub Inspector of Police in charge of<br \/>\n     the Station should maintain the Rowdy History<br \/>\n     Sheets     personally    or   under    his   direct<br \/>\n     supervision. Whenever any entry is made in the<br \/>\n     G.D non-cognizable case register or Petty Case<br \/>\n     Register about an individual for whom a History<br \/>\n     Sheet is maintained, relevant notes from the<br \/>\n     above registers should be made in the History<br \/>\n     Sheets also.\n<\/p>\n<p>     (6)   The Circle Inspector of Police should check<br \/>\n     the Rowdy History Sheets of a Station during the<br \/>\n     visits and inspections and make a record of it<\/p>\n<p>W.P. (C) No.24036 of 2010<br \/>\n<span class=\"hidden_text\">                              8<\/span><\/p>\n<p>     with instructions, if any, in Section IV of the<br \/>\n     Sheet.\n<\/p>\n<p>     (7)   Activities of non-resident rowdies should be<br \/>\n     promptly communicated to the concerned Police<br \/>\n     Station in B.C Rolls after making entries in item<br \/>\n     12, Section II of Station History Sheet.<\/p>\n<p>     (8)   A Rowdy History Sheet may be closed on<br \/>\n     the orders of the Superintendent of Police, based<br \/>\n     on the recommendations of the Circle Inspector<br \/>\n     of    Police     routed   through   the    Deputy<br \/>\n     Superintendent         of     Police     Assistant<br \/>\n     Superintendent of Police.\n<\/p>\n<p>     (9)   List of Rowdies of a Circle will be<br \/>\n     maintained in the Office of the Circle Inspector<br \/>\n     of Police. The Circle Inspector of Police will<br \/>\n     check the list with the Rowdy History Sheets in<br \/>\n     the respective Police Station every half year.<\/p>\n<p>     (10) Rowdies may be dealt with under the<br \/>\n     following provisions of Law:-\n<\/p>\n<p>     (1)   Section 106 Cr.P.C (Security for keeping<br \/>\n     the peace on conviction)<\/p>\n<p>     (2)   Section 107 Cr.P.C (Security for keeping<br \/>\n     the peace etc)<\/p>\n<p>     (3)   Section 109 Cr.P.C (Security from vagrants<br \/>\n     etc.)<\/p>\n<p>     (4)   Section 110 (F) Cr.P.C (Security for good<br \/>\n     behaviour from a person so desparate and<br \/>\n     dangerous etc.)<\/p>\n<p>     (5)   Sections 48, 51 and 51 A of the Kerala<br \/>\n     Police Act      (For being found armed between<br \/>\n     sunset and      sunrise  intending to commit an<br \/>\n     offence, drunken and disorderly conduct, riotous<\/p>\n<p> W.P. (C) No.24036 of 2010<br \/>\n<span class=\"hidden_text\">                               9<\/span><\/p>\n<p>      or indecent behaviour in street etc. respectively)<\/p>\n<p>      (6)   Prosecution    in  appropriate  cases   for<br \/>\n      obscene act &#8211; songs &#8211; Section 294 IPC.<\/p>\n<p>      (7)   Prosecution for any other specific offence<br \/>\n      that may be committed.\n<\/p>\n<\/p>\n<p>      5.    A proper appreciation of Clause 259 makes it<\/p>\n<p>clear that      rowdy history sheet shall be maintained<\/p>\n<p>individually in     Kerala Police Form 174 (D) to keep a<\/p>\n<p>progressive record and      watch the activities of persons<\/p>\n<p>found to be indulging in rowdyism. Such sheets are to be<\/p>\n<p>opened on the orders of the Sub Divisional Police Officer<\/p>\n<p>or higher authority , based on the reports of the Local<\/p>\n<p>Police Officer or other sources. The forms of rowdyism as<\/p>\n<p>enumerated in Clause 259 are habitually committing affray<\/p>\n<p>and rioting, habitually committing stabbing, threatening<\/p>\n<p>and beating up prosecution witnesses in court premises<\/p>\n<p>and forcing them to turn hostile, intimidation of peace<\/p>\n<p>loving people by acts of violence or by show of force or<\/p>\n<p>abusive language, rowdyism in cinema halls, theatres,<\/p>\n<p>sports stadiums, milk booths, bus stands, toddy shops,<\/p>\n<p> W.P. (C) No.24036 of 2010<br \/>\n<span class=\"hidden_text\">                              10<\/span><\/p>\n<p>trains etc, forcible collection of subscriptions, habitual<\/p>\n<p>gambling and smuggling of food grains, illicit distillation,<\/p>\n<p>drunken and disorderly behaviour, decoying persons to<\/p>\n<p>houses of ill repute by pimps, snatching of gold chains etc.<\/p>\n<p>or other anti social activity associated with violence. Sub<\/p>\n<p>clause (5) of Clause 246 provides that a check register of<\/p>\n<p>rowdies shall be maintained in each Police Station and<\/p>\n<p>outposts in KPF No. 89 (A).\n<\/p>\n<p>      6.    Therefore, in the light of the instructions in<\/p>\n<p>Kerala Police Manual, it cannot be said that maintenance of<\/p>\n<p>a rowdy list is unauthorised. There is specific provision for<\/p>\n<p>maintenance of rowdy history sheet and it is for a purpose.<\/p>\n<p>The question then is whether the name of the petitioner<\/p>\n<p>could have been included in the rowdy list in view of the<\/p>\n<p>categories of cases provided in sub clause (2) of clause 259.<\/p>\n<p>      7.    Though two crimes were registered against the<\/p>\n<p>petitioner, one for the offences under Sections 341 and 294<\/p>\n<p>(b) of Cr.P.C, petitioner has already been acquitted in the<\/p>\n<p>case after recording the evidence. Though another crime<\/p>\n<p>was registered under Section 10 of      Unlawful Activities<\/p>\n<p> W.P. (C) No.24036 of 2010<br \/>\n<span class=\"hidden_text\">                              11<\/span><\/p>\n<p>(Prevention) Prevention Act 1967 on the allegation that<\/p>\n<p>petitioner is working for SIMI,       this Court has already<\/p>\n<p>quashed the said crime as against the petitioner. There is<\/p>\n<p>no other case registered against the petitioner.<\/p>\n<p>      8.    Learned Government Pleader submitted that<\/p>\n<p>two petitions were registered before Nallalam Police<\/p>\n<p>Station, the former on 31.12.2005         and the   latter on<\/p>\n<p>18.5.2006 and in the former the case was that petitioner<\/p>\n<p>scolded and caused obstruction of the lady complainant and<\/p>\n<p>in the latter the allegation was that petitioner has severed<\/p>\n<p>the service connection to the house of the complainant.<\/p>\n<p>There is no case that       in any of these petitions, after<\/p>\n<p>conducting enquiry or investigation a crime was registered.<\/p>\n<p>Therefore, it is clear that there is no justification for<\/p>\n<p>including the name of the petitioner in the rowdy history<\/p>\n<p>sheet, as petitioner is not guilty of any form of rowdyism as<\/p>\n<p>provided under sub clause (2) of Clause 259 of Chapter-III<\/p>\n<p>of the Kerala Police Manual. Moreover, the statement by<\/p>\n<p>the Sub Inspector will show that the Sub Inspector has<\/p>\n<p>addressed the Assistant Commissioner of Police to remove<\/p>\n<p> W.P. (C) No.24036 of 2010<br \/>\n<span class=\"hidden_text\">                               12<\/span><\/p>\n<p>the name of the petitioner from the rowdy list. In such<\/p>\n<p>circumstances, name of the petitioner in the rowdy list can<\/p>\n<p>only be removed.\n<\/p>\n<p>      The writ petition is allowed.
