     The petitioner is the sole accused in C.C.No 146\/2004<\/p>\n
pending before the      Judicial First Class Magistrate Court,<\/p>\n
Ranny which is a case instituted based upon Final Report,<\/p>\n
Annexure-I, in crime No. 25\/2004 of Ranny Police Station<\/p>\n
for the offence under section 379 of IPC. The petitioner<\/p>\n
now seeks an order under section 482 of Cr.P.C. quashing<\/p>\n
Annexure-I Final Report report and all further proceedings<\/p>\n
thereon pending before the court below.<\/p>\n
     2.   The averments in the above          Crl.M.C. is to the<\/p>\n
effect that    the petitioner      is the     son of the     2nd<\/p>\n
respondent’s brother. Both the petitioner’s father and the<\/p>\n
2nd respondent    claim ownership        over the    property in<\/p>\n
question   as the same belonged        to their mother.     The<\/p>\n
allegation against the petitioner is that he had        cut and<\/p>\n
removed 55 rubber trees, two coconut trees and two jack<\/p>\n
trees from the property owned by the 2nd respondent by<\/p>\n

the end of December 2003 and in between 16-1-2004. On<\/p>\n
the strength of the above allegation, the 2nd respondent<\/p>\n
lodged information before the Ranny police          station<\/p>\n
wherein F.I.R in crime No.25\/2004 for the offence under<\/p>\n
section 379 of IPC was registered against the petitioner.<\/p>\n
The Ranny Police,    after investigation, filed Annexure I<\/p>\n
final report on the basis of which the Judicial First Class<\/p>\n
Magistrate,    Ranny  took    cognizance    and  instituted<\/p>\n
C.C.No.146\/2004    for the above offence. It is the above<\/p>\n
case and Annexure I final report are being challenged in<\/p>\n
this Crl.M.C. and the petitioner    prays that the above<\/p>\n
proceedings may be quashed.\n<\/p>\n
      3.   I have heard the      learned counsel for the<\/p>\n
petitioner as well as the counsel for the 2nd respondent<\/p>\n
and also the learned Public Prosecutor.<\/p>\n
      4. The learned counsel appearing for the petitioner<\/p>\n
submitted that the petitioner has already approached the<\/p>\n
Munsiff’s court, Ranni by filing O.S No.47\/2004, copy of<\/p>\n
which is produced as Annexure 2. It is submitted by the<\/p>\n

counsel that in the above suit, the petitioner has got an<\/p>\n
interim    order   of   injunction   restraining  the   2nd<\/p>\n
respondent\/de facto complainant from dispossessing the<\/p>\n
petitioner from the property in question. It is the further<\/p>\n
case that as a counter blast to the above suit, the 2nd<\/p>\n
respondent filed a suit, i.e., O.S.No.74\/2004 before the<\/p>\n
same court which is produced as Annexure-3. It is also<\/p>\n
submitted by the petitioner’s counsel     that despite the<\/p>\n
above civil suit, the 2nd respondent has filed another suit<\/p>\n
also, i.e., O.S.211\/2004    claiming damages.     Thus the<\/p>\n
counsel for the petitioner submitted that a very serious<\/p>\n
civil dispute is pending before the    competent court and<\/p>\n
the petitioner   also claimed     absolute right  over the<\/p>\n
property as evidenced by Annexure 2 and the interim<\/p>\n
order passed thereon and therefore, according to the<\/p>\n
learned counsel for the petitioner, even if the so called<\/p>\n
items of trees were removed, it will not amount to theft<\/p>\n
as there is no dishonest intention. On the other hand,<\/p>\n
the said act can only be treated as part of his exercise of<\/p>\n

right over the property.\n<\/p>\n
      5.   Per contra, the learned counsel for the 2nd<\/p>\n
respondent submitted that the petitioner herein       had<\/p>\n
preferred the suit  O.S.47\/2004 only on 25-2-2004 as a<\/p>\n
counter blast to the criminal proceedings initiated at the<\/p>\n
instance of the    2nd    respondent.    On the basis of<\/p>\n
Annexure-I Final Report, the learned counsel submitted<\/p>\n
that the 2nd respondent approached the police on 18-1-<\/p>\n
2004 alleging the offence committed by the petitioner and<\/p>\n
after registration of crime on 18-1-2004 the police<\/p>\n
conducted a thorough investigation and the          stolen<\/p>\n
properties were recovered in accordance with law. It is<\/p>\n
also the case of the 2nd respondent that       they have<\/p>\n
approached     the civil court for claiming   damages by<\/p>\n
filing O.S.211\/2004.   According to the counsel for the 2nd<\/p>\n
respondent, the 2nd respondent has absolute ownership<\/p>\n
and right over the property in question and he is residing<\/p>\n
far    away from the property and it was in this<\/p>\n
circumstances, the petitioner herein filed O.S.47\/2004 on<\/p>\n

the ground of adverse possession.           According to the<\/p>\n
counsel, merely a suit was filed for adverse possession,<\/p>\n
no     absolute     ownership     will    confer    on   the<\/p>\n
plaintiff\/petitioner.\n<\/p>\n
     6. The learned Public Prosecutor submitted that on<\/p>\n
the basis of the        information furnished by the 2nd<\/p>\n
respondent,          police  have     registered F.I.R. and<\/p>\n
subsequently, investigation      was       undertaken  which<\/p>\n
resulted in Annexure -I final report and          during the<\/p>\n
investigation it is found that the petitioner has committed<\/p>\n
offence under section 379 of IPC. It is also pointed out<\/p>\n
that     during police investigation, no evidence         or<\/p>\n
documents produced by the petitioner to substantiate his<\/p>\n
right over the property defending the criminal allegation.<\/p>\n
     7. I have considered the submissions made by the<\/p>\n
counsel and also perused        the documents and records<\/p>\n
and materials       available on records.      The place of<\/p>\n
occurrence in the present        case is    pertained to the<\/p>\n
property    in    Sy.No.29\/16-4     (0.789    hectares) and<\/p>\n

Sy.No.29\/16-15 (0.0324 hectares), the total extent is<\/p>\n
0.01113 hectares which is equivalent to 27 1\/2 cents.<\/p>\n
From the submissions and various records filed by        the<\/p>\n
parties, it appears to me that a civil dispute is pending<\/p>\n
before the     competent court and      each of them are<\/p>\n
claiming their right over the property.     In the present<\/p>\n
case, after registering the      crime, police    conducted<\/p>\n
investigation and through their investigation they found<\/p>\n
that the petitioner has committed the offence. In support<\/p>\n
of the above allegation they      have produced     various<\/p>\n
materials.    Admittedly,     The petitioner herein had<\/p>\n
preferred the suit     O.S.47\/2004 only on       25-2-2004<\/p>\n
whereas FIR was registered on 18-1-2004. At the time of<\/p>\n
lodging the FIR, whether the petitioner has got any right<\/p>\n
over the property is a question of fact to be decided at the<\/p>\n
time of trial by both the criminal court as well as the civil<\/p>\n
court. At present the police after investigation found<\/p>\n
that the petitioner is guilty of the offence under section<\/p>\n
379 of IPC. I am not proposed to enter into the merits of<\/p>\n

the criminal case against the petitioner.     Whatever the<\/p>\n
defence the petitioner has got, the same can be raised<\/p>\n
before the trial court and if he has got any right over the<\/p>\n
property, the same can be      brought to the notice of the<\/p>\n
trial court.    The counsel for the petitioner submitted<\/p>\n
that even if the removal of the property is admitted, it will<\/p>\n
not amount to theft since the petitioner got right over<\/p>\n
the property and no dishonest intention can be attributed<\/p>\n
with the removal of property. It is relevant to note that<\/p>\n
in a proceedings under section 482 of Cr.P.C., this Court<\/p>\n
has no jurisdiction to conduct an enquiry and decide the<\/p>\n
right, when the    facts are under dispute.    Whether the<\/p>\n
petitioner   has  got right over the property in question<\/p>\n
and whether he had dishonest intention in removing the<\/p>\n
articles etc. are to be decided on the basis of evidence to<\/p>\n
be adduced at the time of trial.     It is also open to the<\/p>\n
petitioner to raise all his contentions regarding his right<\/p>\n
over the property    and other pleadings before the trial<\/p>\n
court at the time of framing of charge.\n<\/p>\n

     8. In the light of the above facts and circumstances,<\/p>\n
I am not inclined to interfere with the criminal trial, but<\/p>\n
the petitioner is at liberty to raise all objections and<\/p>\n
pleadings at the time of framing of charge and with the<\/p>\n
above observation, the Crl.M.C. is dismissed.<\/p>\n
