{"id":44680,"date":"2009-09-15T00:00:00","date_gmt":"2009-09-14T18:30:00","guid":{"rendered":"https:\/\/www.legalindia.com\/judgments\/khet-singh-vs-state-on-15-september-2009"},"modified":"2019-01-18T13:44:32","modified_gmt":"2019-01-18T08:14:32","slug":"khet-singh-vs-state-on-15-september-2009","status":"publish","type":"post","link":"https:\/\/www.legalindia.com\/judgments\/khet-singh-vs-state-on-15-september-2009","title":{"rendered":"Khet Singh vs State on 15 September, 2009"},"content":{"rendered":"<div class=\"docsource_main\">Rajasthan High Court &#8211; Jodhpur<\/div>\n<div class=\"doc_title\">Khet Singh vs State on 15 September, 2009<\/div>\n<pre>                                1\n                                     S.B.Cr.Revsion Petition No.272\/1994\n\n    IN THE HIGH COURT OF JUDICATURE FOR RAJASTHAN\n                      AT JODHPUR\n\n                            ORDER\n\n    S.B.CRIMINAL REVISION PETITION NO.272\/1994\n\n                           Khet Singh\n                               Vs.\n                       State of Rajasthan\n\n                Date of Order   ::   15.09.2009\n\n\n                           PRESENT\n\n\n            HON'BLE MR.JUSTICE H.R.PANWAR\n\n\nMr.Rajesh Bhati, Amicus Curiae for the petitioner.\nMr.O.P.Singaria, Public Prosecutor for State.\n\n\nBY THE COURT:<\/pre>\n<p>           The instant criminal revision petition under Section<\/p>\n<p>397 read with Section 401 Cr.P.C. is directed against the<\/p>\n<p>judgment and order dated 8.7.1994 passed by Sessions Judge,<\/p>\n<p>Jalore (for short &#8220;the appellate court&#8221;) whereby the appeal filed<\/p>\n<p>by the petitioner was partly allowed and while maintaining the<\/p>\n<p>conviction of the petitioner for offence under Section 16\/54 of<\/p>\n<p>the Rajasthan Excise Act, he was sentenced to undergo 6<\/p>\n<p>months&#8217; rigorous imprisonment and a fine of Rs.100\/-; in<\/p>\n<p>default of payment of fine to further undergo 15 days&#8217; simple<\/p>\n<p>imprisonment.\n<\/p>\n<p>           On a report lodged by the Excise Inspector on<\/p>\n<p>21.4.1985, the police investigated the matter and ultimately<\/p>\n<p>filed the challan against the petitioner for the offence under<\/p>\n<p>Section 16\/54 of the Rajasthan Excise Act. It is alleged that the<br \/>\n<span class=\"hidden_text\">                                   2<\/span><br \/>\n                                         S.B.Cr.Revsion Petition No.272\/1994<\/p>\n<p>petitioner was found with the possession of more than one<\/p>\n<p>bottle of wash along with material for preparing the illicit liquor.<\/p>\n<p>By   judgment    and     order   dated    12.4.1990,       the    Judicial<\/p>\n<p>Magistrate, First Class, Jalore (for short, &#8220;the trial court&#8221;<\/p>\n<p>hereinafter) convicted and sentenced the accused-petitioner.<\/p>\n<p>On an appeal, the appellate court passed the judgment and<\/p>\n<p>order impugned as noticed above. Hence, this revision petition.<\/p>\n<p>            I have heard learned Amicus Curiae and learned<\/p>\n<p>Public Prosecutor. Carefully gone through the orders passed by<\/p>\n<p>both the courts below.\n<\/p>\n<p>              It is contended by leraned             counsel      for the<\/p>\n<p>petitioner that witnesses PW-1 Lakma and PW-2 Sawiya are the<\/p>\n<p>motbir witnesses of the occurrence. They did not support the<\/p>\n<p>prosecution case and turned hostile. According to learned<\/p>\n<p>counsel for the petitioner, there is no independent witnesses to<\/p>\n<p>the alleged recovery. PW-3 Hari Singh is government employee<\/p>\n<p>being a Patwari of the area, who stated in his statement that<\/p>\n<p>the place from where the alleged wash said to have been<\/p>\n<p>recovered, was in the joint possession of the petitioner and his<\/p>\n<p>brother and therefore, according to learned counsel for the<\/p>\n<p>petitioner, there is no evidence worthwhile that it was the place<\/p>\n<p>exclusively possessed by the petitioner from where the bottle of<\/p>\n<p>wash and material for preparing illicit liquor have been<\/p>\n<p>recovered. In alternative, it was contended that the petitioner<\/p>\n<p>has already suffered the imprisonment of about one month out<\/p>\n<p>of six months&#8217; imprisonment awarded to him. The occurrence is<\/p>\n<p>of year 1985 and at the time of occurrence, the petitioner was<br \/>\n<span class=\"hidden_text\">                                      3<\/span><br \/>\n                                          S.B.Cr.Revsion Petition No.272\/1994<\/p>\n<p>     65-66 years of age and by now, 25 years have since elapsed,<\/p>\n<p>     therefore, substantive sentence of imprisonment awarded to<\/p>\n<p>     the petitioner may be reduced to the period already undergone<\/p>\n<p>     by him.\n<\/p>\n<p>                 On close scrutiny of the judgments and orders<\/p>\n<p>     impugned as also the statements of the prosecution witnesses,<\/p>\n<p>     in my view, there is concurrent finding of fact recorded by two<\/p>\n<p>     courts below and therefore, I do not find any ground to<\/p>\n<p>     interfere with the concurrent finding of facts recorded by courts<\/p>\n<p>     below convicting the petitioner. So far as the quantum of<\/p>\n<p>     sentence is concerned, since it was stated that at the time of<\/p>\n<p>     occurrence, the petitioner was 65-66 years of age and 25 years<\/p>\n<p>     have since elapsed from the date of occurrence and the<\/p>\n<p>     petitioner has already suffered imprisonment of about one<\/p>\n<p>     month out of the six months&#8217; imprisonment, therefore, in my<\/p>\n<p>     view, the   ends of justice would be met if the sentence of<\/p>\n<p>     imprisonment awarded to the petitioner is reduced to the<\/p>\n<p>     period of imprisonment already undergone by him.<\/p>\n<p>                 Consequently, the revision petition filed by the<\/p>\n<p>     petitioner is partly allowed and while maintaining the conviction<\/p>\n<p>     of the petitioner for the offence under Section 16\/54 of the<\/p>\n<p>     Rajasthan Excise Act and the amount of fine, the substantive<\/p>\n<p>     sentence of imprisonment awarded to the petitioner is reduced<\/p>\n<p>     to the period already undergone by him. The petitioner is on<\/p>\n<p>     bail.
