Cell is present before<br \/>\nthe Court.\n<\/p>\n<p>\tLearned<br \/>\nadvocate Mr.M.G.Nagarkar, on instructions from the said officer,<br \/>\nstates that the officer is in know of the order passed by this Court<br \/>\n(Coram: Hon&#8217;ble Mr.Justice M.R.Shah) dated 16th April 2010<br \/>\nin Company Application No.39\/2010 and Official Liquidator Report<br \/>\nNo.219\/2007 of which paragraph 6 reads as under:\n<\/p>\n<p> In<br \/>\nview of the above, Official Liquidator is hereby directed to see that<br \/>\nthe applicant is permitted to remove\/ dismantle plant and machinery,<br \/>\nbuilding structure and movable assets from the Mill premises, which<br \/>\nare sold to him\/it and there is no hindrance to the applicant in<br \/>\nremoving the same i.e. no difficulty would be faced by the applicant<br \/>\nfor ingress and outgress (sic egress) of the Mill premises of  assets<br \/>\nsold to him. Official Liquidator is hereby directed to have the<br \/>\ninventory of the trees in the Mill premises. In the facts and<br \/>\ncircumstances of the case and considering the facts as stated<br \/>\nhereinabove and request made by learned advocate appearing on behalf<br \/>\nof the applicant, the applicant is hereby granted further time for a<br \/>\nperiod of four months from today to remove \/ dismantle assets sold to<br \/>\nhim\/it on condition that the applicant shall deposit\/pay the amount<br \/>\nof Rs.20,000\/- per month for the delayed period. If the work of<br \/>\ndismantling of the plant and machinery and assets sold to the<br \/>\napplicant is completed prior thereto, liability for the additional<br \/>\namount shall be only up to that month. The applicant shall pay the<br \/>\nadditional amount at the rate of Rs.20,000\/- per month for the<br \/>\ndelayed period in the first week of every month. It is clarified that<br \/>\neven if the work of dismantling is completed during any part of the<br \/>\nmonth, the liability to pay additional amount shall be for whole of<br \/>\nthe month.\n<\/p>\n<p>With<br \/>\nthis, the present Company Application is disposed of. Notice is<br \/>\ndischarged.\n<\/p>\n<p>\tLearned<br \/>\nadvocate Mr.Nagarkar further states on instruction that the officer<br \/>\nis not aware as to why a complaint is made and a relief is sought in<br \/>\nthe present Application in paragraph 1(B) which reads as under:\n<\/p>\n<p> 1(B)<br \/>\nThe Hon&#8217;ble Court may be pleased to direct the respondent to instruct<br \/>\nthe personnel of GSTC\/GIDC  not to remain present and\/or<br \/>\ncreate hindrance and difficulties in carrying out the demolition work<br \/>\nand removal of the properties purchased by the applicants<br \/>\nin the facts and circumstances of the case and in the interest of<br \/>\njustice.\n<\/p>\n<p>\tSo<br \/>\nfar as not remaining present is concerned, such direction is not<br \/>\nrequired to be issued. But so far as direction sought to the effect<br \/>\nthat, &#8216;the personnel of G.S.T.C.\/G.I.D.C. not to create hindrance and<br \/>\ndifficulties in carrying out the demolition work and removal of the<br \/>\nproperties purchased by the applicants is concerned&#8217;, any such<br \/>\nattempt on the part of the personnel of G.S.T.C.\/ G.I.D.C. will<br \/>\namount to interference with the compliance of the order passed by<br \/>\nthis Court on 16th<br \/>\nApril<br \/>\n2010 in Company Application No.39\/2010 of which paragraph 6 is<br \/>\nreproduced hereinabove.\n<\/p>\n<p>\tAt<br \/>\nthis juncture, learned advocate Mr.Nagarkar, on instructions, assures<br \/>\nthis Court that the officer concerned will assure that order dated<br \/>\n16th April 2010 passed by this Court is allowed to be<br \/>\ncomplied with by the present applicant. He will see to it that either<br \/>\nby himself remaining present at the site or by deputing any other<br \/>\nresponsible officer at the site no hindrance or difficulty is created<br \/>\nin carrying out the demolition work and removal of the properties<br \/>\npurchased by the applicant.\n<\/p>\n<p>\tThe<br \/>\nofficer concerned to tender an unconditional apology to this Court<br \/>\nfor the alleged act of creating obstacle in compliance with the order<br \/>\nof this Court. Apology to be filed by tomorrow.
