Nanavati, learned Assistant Government Pleader waives<br \/>\nservice of Notice for respondent No.1.\n<\/p>\n<p>2.\tThis<br \/>\npetition under Article 226 of the Constitution of India has been<br \/>\nfiled, with the following prayers :\n<\/p>\n<p>&#8220;This<br \/>\nHonourable Court may be pleased to issue a writ of mandamus or any<br \/>\nother writ, order or direction :\n<\/p>\n<p>A)\tDirecting<br \/>\nthe Respondents to apply the judgment dt.18.2.2010 passed in Special<br \/>\nCivil Application No.324 of 2010 in the case of the petitioner and<br \/>\ngrant 1st higher grade scale to the petitioner from<br \/>\n16.10.1985 i.e. after completion of 9 years of service from the date<br \/>\nof appointment instead of 11.11.1993 and grant her consequential<br \/>\nbenefits  accordingly.\n<\/p>\n<p>B)\tDuring<br \/>\nthe pendency and final disposal of this petition, the Respondents may<br \/>\nbe directed to reconsider the case of the petitioner for grant of<br \/>\nhigher grade scale w.e.f. 16.10.1985 in light of the judgment<br \/>\ndt.18.2.2010 passed in Special Civil Application No.324 of 2010.\n<\/p>\n<p>C)\tTo<br \/>\ngrant such and further relief as may b e deemed fit and proper.&#8221;\n<\/p>\n<p>3.\tHeard<br \/>\nMr.A.S.Supehia, learned counsel for the petitioner. It is submitted<br \/>\nby him that the petitioner has become entitled to the first higher<br \/>\ngrade scale from 16.10.1985, after completion of nine years of<br \/>\nservice as Mukhya Sevika. The departmental examination of the<br \/>\npetitioner under the Gujarat Public Health Service Examination Rules,<br \/>\n1993 was held and the petitioner cleared the same on 11.11.1993. She<br \/>\nwas, therefore, granted 1st higher grade scale vide order<br \/>\ndated 25.7.2002 with effect from 11.11.1993. It is further submitted<br \/>\nthat the name of the petitioner stands at Serial No.6 of the said<br \/>\norder. The petitioner is entitled to higher grade scale with effect<br \/>\nfrom 16.10.1985 i.e. after completion of nine years of service from<br \/>\nthe date of her appointment instead of from 11.11.1993. It is further<br \/>\ncontended by the learned counsel for the petitioner that in similar<br \/>\nsituations, similarly situated persons filed Special Civil<br \/>\nApplication No.8181\/1998, which was allowed by judgment dated<br \/>\n6.8.1999. The said judgment was subject matter of challenge in<br \/>\nLetters Patent Appeal No.663\/2000 and the appeal filed by the<br \/>\nrespondent department was rejected by order dated 28.1.2010 of the<br \/>\nDivision Bench. It is further urged that the other similarly situated<br \/>\npersons have also filed Special Civil Application No.324\/2010 and<br \/>\nallied matters, which have been allowed by judgment dated 18.2.2010<br \/>\nof the learned Single Judge. The respondents have complied with the<br \/>\njudgment of the learned Single Judge dated 18.2.2010 by passing order<br \/>\ndated 30.10.2010. Hence, as the<br \/>\ncase of the petitioner is similar, the same treatment ought to be<br \/>\nmeted out to him.\n<\/p>\n<p>4.\tAt<br \/>\nthis stage, the learned counsel for the petitioner states that<br \/>\nthe interest of justice would be met, if the petitioner is permitted<br \/>\nto make a representation to respondent No.1, within a period of two<br \/>\nweeks from today and the said respondent may be directed to consider<br \/>\nand decide the same, in the light of the judgments of this Court and<br \/>\nthe orders, passed in the case of similarly situated persons.\n<\/p>\n<p>5.\tUpon<br \/>\nthe above statement being made by the learned counsel for the<br \/>\npetitioner, the following order is passed :\n<\/p>\n<p>\tThe<br \/>\npetitioner shall make a representation to respondent No.1, within a<br \/>\nperiod of two weeks from today. In<br \/>\nthe event that the representation is made within the stipulated<br \/>\nperiod of time, respondent No.1 shall consider and decide the same,<br \/>\nin the light of the judgments of this Court in the cases of similarly<br \/>\nsituated persons, as also order dated 30.10.2010 passed in the case<br \/>\nof persons, whose cases are stated to be similar to that of the<br \/>\npetitioner.
