Justice V.GIRI\n\n Dated :13\/06\/2008\n\n O R D E R\n                            V.GIRI,J.\n                     -------------------------\n                W.P ( C) No. 16955 of 2008\n                     --------------------------\n              Dated this the 13th June, 2008\n\n                       J U D G M E N T\n<\/pre>\n<p>     Petitioner is working as Junior Public Health Nurse<\/p>\n<p>in the Primary Health Centre at Mulamkunnathukavu in<\/p>\n<p>Thrissur District. In the provisional list relating to the<\/p>\n<p>transfer of Junior Public Health Nurses within the state,<\/p>\n<p>there was no proposal to disturb the petitioner as such.<\/p>\n<p>But when Exhibit-P1 order was issued petitioner found<\/p>\n<p>that she has been transferred to the Primary Health<\/p>\n<p>Centre at Velur.     Petitioner has submitted Exhibit-P3<\/p>\n<p>representation seeking a variation of the same before the<\/p>\n<p>2nd respondent and the same is pending consideration.<\/p>\n<p>She has pointed out the other stations wherein she could<\/p>\n<p>be accommodated in Exhibit-P2.\n<\/p>\n<p>     2.    Learned     counsel       for     the    petitioner<\/p>\n<p>Sri. Gopinatha Menon submits that the person who has<\/p>\n<p>been    posted    in   the     place     of    petitioner   at<\/p>\n<p>Mulamkunnathukavu is undergoing training and therefore<\/p>\n<p>W.P ( C) No. 16955 of 2008<br \/>\n<span class=\"hidden_text\">                                  2<\/span><\/p>\n<p>there is no incumbent to discharge the functions<\/p>\n<p>at    Mulamkunnathukavu          even      now.    Apparently<\/p>\n<p>Smt.Geetha.K.K, who has been posted in the place of the<\/p>\n<p>petitioner had joined duty at Mulamkunnathukavu, but<\/p>\n<p>immediately she proceeded on leave. This aspect may also<\/p>\n<p>be considered by the 2nd respondent.\n<\/p>\n<p>      In the result, the writ petition is disposed of directing<\/p>\n<p>the 2nd respondent to consider and pass orders on Exhibit-<\/p>\n<p>P3, within three weeks from the date of receipt of a copy of<\/p>\n<p>this judgment.
