     The first respondent before the Tribunal, who is<\/p>\n
the owner of the vehicle involved in the accident, is<\/p>\n
challenging the award of the Tribunal in this appeal.<\/p>\n
The first respondent\/claimant sustained injuries in a<\/p>\n
motor accident which occurred at 4.30 p.m. on<\/p>\n
26\/12\/04. The claim petition was filed with the<\/p>\n
averments that the accident occurred when he was<\/p>\n
travelling in the vehicle (jeep) driven by the second<\/p>\n
respondent therein and that he was thrown out of the<\/p>\n
vehicle due to rash and negligent driving of the second<\/p>\n
respondent. On consideration of evidence adduced, the<\/p>\n

      Tribunal found that the first respondent\/claimant is<\/p>\n
      entitled to      get compensation   to  the tune of<\/p>\n
      Rs.2,68,230\/-. The said amount was ordered to be<\/p>\n
      paid along with 7.5% interest per annum and<\/p>\n
      Rs.5,000\/- as cost. The first appellant herein was<\/p>\n
      directed to make payment of the amount finding that<\/p>\n
      the third respondent, insurer of the vehicle is not<\/p>\n
      liable, because the policy in question will not cover<\/p>\n
      compensation payable to any passengers carried in the<\/p>\n
      vehicle. The vehicle in question is a private jeep and<\/p>\n
      the claimant was considered only as a gratuitous<\/p>\n
      passenger.\n<\/p>\n<\/p>\n
             2. Sri.Sheji P. Abraham, the learned counsel<\/p>\n
      appearing for the appellant had pointed out that the<\/p>\n
      version put forth by the first respondent\/claimant<\/p>\n
      before the Tribunal is totally contradictory to the<\/p>\n

      version illustrated in the police records. Exts.A1 to A5<\/p>\n
      are documents marked on behalf of the first<\/p>\n
      respondent\/claimant and it pertains to the criminal<\/p>\n
      case registered by the police authorities with respect<\/p>\n
      to the accident. On a perusal of Exts.A1 to A5<\/p>\n
      documents it is revealed that the entire police case is<\/p>\n
      proceeded on the basis that the accident occurred<\/p>\n
      when the jeep in question had hit the claimant, who<\/p>\n
      was a pedestrian. Therefore, it is pointed out that the<\/p>\n
      documents produced by the claimant himself will prove<\/p>\n
      that the claim put forth before the Tribunal is not true<\/p>\n
      and correct. According to the appellant, since no oral<\/p>\n
      evidence was adduced before the Tribunal, the<\/p>\n
      appellant was not in a position to controvert version of<\/p>\n
      the claimant as illustrated in the claim petition. It is<\/p>\n
      further contended that, if the accident is occurred as<\/p>\n

      enumerated in the Police records, the claimant will be<\/p>\n
      in the status of a third party and in such case the third<\/p>\n
      respondent\/insurer will be liable for payment of the<\/p>\n
      compensation. But, on a perusal of copy of the written<\/p>\n
      statement filed by the appellant before the Tribunal,<\/p>\n
      we notice that no such contention based on the police<\/p>\n
      records is seen raised before the Tribunal. At the same<\/p>\n
      time, we notice that evidence adduced before the<\/p>\n
      Tribunal through Exts.A1 to A5, marked on behalf of<\/p>\n
      the claimant, reveals a different version regarding the<\/p>\n
      accident, which will run contradictory to the version<\/p>\n
      put forth by the claimant. Inspite of those documents<\/p>\n
      produced in evidence, the Tribunal has omitted to<\/p>\n
      notice the contents thereof.\n<\/p>\n<\/p>\n
             3. Under the above mentioned circumstances,<\/p>\n
      despite omission on the part of the appellant in raising<\/p>\n

      relevant contentions, in our considered view, it is only<\/p>\n
      just and proper that the matter need consideration<\/p>\n
      afresh. We feel that it is only just and proper to afford<\/p>\n
      all the parties in the claim petition to adduce proper<\/p>\n
      pleadings and evidence before the Tribunal to achieve<\/p>\n
      ends of justice. Hence, we are proposing to remand<\/p>\n
      the case for fresh disposal on imposing sufficient<\/p>\n
      terms and conditions on the appellant to compensate<\/p>\n
      their latches and with a view to secure interest of the<\/p>\n
      claimant.\n<\/p>\n<\/p>\n
             4. In the result, the impugned award of the<\/p>\n
      Tribunal is hereby set aside on condition of the<\/p>\n
      appellant\/first    respondent    deposits  a   sum     of<\/p>\n
      Rs.25,000\/- before the Tribunal towards part payment<\/p>\n
      of the compensation on a provisional basis, within a<\/p>\n
      period of one month from today. The appellant shall<\/p>\n

      also pay a sum of Rs.5,000\/- as cost to the High Court<\/p>\n
      Legal Services Committee on or before 09\/05\/2010<\/p>\n
      and     produce    receipt before   the  Tribunal.   On<\/p>\n
      compliance of the conditions as stipulated above, the<\/p>\n
      Tribunal shall take up the case and to dispose of the<\/p>\n
      same afresh after affording opportunity to all the<\/p>\n
      parties to make necessary amendments in the<\/p>\n
      pleadings and to adduce evidence in the claim petition.<\/p>\n
      The parties are directed to appear before the Tribunal<\/p>\n
      on 19\/04\/2010. The Tribunal shall dispose of the case<\/p>\n
      at the earliest possible, at any rate within a period of<\/p>\n
      three months from the date of appearance.<\/p>\n
             5. It is submitted by learned counsel for the<\/p>\n
      appellant that a sum of Rs.25,000\/- has already been<\/p>\n
      deposited before the Tribunal. If there is any such<\/p>\n
      payment, the same shall be treated as compliance of<\/p>\n

      the conditions stipulated hereinabove and the Tribunal<\/p>\n
      shall allow the first respondent\/claimant to withdraw<\/p>\n
      the said amount subject to final result of the claim<\/p>\n
      petition.\n<\/p>\n<\/p>\n
             6. The appeal is allowed and the case is<\/p>\n
      remanded as above. No order as to costs of parties.<\/p>\n
