So far the impugned order dated 2.9.2011<\/p>\n<p>                    is concerned, it appears that the court below has only<\/p>\n<p>                    called for the record of the title suit and, therefore, still<\/p>\n<p>                    the objection filed by the respondent has not been decided<\/p>\n<p>                    and moreover, admittedly, the petitioner filed rejoinder to<\/p>\n<p>                    the objection.\n<\/p>\n<p>                               In such circumstances, the Executing Court has<\/p>\n<p>                    only called for the original record of the title suit therefore,<\/p>\n<p>                    by the order the rights of the party have not been decided.<\/p>\n<p>                    I therefore, find no jurisdiction error in the impugned<\/p>\n<p>                    order and accordingly, this writ application has got no<\/p>\n<p>                    merit and thus, it is dismissed. However, the Executing<\/p>\n<p>                    Court shall dispose of the objection after hearing the<\/p>\n<p>                    parties as early as possible.\n<\/p>\n<\/p>\n<pre>S.S.
