4. We have heard Sri Sanjay S.i{ata.gei’lii,flearned counsel for<\/p>\n
the appellant–clairr1arit_anc[l   li\u00e9ieshpande, learned<\/p>\n
counsel for the  Cornpany. Though the
\nIs: reSp0Ddet:.t.is.,serire;d;\u00a7:.;he  unrepresented. Having
\nheard learned ‘for the parties, the point that
\narises for considerationiiisiii ”\n<\/p>\n
 Wh,e:ther’~the cornpensation awarded under judgment and<\/p>\n
award  by the Tribunal is just and proper or it<\/p>\n
 requiresthe-nthanciernentiand if so, to what extent?<\/p>\n
 Sri Sanjay S.Katageri, learned counsel for the appellarit<\/p>\n
‘ciointend that disability certi\ufb01cate produced by the claimant<\/p>\n
  marked at Ex.P1O has not been considered in its proper<\/p>\n
\ufb01n<\/p>\n

This evidence of the doctor has remained .unchall=erige’d i.ve.,u <\/p>\n
the Insurance company has not cross–eX_am;ine;i the doctor  this<\/p>\n
certi\ufb01cate issued by PW2. It is the-._speciiic_ ‘case tofu”t.he._ciai3mant.ii’<\/p>\n
that he is unable to do the work  ‘vvasi  prior to the
\naccident and on account of  there has been
\ndisability to the left foot to an   nature of work
\nhe was carrying on   it is not possible
\nfor him to do the;’sair1.e  who has been examined
\nhas denied Zithiem   respondent that the
\npetitioner~clai’rnariit do the routine work as he was
\ndoing earlierr The-Vdisabilitykcerti\ufb01cate having not been disputed
\nan-tithe  nconipanyihaving not chosen to contradict this<\/p>\n
evideniceiiviz.A,”-the:’disability certi\ufb01cate EX.PlO either by seeking<\/p>\n
:'”Y._reference. to anoltvhierciz doctor or by producing any other contra<\/p>\n
Vihrnaterial to disprove this fact, we have no other option but to<\/p>\n
~thiVs”d.isability certi\ufb01cate which is at Ex.P1O and accordingly<\/p>\n
ii”-4v.te_ do so? In the said disability certi\ufb01cate it is concluded that the<\/p>\n
  to the left foot is to the extent of 35%. Thus, the whole<\/p>\n

body disability can be arrived at is 1\/31″ of the disability–__to the<\/p>\n
particular limb ie, at 10%.\n<\/p>\n<\/p>\n
8. We have seen from the judgrnent\u00bband  the i<\/p>\n
Tribunal that it has not taken into consideratioin the_lfuture”<\/p>\n
earning capacity of the claimant”‘–~on account livof injury”?<\/p>\n
sustained. Having held that the  to the en.t..ire_.body is to
\nthe extent of 10%, the compe:i1satior:{.g’lobe’awarded under this
\nhead is to be accordingly calculated. “the claimant was

\nincome would  p.m. Accordingly the total
\ncompensatibnggggpayablel’under the heading loss of future earning<\/p>\n
wouldbel\u20ac’s:.A30.tjXl2<eRs.3,6O0\/– p.a. and the relevant multiplier to<\/p>\n
  applied  age of the claimant at 33 years would be 16.<\/p>\n
_j:lThus,V.gthe totaljcompensation payable under the head "loss of<\/p>\n
4:\u00a3u\u00a3izl-to-j\u00bb earning" would _be Rs.3,60()xl6==Rs.57,600\/– and<\/p>\n
iidlaccordinigly We award the same.\n<\/p>\n<\/p>\n
9. In so far as the loss of amenities is concerned, the<\/p>\n
Tribunal under the heading loss of expectation in 1i’f\u00a2,’v.”fIp,\u00a7sv.. of<\/p>\n
comforts and happiness has combined the loss of gainenities <\/p>\n
has awarded a total sum of Rs.10,000\/ –_. \u00bb.~Hence.’thei4ll i<\/p>\n
awarded under the heard loss of amenitieisi”also*–requi:es:”to “be<\/p>\n
enhanced by granting an additi5_:ia1.. sum of.  5 and”.<\/p>\n
accordingly, the same is awarded;-..Vg’ Thus ha’ totali sum of
\nRs.67,600\/- is awarded bylwaiy pofi\u00ab’en.hancein:en\u00abt’under these two
\nheads. Hence the following orderis   1 * ‘<\/p>\n
(1) The appealiiieslgallowed ‘iii p.ar.f_t.ll <\/p>\n
(ii) ‘;{_:’he<  [ enhanced by Rs.67,600\/~
\ntoigether  6% p.a. from the date of
\n_ .petitior1 tilldie date "of payment.\n<\/p>\n
   iltheilgjsaid enhanced amount, 50% of the amount
\nl’ ,5iarithlipiioportionate interest shall be kept in a \ufb01xed
\ndepi1;sit in a nationalised bank’ for a period of five years<\/p>\n
lilifand the appellant shall be entitled to withdraw<\/p>\n
periodical interest. The remaining 50% with<\/p>\n

proportionate interest shall be reieased in favouzjof the<\/p>\n
