Chandnani of Mumbai filed an RTI-application with the Public<br \/>\nInformation Officer, Ministry of External Affairs, New Delhi on 14 February 2008<br \/>\nwherein he sought passport details of two individuals.\n<\/p>\n<p>2.    The PIO vide his letter dated 28 February 2008 replied to his RTI-application.<br \/>\nNot satisfied with the reply of the PIO, the Appellant filed an appeal with the first<br \/>\nAppellate Authority on 10 March 2008 who vide his letter dated 24 March 2008<br \/>\nreplied to it. Thereafter, the Appellant approached the Commission with a Second<br \/>\nAppeal on 15 July 2008, which was registered in the Commission on 18\/08\/2008.\n<\/p>\n<p>3.   The Bench of Dr. O.P. Kejariwal, Information Commissioner, heard the matter<br \/>\non 17 October 2008.\n<\/p>\n<p>4.    Shri R.N. Kajla, US (CPV-RTI) &amp; PIO, represented the Respondents.\n<\/p>\n<p>5.   The Appellant, Shri Bhagwan K. Chandnani, was present in person.\n<\/p>\n<p>Decision:\n<\/p>\n<p>6.    The Commission heard both the sides and broadly agreed with the submission<br \/>\nof the Respondent that the information asked for by the Appellant about two<br \/>\nindividuals was purely a personal matter constituting third party information. During<br \/>\nthe hearing, the Appellant, however, alleged certain irregularities on the part of the<br \/>\npersons about whom he was asking for information.           The Commission drew his<br \/>\nattention to the provision of the Act whereby the third party clause could be<br \/>\noverridden in case there was any public interest involved.            The Commission,<br \/>\n  therefore, gives one more opportunity to the Appellant to make his submission in<br \/>\n writing to establish that the matter has an element of public interest and was not<br \/>\n merely a case of a private dispute. This should be made by 14 November 2008. In<br \/>\n case no communication is received from the Appellant by that date, the matter will<br \/>\n be treated as finally closed.\n<\/p>\n<p> 7.
