The learned Judge was pleased to direct the petitioner to pay<br \/>\na sum of Rs.400\/- as costs of the petition to the respondent. The<br \/>\ncase of the petitioner was that the communication dated 2nd<br \/>\nSeptember 1997, whereby the representation\/ application dated 14th<br \/>\nAugust 1997 was rejected, was a non speaking order, was required to<br \/>\nbe quashed and set aside and it was required to be held by this Court<br \/>\nthat the petitioner-institution is entitled to receive grant. The<br \/>\nlearned Judge, after taking into consideration the submissions made<br \/>\nby the learned advocate for the petitioner and after taking into<br \/>\nconsideration the two decisions, which were relied upon by the<br \/>\nlearned advocate, which were found distinguishable as set out in<br \/>\nparagraphs 7 and 8, found that the petition has no merit.  The<br \/>\nlearned Judge also observed that,<\/p>\n<p>?S\t..\t..\tIt    is<br \/>\nnot   the   case   where the   petitioner-trust is  identically<br \/>\nsituated.     Otherwise also,  on  merits,   the petitioner once<br \/>\nhas accepted this conditional order it has to abide by it.  The<br \/>\npetitioner when accepted this condition clearly goes to show that it<br \/>\nwanted to serve the people of the area without taking any grant.<br \/>\nOnce  it has been decided to serve the people, I fail to see what for<br \/>\nthis claim has been  lodged  by  it.  Those  who  really want to<br \/>\nserve the people and those who are bona fide and genuine persons and<br \/>\nwant  to  serve  the  people never  bothers  about  this  grant etc..<br \/>\n The very fact that the petitioner is claiming for  grant  goes  to<br \/>\nshow  that  its real purpose and object is not of serving  the people<br \/>\nbut for some other object and purpose.  It  is  a  case  where the<br \/>\nrepresentation filed by the petitioner was not accepted and rightly<br \/>\nit is not accepted. I do not  consider  it  to be necessary in the<br \/>\npresent case to      decide whether the order impugned in this<br \/>\nspecial  civil      application  is  passed  in quasi-judicial<br \/>\nproceedings or not.??  \t  (emphasis supplied)<\/p>\n<p>2.\tLearned<br \/>\nadvocate, Ms.Sejal Mandavia for the appellant submitted that this<br \/>\nCourt (Coram : Akil Kureshi, J.) by judgement and order dated 5th<br \/>\nJuly 2006 in  Special Civil Application No.6381 of 1998 and allied<br \/>\nmatters, has issued certain directions to the State Government.  She<br \/>\nsubmitted that if the case of the appellant is also directed to be<br \/>\nconsidered in light of those directions, the appellant will rest<br \/>\ncontented.\n<\/p>\n<p>The<br \/>\ndirections issued by this Court are contained in para 18 of the<br \/>\njudgement, which are reproduced hereunder for ready perusal:\n<\/p>\n<blockquote><p>\t\t\t?S(i)<br \/>\n\t\t\tThe Government shall issue a G.R. laying down its policy for<br \/>\n\t\t\tconsidering the cases  as special cases for conversion  from<br \/>\n\t\t\tnon-grant-in-aid to grant-in-aid institutions.  Such a G.R. shall<br \/>\n\t\t\tbe issued along the line  of the affidavit-in reply filed by Shri<br \/>\n\t\t\tP.Panneervel on 8th March, 2006. This shall be done<br \/>\n\t\t\twithin a period of four weeks from the date of receipt of a copy<br \/>\n\t\t\tof this order.\n<\/p><\/blockquote>\n<blockquote><p>\t\t\tIn<br \/>\n\t\t\tall future cases, application  of interested institutions shall be<br \/>\n\t\t\tconsidered by the competent authority applying the guidelines so<br \/>\n\t\t\tlaid down  by the Government.\n<\/p><\/blockquote>\n<blockquote><p>\t\t\t  While<br \/>\n\t\t\tconsidering such applications, either accepting or rejecting, the<br \/>\n\t\t\tauthorities shall record and communicate the applicant its brief<br \/>\n\t\t\treasons for the conclusion.\n<\/p><\/blockquote>\n<blockquote><p>\t\t\tThe<br \/>\n\t\t\tapplications of  all the petitioners except those wherein the<br \/>\n\t\t\tinstitutions have been closed down will be considered by the<br \/>\n\t\t\tGovernment in light of the policy that may be circulated. Such<br \/>\n\t\t\tconsideration shall be prospective and on the basis of the<br \/>\n\t\t\tGovernment policy being framed.  Such consideration shall be<br \/>\n\t\t\texpeditious and the concerned institutions will be communicated<br \/>\n\t\t\tthe outcome thereof within a period of eight weeks from the date<br \/>\n\t\t\tof receipt of a copy of this order.\n<\/p><\/blockquote>\n<blockquote><p>\t\t\tTill<br \/>\n\t\t\tthe Government formulates its policy, the interim injunction<br \/>\n\t\t\tgranted by this Court by the order dated 13.2.2006  not to grant<br \/>\n\t\t\tany further applications to any of the institutions shall<br \/>\n\t\t\tcontinue.  It is, however, clarified that once the Government<br \/>\n\t\t\tpolicy is formulated as mentioned above, it will be open for the<br \/>\n\t\t\tGovernment to consider all cases on the basis of such policy.??\n<\/p><\/blockquote>\n<p>3.\tThe<br \/>\npresent Letters Patent Appeal is against the order of the learned<br \/>\nSingle Judge dated 10th April 2000.  As record stands, the<br \/>\norder does not warrant any interference.  That being so, the Letters<br \/>\nPatent Appeal deserves to be dismissed.  The same is accordingly<br \/>\ndismissed. Notice of admission is discharged.\n<\/p>\n<p>However,<br \/>\nthe request of the learned advocate is found reasonable and hence it<br \/>\nis directed that in the event the appellant herein approaches the<br \/>\nGovernment with a fresh application\/ representation, his case should<br \/>\nbe considered in light of the directions given by this Court in the<br \/>\nabove judgement and order dated 5th July 2006 in Special<br \/>\nCivil Application No.6381 of 1998.  It goes without saying that the<br \/>\nGovernment will consider the case of the appellant\/ petitioner on its<br \/>\nown merits in accordance with law and if the directions issued by<br \/>\nthis Court are applicable to the facts of the case of the appellant.\n<\/p>\n<p>(RAVI R.
