Jani for the respondent no.1-State of<br \/>\n\tGujarat and learned counsel, Mr.N.A. Brahmbhatt<br \/>\n\tfor the respondent no.2-original complainant waive service of notice<br \/>\n\tof rule.\n<\/p>\n<p>The<br \/>\n\tpresent application has been filed by the applicants under Section<br \/>\n\t482 of the Criminal Procedure<br \/>\n\tCode, 1973 for the prayer that the Complaint\/Inquiry<br \/>\n\tNo.22\/2011 filed before the Court of the Judicial Magistrate, First<br \/>\n\tClass, Vadodara, which has been registered as M.Case No.1\/2011 with<br \/>\n\tChhani Police Station may be quashed and set aside on the grounds<br \/>\n\tstated in the application.\n<\/p>\n<p>Heard<br \/>\n\tlearned counsel appearing for the respective parties.\n<\/p>\n<p>Learned<br \/>\n\tcounsel, Mr.Arpit Patel has referred to the papers including the<br \/>\n\twriting arrived at recording the settlement between the parties,<br \/>\n\twhich is produced at Annexure-C and submitted that the parties have<br \/>\n\tamicably resolved the dispute with regard to use of excess land in<br \/>\n\tquestion and, therefore, the present petition may be allowed.\n<\/p>\n<p>Learned<br \/>\n\tcounsel, Mr.Brahmbhatt appearing for the respondent no.2-original<br \/>\n\tcomplainant has no objection if the impugned FIR may be quashed.\n<\/p>\n<p>Therefore,<br \/>\n\thaving regard to the facts and circumstances of the case, the<br \/>\n\tpresent application deserves to be allowed.\n<\/p>\n<p>A<br \/>\n\tuseful reference can be made to the judgment of the Hon&#8217;ble Apex<br \/>\n\tCourt in case of Madan Mohan Abbot V\/s State of Punjab<br \/>\n\treported in (2008) 4 SCC 582, wherein it has been<br \/>\n\tspecifically observed in para No.6 as under :-\n<\/p>\n<p>\tWe<br \/>\n\tneed to emphasize that it is perhaps advisable that in disputes<br \/>\n\twhere the question involved is of a purely personal nature, the<br \/>\n\tCourt should ordinarily accept the terms of the compromise even in<br \/>\n\tcriminal proceedings as keeping the matter alive with no possibility<br \/>\n\tof a result in favour of the prosecution is a luxury which the<br \/>\n\tCourts, grossly overburdened as they are, cannot afford and that the<br \/>\n\ttime so saved can be utilized in deciding more effective and<br \/>\n\tmeaningful litigation. This is a common sense approach to the matter<br \/>\n\tbased on ground of realities and bereft of the technicalities of the<br \/>\n\tlaw.\n<\/p>\n<p>In<br \/>\n\tthe circumstances, the present application stands allowed. The the<br \/>\n\tComplaint\/Inquiry No.22\/2011 filed before the Court of the Judicial<br \/>\n\tMagistrate, First Class, Vadodara, which has been registered as<br \/>\n\tM.Case No.1\/2011 with Chhani Police Station is hereby quashed and<br \/>\n\tset aside. Rule is made absolute.
