No. I-21\/2010 registered with<br \/>\nSarkhej Police Station  for the alleged offences under sec.<br \/>\n406, 420, 120B of IPC.\n<\/p>\n<p>2.\tLearned<br \/>\nadvocate Mr. Hardik Dave referred to the FIR and other papers and<br \/>\nsubmitted that the applicant is having properties at Sarkhej<br \/>\nincluding shops at Shreeji Complex, godown and plot as stated in the<br \/>\napplication and he is also doing different businesses.\n<\/p>\n<p>3.\tLearned<br \/>\nadvocate Mr. Dave submitted that in February, 2009 he was approached<br \/>\nby one Hakambhai Rathod for purchase of aforesaid property\/shop of<br \/>\nthe applicant for which Banakhat was also entered into.  He submitted<br \/>\nthat part payment was made by cheque and power-of-attorney was<br \/>\nexecuted by the applicant in<br \/>\nfavour of Hakambhai, which led to filing of the present complaint as<br \/>\nthe said Hakambhai abused and misused the power-of-attorney.\n<\/p>\n<p>4.\tLearned<br \/>\nadvocate Mr. Dave submitted that the ingredients for the alleged<br \/>\noffences are not attracted as there is no entrustment and there is no<br \/>\nfalse promise made by the applicant.  He submitted that the witnesses<br \/>\nhave also not stated about any involvement of the applicant. Learned<br \/>\nadvocate Mr. Dave submitted that the transactions have been made by<br \/>\nthe applicant with the said Hakambhai prior to the scam of Ashok<br \/>\nJadeja was revealed and he is not concerned. He therefore submitted<br \/>\nthat the present application may be entertained.\n<\/p>\n<p>5.\tLearned<br \/>\nAPP Mr. Shukla submitted that a scam of duping large number of people<br \/>\nand huge amount was made by one Ashok Jadeja and the modus operandi<br \/>\nwas  that he would enter into transaction through agents and a<br \/>\nwidespread network for such offences was made. He submitted that<br \/>\nallegations are for the conspiracy also and the applicant is involved<br \/>\nas it is revealed from the prima facie evidence. He submitted that<br \/>\nthe investigation qua the applicant is at the initial stage.<br \/>\nCustodial interrogation may be necessary and therefore the present<br \/>\napplication may not be entertained.\n<\/p>\n<p>6.\tIn<br \/>\nview of rival submissions, it is required to be considered whether<br \/>\nthe present application can be entertained or not.\n<\/p>\n<p>7.\tIt<br \/>\nis well settled by catena of judicial pronouncements that discretion<br \/>\nunder sec. 438 of CrPC is required to be exercise with care and<br \/>\ncircumspection.  Therefore, considering the guidelines for exercise<br \/>\nof discretion under sec. 438 of CrPC in background of the facts<br \/>\nrevealed with regard to the transactions made by the applicant, which<br \/>\nprima facie suggest that he has entered into such transactions and<br \/>\nhas also made further transactions, which prima facie suggest his<br \/>\ninvolvement, the present application cannot be entertained.\n<\/p>\n<p>8.\tAs<br \/>\nthe court is not required to discuss in detail, considering the<br \/>\nnature of allegations with regard to the scam and the role<br \/>\nattributed, the discretion cannot be exercised in favour of the<br \/>\napplicant-accused.\n<\/p>\n<p>9.\tThe<br \/>\npresent application, therefore, deserves to be rejected and<br \/>\naccordingly stands rejected.
