{"id":45068,"date":"2010-01-04T00:00:00","date_gmt":"2010-01-03T18:30:00","guid":{"rendered":"https:\/\/www.legalindia.com\/judgments\/shri-nisar-ahmed-tamboli-dhule-vs-union-public-service-commission-on-4-january-2010"},"modified":"2018-11-02T03:09:40","modified_gmt":"2018-11-01T21:39:40","slug":"shri-nisar-ahmed-tamboli-dhule-vs-union-public-service-commission-on-4-january-2010","status":"publish","type":"post","link":"https:\/\/www.legalindia.com\/judgments\/shri-nisar-ahmed-tamboli-dhule-vs-union-public-service-commission-on-4-january-2010","title":{"rendered":"Shri Nisar Ahmed Tamboli, Dhule vs Union Public Service Commission &#8230; on 4 January, 2010"},"content":{"rendered":"<div class=\"docsource_main\">Central Information Commission<\/div>\n<div class=\"doc_title\">Shri Nisar Ahmed Tamboli, Dhule vs Union Public Service Commission &#8230; on 4 January, 2010<\/div>\n<pre>               CENTRAL INFORMATION COMMISSION\n                 Appeal No. CIC\/WB\/A\/2009\/01040 dated 6-6-2008\n                   Right to Information Act 2005 - Section 19\n\nAppellant:          Shri Nisar Ahmed Tamboli, Dhule\nRespondent:             Union Public Service Commission (UPSC)\n                             Decision Announced 4.1.'10\n\n\nFACTS<\/pre>\n<p>      By an undated application received in the UPSC on 18.2.2008 Shri<br \/>\nNisar Ahmed Tamboli of Dhule, Maharashtra applied to the CPIO, UPSC<br \/>\nseeking the following information:\n<\/p>\n<blockquote><p>      &#8220;Name and address of the Muslim candidates passed in the year<br \/>\n      2007 in the interview of: (a) IAS, (b) IPS, (c) IFS, (d) Allied<br \/>\n      Services.\n<\/p><\/blockquote>\n<blockquote><p>      Name and address of the Muslim candidates failed in the Main<br \/>\n      exam held in 2007 of (a) IAS, (b) IPS, (c) IFS, (d) Allied Services.\n<\/p><\/blockquote>\n<blockquote><p>      Name and address of the Muslim candidates failed in the<br \/>\n      Interview held in 2007 of (a) IAS, (b) IPS, (c) IFS, (d) Allied<br \/>\n      Services.\n<\/p><\/blockquote>\n<blockquote><p>      Name and address of the Muslim candidates failed in the<br \/>\n      preliminary exam held in 2007 of (a) IAS, (b) IPS, (c) IFS, (d)<br \/>\n      Allied Services.<\/p><\/blockquote>\n<p>      To this Shri Nisar Ahmed Tamboli received a response dated<br \/>\n27.2.2008 from CPIO Shri Prachish Khanna, DS, UPSC informing Shri<br \/>\nTamboli as follows: &#8211;\n<\/p>\n<blockquote><p>      &#8220;In this regard, it is regretted that the desired information is not<br \/>\n      available as the Commission do not maintain religion-wise data<br \/>\n      of the candidates appearing in the Civil Service Examination.&#8221;\n<\/p><\/blockquote>\n<blockquote><p>      Shri Tamboli, acknowledging that UPSC does not maintain religion-\n<\/p><\/blockquote>\n<p>wise data of the candidates, and not pressing for the information regarding<br \/>\npreliminary examinations, Shri Tamboli has then pleaded as follows before<br \/>\nthe Appellate Authority UPSC, Shri K. S. Bariar, Jt. Secretary (Exam):\n<\/p>\n<blockquote><p>      &#8220;The DVD maintained by the Commission of the addresses of<br \/>\n      the total candidates who failed in main exam (Written) and main<br \/>\n      exam (Interview Test) is possible to make available to the<\/p>\n<p><span class=\"hidden_text\">                                         1<\/span><br \/>\n        appellant. The appellant will sort out the names of the Muslim<br \/>\n       candidates.&#8221;<\/p><\/blockquote>\n<p>       Appellate Authority Shri K. S. Bariar Jt. Secretary (Exam), UPSC has,<br \/>\nhowever, dismissed the appeal by an order of 18-4-2008 as follows: &#8211;\n<\/p>\n<blockquote><p>       &#8220;I observe that the reply given by the CPIO, UPSC to the<br \/>\n       appellant is appropriate and just. In view of the above, I find<br \/>\n       nothing to be interceded in the matter at the appellate stage.&#8221;<\/p><\/blockquote>\n<p>       Shri Tamboli has then moved a second appeal before us with the<br \/>\nfollowing prayer: &#8211;\n<\/p>\n<blockquote><p>       &#8220;(i)    Order the Central public Information Officer, to provide<br \/>\n               the information in the form of DVD free of charge with the<br \/>\n               virtue of section 7 (6) and 19 (8) (a) (i) of the Act.\n<\/p><\/blockquote>\n<blockquote><p>       (ii)    Order the Central Public Information Officer to<br \/>\n               compensate the appellant Rs. 8,000\/- (eight thousand) as<br \/>\n               T. A. &amp; D. A. for attending the hearing to the Commission,<br \/>\n               New Delhi, with the virtue of section 19 (8) (b).\n<\/p><\/blockquote>\n<blockquote><p>       (iii)   Impose a penalty Rs. Two hundred and fifty from 17th<br \/>\n               March, 2008 till information is received by the appellant,<br \/>\n               u\/s 20 of the Act.\n<\/p><\/blockquote>\n<blockquote><p>       (iv)    To recommend for disciplinary action against the Central<br \/>\n               Public Information Officer under the provision of Central<br \/>\n               Civil Services Rules, 1964, on the strength of section 20<br \/>\n               of the Act.&#8221;<\/p><\/blockquote>\n<p>       The appeal was heard on 4.1.2010. Arrangements had been made for<br \/>\nvideoconference with Dhule, Maharashtra. The following are present at CIC<br \/>\nChambers, New Delhi.\n<\/p>\n<p>       Respondents<br \/>\n       Shri Naresh Kaushik, Advocate.\n<\/p>\n<p>       Ms. Amita Kalkal Chaudhry, Advocate.\n<\/p>\n<p>       Ms. Aditi Gupta, Advocate.\n<\/p>\n<p>       Shri Prachish Khanna, Dy. Secretary &amp; CPIO.<br \/>\n       Shri D. B. Das, Under Secretary.\n<\/p>\n<p>               Although informed of the date of hearing and arrangement for<br \/>\nvideoconference through our notice of 29-12-2009 appellant Shri Nisar<br \/>\nAhmed Tamboli opted not to be present. At the time of hearing his cell phone<br \/>\nwas also switched off and he was not available at his residence. Officials of<br \/>\nNIC reported that appellant had not contacted them with regard to the hearing.\n<\/p>\n<p>       Learned Counsel for respondents Shri Naresh Kaushik submitted that<br \/>\nreligion wise information is not stored with regard to the candidates appearing<\/p>\n<p><span class=\"hidden_text\">                                        2<\/span><br \/>\n for the UPSC Examination.         Moreover it is only the list of successful<br \/>\ncandidates that is compiled. There is no list of failed candidates. For the<br \/>\npurposes of conducting the exam roll numbers are assigned but there is no<br \/>\nlist maintained of the failed candidates either in the UPSC or in the DOPT,<br \/>\nwhich is the administrative Ministry for the examinations at issue.\n<\/p>\n<p>                              DECISION NOTICE<\/p>\n<p>       Because the concerned public authority, in this case the UPSC, does<br \/>\nnot hold the information sought, there is no information that CPIO, UPSC<br \/>\ncould have provided to appellant Shri Nisar Ahmed Tamboli. This should not,<br \/>\nhowever, deter Shri Tamboli from pursuing his declared objective of<br \/>\norganizing a voluntary Pre-training Center for Muslim candidates, since there<br \/>\nis little doubt that the representation of Muslims in the services is, in terms of<br \/>\npercentage, well below their proportionate percentage in India&#8217;s population.<br \/>\nAppellant Shri Tamboli may seek guidance on organising such a programme<br \/>\nfrom     the      Jamia     Hamdard         New     Delhi,     contactable      at<br \/>\ninquiry@jamiahamdard.edu, which runs a programme of this nature. With<br \/>\nthese remarks, because the appeal under RTI has no merit, however, this<br \/>\nappeal is now dismissed.\n<\/p>\n<p>       Announced in the hearing.
