Associates for Applicant. \nMR MG NANAVATI,\nADDL PUBLIC PROSECUTOR for\nRespondent. \n=========================================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\n HONOURABLE\n\t\t\tMR.JUSTICE H.B.ANTANI\n\t\t\n\t\n\n \n\nDate\n: 06\/10\/2010 \n\n \n\n \n \n ORAL\nORDER<\/pre>\n<p>\tThis<br \/>\napplication is preferred under Section 439 of the Code of Criminal<br \/>\nProcedure, 1973 seeking regular bail by the applicant, who came to be<br \/>\narrested in connection with FIR registered as M. Case No.1 of 2008<br \/>\nwith CID Crime, Bhuj, Rajkot Zone for the offence punishable under<br \/>\nSections 200, 203, 217, 465, 466, 467, 471, 472, 474, 475, 485, 406,<br \/>\n409 and 120.B of the Indian Penal Code.\n<\/p>\n<p>\tMr.\n<\/p>\n<p>Yogesh Lakhani, learned counsel for the applicant submitted that the<br \/>\napplicant is an innocent person and he has been falsely implicated in<br \/>\nthe alleged offence as narrated in the FIR.  The applicant is not at<br \/>\nall involved in the alleged commission of the offence, but a false<br \/>\ncase is foisted on him.  Even the applicant has not committed forgery<br \/>\nof any document.  Learned advocate submitted that the procedure for<br \/>\nallotment of land to the Bhuj Market Navnirman Trust [hereinafter<br \/>\nreferred to as the Trust] was completed after due diligence and<br \/>\nverifying the records and after recording the statements of the<br \/>\naffected persons from the Collector&#8217;s office.  Learned advocate for<br \/>\nthe applicant submitted that the applicant is simply a Trustee of the<br \/>\nTrust and he was also associated with other institutions.  On perusal<br \/>\nof the FIR, even a prima facie case is not made out against the<br \/>\napplicant and the FIR is filed against the applicant with ulterior<br \/>\nmotive.  Learned advocate for the applicant submitted that<br \/>\nconsidering the role attributed to the applicant as reflected in the<br \/>\nFIR, the applicant deserves to be enlarged on bail.  Learned advocate<br \/>\nfurther submitted that some co-accused who were Government officers<br \/>\ninvolved in the present case have also been released on bail by a<br \/>\nco-ordinate bench of this Court as per the order passed in Criminal<br \/>\nMisc. Application Nos. 6783\/2010 &amp; 4880\/2010 dated 02.08.2010 &amp;<br \/>\n02.08.2010 respectively.  Learned advocate further submitted that<br \/>\neven  some co-accused who were allottees of the shops have also been<br \/>\nreleased on bail by a co-ordinate bench of this Court as per the<br \/>\norders dated 24.09.2010 passed in Criminal Misc. Application No.<br \/>\n10430 of 2010 and 10428 of 2010. Learned advocate for the applicant<br \/>\nfurther submitted that even one of the main accused, Pradeep N.<br \/>\nSharma, has been released on regular bail by the Honourable Supreme<br \/>\nCourt vide order dated 06.09.2010 passed in Special Leave to Appeal<br \/>\n(Criminal) No. 6166 of 2010.  Learned advocate, therefore, submitted<br \/>\nthat even on the ground of parity, the applicant deserves to be<br \/>\nenlarged on regular bail.\n<\/p>\n<p>\tMr.\n<\/p>\n<p>Nanavati, learned Additional Public Prosecutor, while opposing the<br \/>\nbail application submitted that the applicant is involved in an<br \/>\noffence punishable under Sections 200, 203, 217, 465, 466, 467, 471,<br \/>\n472, 474, 475, 485, 406, 409 and 120.B of the Indian Penal Code.<br \/>\nConsidering the role attributed to the applicant and the manner in<br \/>\nwhich the applicant along with other co-accused have committed the<br \/>\noffence, which is of a serious nature, no discretionary relief be<br \/>\ngranted to the applicant and the application deserves to be rejected.\n<\/p>\n<p>\tHeard<br \/>\nlearned advocate Mr. Yogesh Lakhani for the  applicant and Mr.<br \/>\nNanavati, learned APP. I have also perused the averments made in the<br \/>\napplication as well as the FIR produced on record.  I have also<br \/>\nconsidered the role alleged against the applicant as relected in the<br \/>\nFIR.  The applicant at the relevant point of time was a trustee of<br \/>\nthe Trust.  One of the main accused, Pradeep N. Sharma, has been<br \/>\nreleased on regular bail by the Honourable Supreme Court.  Even some<br \/>\nco-accused, who were Government Officers and who have played larger<br \/>\nrole than the present applicant as reflected in the FIR, have also<br \/>\nbeen released on bail, as stated hereinabove.  Considering the role<br \/>\nalleged against the applicant, the gravity of the offence, nature of<br \/>\nthe offence and the manner in which the offence committed as well as<br \/>\nthe provisions of sections 200, 203, 217, 465, 466, 467, 471, 472,<br \/>\n474, 475, 485, 406, 409 and 120.B of the Indian Penal Code and the<br \/>\nquantum of punishment,  I am of the view that the the  applicant is<br \/>\nrequired to be enlarged on regular bail at this stage, without<br \/>\nentering into the merits of the case and without discussing the<br \/>\nevidence in detail.\n<\/p>\n<p>\tIn<br \/>\nthe facts and circumstances of the case, the application is allowed<br \/>\nand the  applicant is ordered to be enlarged on bail in connection<br \/>\nwith  M.
