SANKARAN, J.\n                    ---------------------------\n                    B.A. No. 6139 of 2009\n               ------------------------------------\n           Dated this the 10th day of November, 2009\n\n\n                           O R D E R\n<\/pre>\n<p>     This is an application for anticipatory bail under Section<\/p>\n<p>438 of the Code of Criminal Procedure. The petitioner is the<\/p>\n<p>accused in Crime No. 645\/2009 of Sasthamcotta Police Station.<\/p>\n<p>     2.   The offences alleged against the petitioner are under<\/p>\n<p>Sections 379 and 188 of the Indian Penal Code and Section 12<\/p>\n<p>read with Section 20 and 21 of the Kerala Protection of River<\/p>\n<p>Banks and Regulation of Removal of Sand Act, 2001.<\/p>\n<p>     3.   When the Bail Application came up for hearing on<\/p>\n<p>26.10.2009, the following order was passed:<\/p>\n<blockquote><p>               &#8220;After having heard the learned counsel<br \/>\n         for the petitioner and the learned Public<br \/>\n         Prosecutor, I am of the view that before<br \/>\n         disposing    of    the    Bail   Application,   an<br \/>\n         opportunity should be given to the petitioner to<br \/>\n         appear     before   the    investigating   officer.<br \/>\n         Accordingly, there will be a direction to the<br \/>\n         petitioner to appear before the investigating<br \/>\n         officer at 9 A.M. on 4th and 5th        November,<br \/>\n         2009.\n<\/p><\/blockquote>\n<blockquote><p>          Post on 10.11.2009.\n<\/p><\/blockquote>\n<p><span class=\"hidden_text\">B.A. No. 6139 of 2009          2<\/span><\/p>\n<blockquote><p>                  It is submitted by the learned Public<br \/>\n            Prosecutor that the petitioner will not be<br \/>\n            arrested until further orders in connection with<br \/>\n            Crime No. 645\/2009 of Sasthamcotta Police<br \/>\n            Station, Kollam.\n<\/p><\/blockquote>\n<blockquote><p>                  Hand over copy of this order to both<br \/>\n            sides.&#8221;<\/p><\/blockquote>\n<p>      4. The learned counsel for the petitioner as well as the<\/p>\n<p>learned Public Prosecutor submitted that the petitioner has<\/p>\n<p>complied with the directions contained in the order dated<\/p>\n<p>26.10.2009.\n<\/p>\n<p>      5. Taking into account the facts and circumstances of the<\/p>\n<p>case, the nature of the offence and other circumstances, I am<\/p>\n<p>of the view that anticipatory bail can be granted to the<\/p>\n<p>petitioner. There will be a direction that in the event of the<\/p>\n<p>arrest of the petitioner, the officer in charge of the police<\/p>\n<p>station shall release him on bail on his executing bond for Rs.<\/p>\n<p>15,000\/- with two solvent sureties for the like amount to the<\/p>\n<p>satisfaction of the officer concerned, subject to the following<\/p>\n<p>conditions:\n<\/p>\n<blockquote><p>         A) The petitioner shall        report    before the<br \/>\n            investigating officer between 9 A.M and 11<br \/>\n            A.M. on all alternate Mondays, till the final<br \/>\n            report is filed or until further orders;\n<\/p><\/blockquote>\n<p><span class=\"hidden_text\">B.A. No. 6139 of 2009         3<\/span><\/p>\n<blockquote><p>         B) The    petitioner  shall   appear    before   the<br \/>\n            investigating officer for interrogation as and<br \/>\n            when required;\n<\/p><\/blockquote>\n<blockquote><p>         C) The petitioner shall not try to influence the<br \/>\n            prosecution witnesses or tamper with the<br \/>\n            evidence.\n<\/p><\/blockquote>\n<blockquote><p>         D) The petitioner shall not commit any offence or<br \/>\n            indulge in any prejudicial activity while on bail.\n<\/p><\/blockquote>\n<blockquote><p>         E) In case of breach of any of the conditions<br \/>\n            mentioned above, the bail shall be liable to be<br \/>\n            cancelled.<\/p><\/blockquote>\n<p>       The Bail Application is allowed to the extent indicated<\/p>\n<p> above.\n<\/p>\n<\/p>\n<p>                                  K.T.
