\nrespondent submitted that  has not been<\/p>\n
challenged at  Vitseiif.Vva.nd””the petitioner has<\/p>\n
approached.~th’isiiftr-‘fter’.V’th.’eorder} is passed in favour of
\nthe first resvponderitljvanfdi writ petition cannot be
\nentertained:   that, adequate representation
\nhas\u00ab.not  persons belonging to the Scheduled<\/p>\n
Caste   or Taiuk. Further he submitted that<\/p>\n
,_the   No.34993\/2004 is not applicable to the<\/p>\n
 the” present case as the facts in W.P. No.34993\/2004\u00bb<\/p>\n

subniitted that the petitioner has invested huge amount<\/p>\n

and he beiongs to Scheduled Caste and he has been running ab!
\nfair price shop since about one year and if he is <\/p>\n
will be put to great hardship and therefore?”

Provided that, out of the authorisation for fair price
\ndepot issued to individuals during the official year__b_y<\/p>\n
an authorised authority, a minimum of
\npercent shall be reserved for persons
\nScheduled Castes and a minimum of  S’ 1<\/p>\n
persons belonging to Scheduled:T’ribes.g <\/p>\n
If person belonging to these’—ca’tegori,es;   it
\navailable then such authorisation rnaybe to

11. It is clear from if eligiblpelgjapplicants are not<\/p>\n
available from Categories {1f}”to..[iv)’,’- theiilonltyitg’ the authorised<\/p>\n
Authority can g1*ant’eaiei\ufb02iorisation in favour of the others like
\npersons belonging to” Caste, Scheduled Tribe etc.
\nThis Co,r_\u00ab1}lg1:’ltlV in w.P;Ne,p34933\/2004 has held, if a shop is<\/p>\n
re’served  for’\u00ab.gS:cl:eduled Caste or Scheduled Tribe, it<\/p>\n
 eontravenesulthe-. proviso to clause 6[l)(b) of the PDS Control<\/p>\n
l\u00b0\u00bb._O4rder.  thecepresent case, the shop at Channegowdanadoddi<\/p>\n
 has been reserved for the Scheduled Caste and<\/p>\n
it”ll’fj~app’licVations have been invited from the persons belonging to \ufb02ue<\/p>\n
L2<\/p>\n
Scheduled Caste. Therefore, the impugned noti\ufb01cation.___and<\/p>\n
also the impugned order granting authorisat’i.on-dgi’-_i’;e,<\/p>\n
