When they<br \/>\n\treached Nava-Nadarva village at about 08-00 p.m., one tanker bearing<br \/>\n\tRegistration No.GRQ-8103 driven by the respondent No.1 herein in<br \/>\n\texcessive speed came from the opposite direction and dashed against<br \/>\n\tthe bicycle of the appellant along with the other cyclist who was<br \/>\n\talso driving with the appellant, who is the applicant of Motor<br \/>\n\tAccident Claim Petition N.617 of 1984 and both these cyclist<br \/>\n\tsustained serious injuries and even their cycles also got damaged.<br \/>\n\tEven the wheels of the said cycles were separated. Thereafter, the<br \/>\n\tappellant filed Motor<br \/>\n\tAccident Claim Petition No.616 of 1984 and the said another<br \/>\n\tperson filed Motor<br \/>\n\tAccident Claim Petition No.617 of 1984. The Tribunal after<br \/>\n\thearing the parties partly allowed the said claim petition filed by<br \/>\n\tthe appellant. Hence, present petition.\n<\/p>\n<p>Mr.S.K. Bukhari, learned advocate<br \/>\n\tfor the appellant, has submitted that the Tribunal has erred in<br \/>\n\tgranting Rs.15,000\/- towards pain, shock and suffering without<br \/>\n\tconsidering eight injuries sustained by the appellant, as mentioned<br \/>\n\tin the Medical Certificate at Exh.29; that the Tribunal has erred in<br \/>\n\tawarding only Rs.12,000\/- under the head of future loss of income<br \/>\n\tand that the Tribunal ought to have appreciated the evidence of<br \/>\n\tDr.Arvind Patel at Exh.39. In view of aforesaid submissions, it is<br \/>\n\tprayed that present appeal may be allowed.\n<\/p>\n<p>Mr.Neeraj<br \/>\n\tSoni, learned Assistant Government Pleader, has submitted that the<br \/>\n\tjudgment and award passed by the Tribunal is just and proper. The<br \/>\n\tTribunal has after taking into consideration all the aspects of the<br \/>\n\tmatter and evidence on record come to the conclusion, which is just<br \/>\n\tand proper. Hence, present appeal is required to be dismissed.\n<\/p>\n<p>Having<br \/>\n\tconsidered the contentions raised by the learned advocate for the<br \/>\n\tappellant, averments made in the appeal and the documentary evidence<br \/>\n\tproduced on record, it transpires that<br \/>\n\tthe Tribunal has after appreciating the evidence on record has come<br \/>\n\tto the conclusion that the appellant is entitled to only<br \/>\n\tRs.32,100\/-. It is required to be noted that the Tribunal has also<br \/>\n\tappreciated the medical evidence at Exhs.29, 30 and 40 while coming<br \/>\n\tto the conclusion. The Tribunal has also appreciated the evidence of<br \/>\n\tthe appellant, wherein in paragraph 3, he himself has admitted that<br \/>\n\tget earns an amount of Rs.12-50 ps. per day and therefore, on the<br \/>\n\tbasis of the same, the Tribunal has calculated the income of the<br \/>\n\tappellant.\n<\/p>\n<p>In<br \/>\n\tview of aforesaid, I am of the opinion that the view taken by the<br \/>\n\tTribunal is just and proper. The Tribunal has assigned cogent and<br \/>\n\tconvincing reasons for arriving<br \/>\n\tat the conclusion. Over and above aforesaid reasons, I adopt the<br \/>\n\treasons assigned by the Tribunal and do not find any illegality much<br \/>\n\tless any perversity in the findings recorded. I am in complete<br \/>\n\tagreement with the findings recorded by the Tribunal. No case is<br \/>\n\tmade out to interfere with the findings recorded by the Tribunal.<br \/>\n\tHence, present appeal deserves to be dismissed.\n<\/p>\n<p>For<br \/>\n\tthe foregoing reasons, present appeal fails and is, accordingly,<br \/>\n\tdismissed.
