The circumstances are :-\n<\/p>\n<p>\tThe<br \/>\n\tappellant was unable to file an appeal due to financial hiccups.\n<\/p>\n<p>\tThe<br \/>\n\tappellant was never released either on temporary bail or on<br \/>\n\tfurlough.\n<\/p>\n<p>\tThe<br \/>\n\tappeals of the other co-accused, who are on the same footing along<br \/>\n\twith appellant, are allowed.\n<\/p>\n<p>2.\t\tIn<br \/>\nview of the above aspects, having found that the evidences led by the<br \/>\nprosecution is not trust-worthy and evidence  is common qua all the<br \/>\naccused persons, the said appeals of the co-accused were allowed on<br \/>\n23.09.2008. In that appeal, we have observed as under:-\n<\/p>\n<p> 8.\tWe<br \/>\nhave considered the rival side submissions. From the\tRecord<br \/>\nand Proceedings, we find that first informant &#8211;\tChampaklal  Bhurabhai<br \/>\nVaniya was examined at Exh.40,\this wife was examined at<br \/>\nExh.41, his son   Depak\tChampaklal was examined at Exh.51 and<br \/>\nDipak&#8217;s \twife  \tHeenaben was examined at Exh.88. The \tdepositions<br \/>\nrun \tin number of pages but what emerges \ttherefrom, can be\tdiscussed<br \/>\nas under:-\n<\/p>\n<p>8.1.\tUndisputedly,<br \/>\nthere was darkness in the house of the first\tinformant where the<br \/>\nrobbery is alleged to have been\tcommitted. The assailants were<br \/>\nwearing masks on their\tfaces leaving open only the part of the eyes.<br \/>\nIn the F.I.R., the \tF.I.R. does not give the name of any of the<br \/>\nassailants nor\tdoes it give any description of any of the assailants.<br \/>\nIt does\tnot emerge from the F.I.R. that the assailants had asked<br \/>\nfor\twater and, while taking water, they had unmasked their\tfaces. It<br \/>\nalso does not emerge from the F.I.R. that there was\tlight coming from<br \/>\nthe windows with the help of which, the\tassailants were identified by<br \/>\nthe first informant or other\twitnesses.\n<\/p>\n<p>8.2.\tIt<br \/>\nalso emerges from the evidence that the theory of the\tassailants<br \/>\nasking for water and while taking water\tunmasking their faces emerges<br \/>\nfrom the statements\trecorded of those witnesses after the Test<br \/>\nIdentification\tParade. This, in our opinion, is a clear attempt on<br \/>\nthe part of\tthe Investigating Agency to fill up the lacuna in the<br \/>\ncase of\tthe first informant and by this, an attempt is made to<br \/>\ngive\tcolour of truthfulness to the identification made by<br \/>\nthe\twitnesses in the Test Identification Parade.\n<\/p>\n<p>8.3.\tIt<br \/>\nalso emerges from the evidence of these witnesses that\twhile deposing<br \/>\nbefore the Court witnesses   Vinaybala\tChampaklal (Exh.41) and<br \/>\nDipak Chempaklal (Exh.51) have\tnot identified the accused persons in<br \/>\ntheir examination in\tchief. Unfortunately, the defence has put<br \/>\ncertain questions\tregarding identity of the accused persons and<br \/>\nduring the\tcourse of examination, the witnesses have tried to<br \/>\nidentify\tthe accused persons by their names as assailants but<br \/>\nin\tdoing so, they have committed mistakes and have fixed the<br \/>\n\tidentity wrongly, incorrectly or erroneously. As a result,<br \/>\nthe\taccused persons were identified by the names of other\taccused<br \/>\npersons.\n<\/p>\n<p>9.\tIt<br \/>\nalso emerges from the evidence of the Investigating\tOfficer that the<br \/>\nphotographs of the accused persons\twere shown to the witnesses before<br \/>\nTest Identification\tParade. It also emerges  from  the evidence<br \/>\nthat\tphotograph of one Anakbhai Kabubhai Kathi was also\tshown  to<br \/>\nthe witnesses during the course of \t investigation.\tBut, thereafter,<br \/>\nwhat  happened and why that Anakbhai\tis not arraigned as an accused<br \/>\nis not \texplained by the\tprosecution.\n<\/p>\n<p>9.1.\tIt<br \/>\nalso emerges from the evidence that no booty is\trecovered or<br \/>\ndiscovered from any of the accused\tpersons.\n<\/p>\n<p>9.2.\tIt<br \/>\nalso emerges from the evidence of Executive\tMagistrate<br \/>\nDipakbhai Shukla at Exh.146 that no\tprecautions were taken to ensure<br \/>\nthat the accused\tpersons were not exposed before exposing  to  public<br \/>\nor\t to\twitnesses, before Test Identification Parade was conducted.\n<\/p>\n<p>10.\tIt<br \/>\nis also  on  the  record  that the Investigating Officer was\tpresent<br \/>\nwhen the Test Identification Parade was\tconducted by the Executive<br \/>\nMagistrate. The evidence is\ttotally silent, so far as charges of<br \/>\n\toffences punishable under \tSections 504 and 506(2) are concerned. No<br \/>\nweapon is\trecovered from any of the accused or discovered by any of<br \/>\n\tthem.\n<\/p>\n<p>4.\t\tWe<br \/>\nhave heard the learned advocate Mr.Buddhbhatti, appointed by this<br \/>\nCourt as amicus curiae for<br \/>\nappellant   accused. The learned advocate, during the course of his<br \/>\nargument, relied upon the above findings, which were arrived at in<br \/>\nthe common judgment delivered in the appeals preferred by the four<br \/>\nco-accused of this case, namely appellant   accused  Dhanji Mohan<br \/>\nVaghri and Dhiru Panna Vaghri,<br \/>\nwho filed Criminal Appeal No.83 of 2005 and appellant   accused<br \/>\nMadhu Desha Vaghi and Himmat Desha Vaghri, who filed Criminal<br \/>\nAppeal No.255 of 2005. The common judgment in both these appeals was<br \/>\ndelivered on 23.9.2008. The learned advocate Mr.Buddhbhatti submitted<br \/>\nthat the findings arrived at in those appeals, with equal force,<br \/>\nshall apply to the case of the appellant, who was one of the<br \/>\nco-accused persons, who were acquitted from all the offences charged<br \/>\nagainst them, as their appeals were allowed.\n<\/p>\n<p>5.\t\tWe<br \/>\nhave heard learned APP Mr.Bhatt for the respondent   State.\n<\/p>\n<p>6.\t\tIn<br \/>\nlight of what is observed by us in the said appeal and since the<br \/>\nevidence is common, we allow this appeal as well, and set-aside the<br \/>\njudgment and order qua the present appellant and direct that the<br \/>\nappellant be released from prison forthwith, if not required in any<br \/>\nother case, and fine, if paid, be refunded to him.\n<\/p>\n<p>7.\t\tBefore<br \/>\nparting, we would like to place on record a word of appreciation for<br \/>\nthe promptness with which the services were rendered by<br \/>\nMr.M.J.Buddhbhatti, who worked as amicus curiae.\n<\/p>\n<p>\t\t\t\t\t\t\t(A.L.DAVE,<br \/>\nJ.)<\/p>\n<p>\t\t\t\t\t\t\t(J.C.UPADHYAYA,<br \/>\nJ.)<\/p>\n<p>(binoy)\t<\/p>\n<p>\t\t   \u00a0\u00a0\u00a0<\/p>\n<p>\t\t   Top<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Gujarat High Court Babubhai vs In on 26 September, 2008 Author: A.L.Dave,&amp;Nbsp;Honourable Mr.Justice J.C.Upadhyaya,&amp;Nbsp;
