1.      Leave granted.\n<\/p>\n
2.      In   all   the   appeals,   the   original   complainant   has <\/p>\n
        challenged   the   separate   orders   passed   by   the   High <\/p>\n
        Court   of   Uttarakhand   at   Nainital   in   Bail   Application <\/p>\n
        No.70   of   2010   in   SLP(Crl.)No.3520   of   2010,   Bail <\/p>\n
        Application No.73 of 2010 in SLP(Crl.)No.3573 of 2010 <\/p>\n
        Bail  Application   No.75  of  2010  in  SLP(Crl.)No.3527  of <\/p>\n
        2010,   Bail   Application   No.   46   of   2010   in <\/p>\n

      Application No. 74 of 2010 in SLP(Crl)No.3523 of 2010 <\/p>\n
      granted bail to the respondents herein.\n<\/p>\n
3.    It is the case of the appellant that the deceased Ranbir <\/p>\n
      Singh   was   a   MBA   student.   On   2nd  of   July,   2009,   he <\/p>\n
      had   gone   to   Dehradun   in   search   of   a   job.   On   3rd  of <\/p>\n
      July,   2009,   he   was   illegally   picked   up   by   the <\/p>\n
      Dehradun Police. At around 3.30 on the same day, he <\/p>\n
      was killed in cold blood by the accused police officials.\n<\/p>\n
      According   to   the   post   mortem   report,   the   police <\/p>\n
      officials fired a total of 29 bullets  at the deceased, 17 <\/p>\n
      of these bullets hit the deceased at a very close range <\/p>\n
      and 9 bullets were fired from a maximum distance of 3 <\/p>\n
      feet.\n<\/p>\n
4.    On   receiving   information   from   some   media   persons <\/p>\n
      that   his   son   had   been   shot   down   by   the   police   at <\/p>\n
      Dehradun,   the   complainant   reached   Dehradun   and <\/p>\n
      tried   to   contact   the   police   officials.   He   was,   however, <\/p>\n
      threatened by one of the police officer that if he tries to <\/p>\n

      interfere   in   the   matter,   he   would   also   be   eliminated <\/p>\n
      like his son.\n<\/p>\n
5.    In   the   appeal,   the   appellant   has   given   details   of   the <\/p>\n
      prosecution version which are not necessary for us to <\/p>\n
      recapitulate   at   this   stage.   After   performing   the   last <\/p>\n
      rites   of   his   son,   the   complainant   went   back   to <\/p>\n
      Dehradun and filed a case against the police personnel <\/p>\n
      which   was   recorded   as   FIR   No.101\/2009   dated <\/p>\n
      6.7.2009 under Section  120B,  364, 302,  201 IPC. On <\/p>\n
      30th  July, 2009, for obvious reasons, the investigation <\/p>\n
      of   the   case   was   handed   over   to   the   CBI,   SCB, <\/p>\n
      Lucknow.\n<\/p>\n
6.    The first respondent herein along with other 4 accused <\/p>\n
      police officers filed bail application No.991\/2009 in the <\/p>\n
      Court of Sessions Judge, 4th FTC Dehradun for bail.\n<\/p>\n
7.    The learned Sessions Judge by order dated 10.12.2009 <\/p>\n
      rejected   the   bail   application.   The   respondent   herein <\/p>\n

      thereafter   moved   the   application   for   bail   in   the   High <\/p>\n
      Court.   A   vacation   Judge   of   the   High   Court   by   order <\/p>\n
      dated 20th  January, 2001 granted bail to the accused.\n<\/p>\n
      Aggrieved   by   the   aforesaid   orders,   the   complainant, <\/p>\n
      father   of   the   deceased,   has   moved   the   petitions   by <\/p>\n
      special leave.\n<\/p>\n
8.    We have heard the learned counsel for the parties.\n<\/p>\n
9.    Mr.Malhotra,   learned   Additional   Solicitor   General <\/p>\n
      submitted   that  the   High  Court   committed   an   error   in <\/p>\n
      granting   bail   without   any   justification.   Learned <\/p>\n
      counsel   appearing   for   the   appellant   emphasised   the <\/p>\n
      seriousness   of   the   offences   committed.   Learned <\/p>\n
      counsel appearing for the complainant submitted that <\/p>\n
      the High Court has been overly influenced by the fact <\/p>\n
      that the CBI was not represented at the time when the <\/p>\n
      bail application came up for hearing. According to the <\/p>\n
      complainant,   presence   or   absence   of   the   counsel   for <\/p>\n
      the CBI was wholly irrelevant for examining the merits <\/p>\n
      of   the   application   for   bail.   He   submitted   that   all   the <\/p>\n

       accused   being   police   officials,   the   complainant   and <\/p>\n
       other   witnesses   are   always   under   constant   threat.\n<\/p>\n
       There is prima facie involvement of all the accused in a <\/p>\n
       case of false encounter. According to the prosecution, <\/p>\n
       not  only  an   innocent   person   has   been  eliminated   but <\/p>\n
       efforts   have   been   made   by   all   concerned   to   cover   up <\/p>\n
       the   crime.   The   High   Court   merely   noticed   the <\/p>\n
       submissions made by the counsel for the accused and <\/p>\n
       arbitrarily   granted   bail.   Mr.Sushil   Kumar,   learned <\/p>\n
       counsel   appearing for the respondents has submitted <\/p>\n
       that   there   is   no   danger   to   either   the   complainant   or <\/p>\n
       any   of   the   witnesses,   as   all   the   police   officials   have <\/p>\n
       now   been   posted   out   of   the   district.   Learned   counsel <\/p>\n
       further submitted that a perusal of the orders passed <\/p>\n
       in   the   case   of   some   of   the   accused   would   show   that <\/p>\n
       the   bail   applications   were   contested   and   vehemently <\/p>\n
       opposed by the CBI.\n<\/p>\n
10.    We   have   considered   the   submissions   made   by   the <\/p>\n
       learned counsel. We are of the considered opinion that <\/p>\n

        the   allegations   made   against   the   respondents   cannot <\/p>\n
        be   brushed   aside   at   this   stage.   The   CBI   after <\/p>\n
        investigation   of   the   matter   has   already   submitted   the <\/p>\n
        charge   sheet.   According   to   the   prosecution   all   the <\/p>\n
        accused were involved in the fake encounter in which <\/p>\n
        an   innocent   young   man   lost   his   life.   The   High   Court <\/p>\n
        also ought to have taken into consideration the serious <\/p>\n
        nature   of   the   allegations,   the   possibilities   of   undue <\/p>\n
        influence   being   exerted   on   the   witnesses   for   the <\/p>\n
        prosecution     at   the   instance   of   the   police   officials.   In <\/p>\n
        our opinion, the High Court committed serious error in <\/p>\n
        granting bail to the respondents.\n<\/p>\n
11.     Keeping   in   view   the   facts   and   circumstances   of   these <\/p>\n
        cases,   we   allow   the   appeals   and   set   aside   the <\/p>\n
        impugned orders of the High Court.\n<\/p>\n
