Justice R.BASANT\n\n Dated :20\/08\/2007\n\n O R D E R\n                             R.BASANT, J.\n                          ----------------------\n                     Crl.M.C.No.2598 of 2007\n                    ----------------------------------------\n              Dated this the 20th day of August 2007\n\n                               O R D E R\n<\/pre>\n<p>      The petitioner now faces indictment in a prosecution under<\/p>\n<p>Section 55(a) of the Kerala Abkari Act. Final report has been<\/p>\n<p>filed.  Cognizance has already taken.                  Proceedings are now<\/p>\n<p>pending as C.P.No.20\/07 before the learned Chief Judicial<\/p>\n<p>Magistrate, Kalpetta, submits the learned counsel for the<\/p>\n<p>petitioner.\n<\/p>\n<p>      2.   Proceedings commenced on the basis of an F.I.R<\/p>\n<p>lodged by the Sub Inspector of Police, Kambalakkad police<\/p>\n<p>station on 6\/7\/2004. Crime was registered under Section 102<\/p>\n<p>Cr.P.C.   The Sub Inspector of Police allegedly inspected the<\/p>\n<p>premises of the petitioner on receipt of information that some<\/p>\n<p>intoxicating liquor was kept in the premises of the petitioner.<\/p>\n<p>Seizure was effected.       The article was sent to the chemical<\/p>\n<p>examiner for report. The report of the chemical examiner shows<\/p>\n<p>that the article in question contains ethyl alcohol. Consequently<\/p>\n<p>final report has been filed raising allegations under the Kerala<\/p>\n<p>Abkari Act against the petitioner. The precise allegation raised<\/p>\n<p>is under Section 55(a) of the Kerala Abkari Act.<\/p>\n<p>      3.   The learned counsel for the petitioner fairly submits<\/p>\n<p>that even though he disputes the alleged seizure etc. he is not<\/p>\n<p><span class=\"hidden_text\">Crl.M.C.No.2598\/07                2<\/span><\/p>\n<p>pressing those contentions at this stage under section 482<\/p>\n<p>Cr.P.C. The learned counsel raises only one contention before<\/p>\n<p>me. He urges that the article seized cannot, in any view of the<\/p>\n<p>matter, be held to be liquor, inasmuch as the report shows that<\/p>\n<p>the percentage of ethyl alcohol present is only 6.2 and 2.15<\/p>\n<p>respectively in the two bottles which were sent for chemical<\/p>\n<p>examination. Therefore, the learned counsel contends that the<\/p>\n<p>prosecution under the Kerala Abkari Act is not justified or<\/p>\n<p>possible.\n<\/p>\n<p>      4.    I am afraid, I cannot accept this contention. Section 3<\/p>\n<p>(10) of the Kerala Abkari Act defines liquor in the following<\/p>\n<p>words.\n<\/p>\n<p>      (10) Liquor:- &#8220;liquor&#8221; includes spirits of wine, [arrack],<br \/>\nspirits, wine, toddy, beer and all liquid consisting of or<br \/>\ncontaining alcohol.&#8221;\n<\/p>\n<\/p>\n<p>      5. The contraband article seized from the premises did<\/p>\n<p>certainly contain ethyl alcohol as seen from the report of<\/p>\n<p>chemical examination. In these circumstances, I find no merit in<\/p>\n<p>the contention that the article seized cannot be held to be liquor.<\/p>\n<p>Inasmuch as the article contains ethyl alcohol, it must now be<\/p>\n<p><span class=\"hidden_text\">Crl.M.C.No.2598\/07                3<\/span><\/p>\n<p>held to answer the definition of liquor in Section 3(10) of the<\/p>\n<p>Kerala Abkari Act.\n<\/p>\n<p>      6.    Possession of liquor without legal authority is an<\/p>\n<p>offence under the Kerala Abkari Act whatever be the precise<\/p>\n<p>offence and I do not find in these circumstances any merit in the<\/p>\n<p>prayer for quashing the proceedings. The petitioner has various<\/p>\n<p>contentions to urge. He even questions the finding that there<\/p>\n<p>was presence of ethyl alcohol in the article from which sample<\/p>\n<p>was taken. The learned counsel relies on different percentages<\/p>\n<p>of alcohol reported in the report of analysis, when admittedly<\/p>\n<p>both samples of the article were taken from one container. Be<\/p>\n<p>that as it may, it is not necessary for me to go into those<\/p>\n<p>contentions now. The petitioner shall be at liberty to raise all<\/p>\n<p>necessary and appropriate contentions before the courts below<\/p>\n<p>in the course of the trial.\n<\/p>\n<p>      7.    I do not, in these circumstances, find any merit in the<\/p>\n<p>contention that the prosecution is bound to fail for the reason<\/p>\n<p>that what is seized is not liquor at all.\n<\/p>\n<p>      8.    The learned counsel for the petitioner submits that<\/p>\n<p>the petitioner is absolutely innocent and apprehends that his<\/p>\n<p><span class=\"hidden_text\">Crl.M.C.No.2598\/07                4<\/span><\/p>\n<p>application for regular bail may not be considered by the learned<\/p>\n<p>Magistrate on merits, in accordance with law and expeditiously.<\/p>\n<p>He therefore prays that appropriate directions may be issued.<\/p>\n<p>      9.    I have no reason to assume that the learned<\/p>\n<p>Magistrate would not consider the petitioner&#8217;s application for<\/p>\n<p>regular bail on merits, in accordance with law and expeditiously.<\/p>\n<p>Every court must do the same. His application for bail will have<\/p>\n<p>to be considered in the light of the decisions in <a href=\"\/doc\/1158859\/\">Sukumari       v.<\/p>\n<p>State of Kerala<\/a> [2001(1) KLT 22] and Alice George vs.Deputy<\/p>\n<p>Superintendent of Police [2003(1)KLT 339]. I need only observe<\/p>\n<p>that such application must be considered on merits and disposed<\/p>\n<p>of expeditiously &#8211; on the date of surrender itself.
