The applicant&#8217;s mother is<br \/>\nhaving some mental disturbance coupled with thyroid an hypertension<\/p>\n<p>2.\t Rule.\n<\/p>\n<p> Mr.J.K. Shah,  learned Additional Public Prosecutor waives service<br \/>\nof rule on  behalf of the respondent-State.  The learned APP invited<br \/>\nattention of the Court to the Jail remarks.\n<\/p>\n<p>3.\tThe<br \/>\napplicant- appellant- original accused has been convicted for the<br \/>\noffences punishable under section 302 of the IPC and section 135 of<br \/>\nthe Bombay Police Act to suffer imprisonment for life with fine of<br \/>\nRs.3000\/-, in default, to undergo a further sentence of  1 month by<br \/>\nthe learned Judge, Fast Track Court No.3, Ahmedabad on 29.08.2009 in<br \/>\nSessions Case No.16 of 2008.\n<\/p>\n<p>4.\tThe<br \/>\napplicant- appellant- convict has been in Jail for 3 years, 2 months<br \/>\nand 18 days as on 10.03.2011.  He had once enjoyed temporary bail in<br \/>\nAugust-September 2010.\n<\/p>\n<p>5.\tFor the<br \/>\ncontents of the application and taking into consideration the medical<br \/>\npapers accompanying with this application, the application is<br \/>\nallowed.  The applicant- convict is ordered to be released on<br \/>\n temporary bail for 45 (forty five)  days from the date<br \/>\nof his release  on his executing a personal bond of Rs.5000\/- (Rupees<br \/>\nfive thousand only) to the satisfaction of the Jail authorities.\n<\/p>\n<p>6.\tThe<br \/>\napplicant shall surrender himself to the Jail authorities on expiry<br \/>\nof the above temporary bail period.\tRule is made absolute.\n<\/p>\n<p>(RAVI<br \/>\nR.
