Justice M.L.JOSEPH FRANCIS\n\n Dated :09\/06\/2010\n\n O R D E R\n           K.M.JOSEPH &amp; M.L.JOSEPH FRANCIS, JJ.\n         ------------------------------------------------------\n                  W.P.(C) No.15446 of 2010-E\n             ----------------------------------------------\n              Dated, this the 9th day of June, 2010\n\n                          J U D G M E N T\n<\/pre>\n<p>K.M.Joseph, J.\n<\/p>\n<p>               Petitioner has approached this Court seeking the<\/p>\n<p>following reliefs:&#8211;\n<\/p>\n<blockquote><p>      &#8220;i) to issue a writ of mandamus or any other appropriate<\/p>\n<p>      writ or order or direction commanding the 6th respondent<\/p>\n<p>      to afford adequate and effective police protection to the<\/p>\n<p>      life and property of the petitioner.\n<\/p><\/blockquote>\n<blockquote><p>      ii) to issue a writ of mandamus or any other appropriate<\/p>\n<p>      writ or order or direction commanding 6th respondent to<\/p>\n<p>      take necessary steps for affording adequate protection to<\/p>\n<p>      the property of the petitioner for constructing ridge\/chira<\/p>\n<p>      in her property.&#8221;\n<\/p><\/blockquote>\n<blockquote><p>              2.   Briefly put, the case of the petitioner is as<\/p>\n<p>follows:&#8211; Petitioner a divorcee with a daughter purchased 54<\/p>\n<p>cents in Kumalanghi village. Out of the same she sold 5 cents<\/p>\n<p>to the Ist respondent.         The property of the petitioner is<\/p>\n<p>waterlogged and fish cultivation is being conducted. When the<\/p>\n<p>petitioner started construction of a ridge in her property the<\/p>\n<p>Ist respondent raised objection. Petitioner filed suit before the<\/p>\n<p>Munsiff Court, Kochi for injunction. Ext.P3 is the interlocutory<\/p>\n<p>order of injunction.         But, respondents 2 to 5 and their<\/p>\n<p>henchmen entered the property of               the petitioner    and<\/p>\n<p>obstructed the workers from constructing the ridge. Hence<\/p>\n<p><span class=\"hidden_text\">WPC 15446\/2010                               -2-<\/span><\/p>\n<p>the writ petition.<\/p><\/blockquote>\n<p>             3. A counter affidavit has been filed by the Ist<\/p>\n<p>respondent. There is also counter by the 4th respondent.<\/p>\n<p>             4.   We heard the learned counsel for the parties.<\/p>\n<p>Ext.P3 is only an exparte interlocutory order. It is pending<\/p>\n<p>final decision in the matter.      It is submitted by the Ist<\/p>\n<p>respondent that the matter is coming up for hearing shortly.<\/p>\n<p>It is submitted that respondents 3 and 4 have already filed<\/p>\n<p>application to implead in the suit. In such circumstances, we<\/p>\n<p>do not think that it is appropriate for this Court to interfere<\/p>\n<p>with the matter particularly at this stage. Leaving it open to<\/p>\n<p>the petitioner to approach the Civil Court for appropriate<\/p>\n<p>remedies we dispose of the writ petition.
