\nagainst the Judgment and Award dated 25.4.2097<\/p>\n
passed in MVC No.2015\/2006 on the file of X:E.Addl,
\nJudge, Court of Small Causes, Member, .uMACE,dag_}<\/p>\n
the Court delivered the followingi, 2<\/p>\n
JUDGEMEX:\n<\/p>\n
The appellant seating. enhancement of the
\ncompensation on the grease that the MAEE had failed
\nto take into apcount tha iossiof earning capacity
\n35% as per the medipal euidence on record, loss of<\/p>\n
amenitiesj and’ alsoW loss, oi income during the<\/p>\n
treatment period. V<\/p>\n
2{\ufb01%;,The learned counsel for the appellant<\/p>\n
stbmitsa that gin._the doctor’s evidence before the<\/p>\n
if; VTribudal, he has clearly stated that the appellant<\/p>\n
7_ has got 35% disahiiity for the whole body following<\/p>\n
_ the fracture of both the bones of right tibia and<\/p>\n
fracture of right femur and as there is a nonwunion<\/p>\n
-of the right femur and right tibia and dislocation<\/p>\n
“55 right shoulder, the doctor had opined that the<\/p>\n
disability is at 35% for the whole body. The MAC?<\/p>\n
erred in taking the disability at 15%. More over,<\/p>\n

the appellant is a mason by occupation and with the<\/p>\n
aforesaid disability the earning capacity reduced to_<\/p>\n
great extent. He has sought for enhancement to\ufb01ardsq *<\/p>\n
loss of amenities and enjoyment in life and loss of ”<\/p>\n
income during the treatment period of \u20ac_\ufb01\u00a9\ufb01thSgl\ufb01_l<\/p>\n
View of the treatment taken for” \ufb01ixation :of*<\/p>\n

3. Sri. O.Mahesh,?ilearnedimcdnnsel for the
\nInsurance Companyvplacing reliance p\ufb01f\ufb01the decision
\nreported in 138: a\u00e9d ad ghahucha\ufb01\ufb01a \ufb01g. Anantharaman
\n& Ors] submits that as the’in\u00a7ured\u00a7claimant did not
\nco–operabs with \ufb02ing doctor _ami refused tr) undergo
\noperation o\ufb01 his leg, the damages will have to be<\/p>\n
reduced -on that -account and consequently, the<\/p>\n
?compensation would also come down.<\/p>\n
d_4ta 1 have heard the iearned counsel for both<\/p>\n
side.\n<\/p>\n
ini, As for as the decision referred supra by the<\/p>\n
learned counsel Sri. O.Mahesh is concerned, that was<\/p>\n
a -case where the Court foundi on facts that the<\/p>\n
Aninjuredwclaimant did not co~operate with the doctor<\/p>\n
and, refused. to undergo operation of his leg and<\/p>\n

therefore, it is in these circumstances the Court<\/p>\n
took the view that the damages will have to _he<\/p>\n
reduced on that account, whereas in the case before ”<\/p>\n
us, it was not refusal on the part of themappellanti”<\/p>\n
to undergo operation, but there was delay_in”getting_,<\/p>\n
treatment on account of financial reasons,a As such,*<\/p>\n
the aforesaid decision is finapplicahleT {Q the<\/p>\n

6. On going xthrough\u00bb the*_eVidence\u00b0 on record,
\nparticularly tbdt of Dr}PLManohar, iwam of the view
\nthat the loss. of_ earning._capacity taken as 35%<\/p>\n

\nhaving regard_to the nature_of the injury sustained<\/p>\n
and the occupation of.the appellant as a mason and<\/p>\n
consequently uunderr thef head of loss of future<\/p>\n
Vearning capacity, the appellant is only entitled to<\/p>\n
Ra;;;i4}2Q0gc\ufb01*_ as ‘ against Rs.86,400–OO. The<\/p>\n
‘v’.\u00bbdifference_will be Rs.l,27,800-00. Towards loss of<\/p>\n
*w,amenitiesg*a further sum of Rs.10,UO0~00 is awarded<\/p>\n
‘”4and’ towards loss of income during the treatment<\/p>\n
‘”a_period, in View of the operation undergone by the<\/p>\n
