JUSTICE DINESH MAHESHWARI\n\n      Mr. Narpat Singh Khileri, for the petitioner.\n      Mr. Anil Joshi, Public Prosecutor.\n                                      ...\n\n      BY THE COURT:<\/pre>\n<p>            The petitioner is facing trial in Sessions Case No.<\/p>\n<p>      88\/2007 pending in the Court of Special Judge, Scheduled<\/p>\n<p>      Castes and Scheduled Tribes (Prevention of Atrocities Cases),<\/p>\n<p>      Merta for offences under Sections 452, 363, 366-A, 376(2)(g)<\/p>\n<p>      IPC and 3(1)(x)(xii) and 3(2)(v) of the Scheduled Castes and<\/p>\n<p>      Scheduled Tribes (Prevention of Atrocities) Act; and has<\/p>\n<p>      moved this application for bail under Section 439 Cr.P.C.<\/p>\n<p>            This bail application was filed on 23.09.2009 with<\/p>\n<p>      reference to the order passed by the learned Trial Court on<\/p>\n<p>      31.01.2009.     In this bail application, earlier, the learned<\/p>\n<p>      counsel for the petitioner submitted that the prosecutrix had<\/p>\n<p>      been examined and prayed for time to place on record the<\/p>\n<p>      copies of the statements and at request, the matter was<\/p>\n<p>      adjourned.\n<\/p>\n<p>             During the course of submissions later, when it was<\/p>\n<p>      pointed out that a criminal revision petition is pending in this<br \/>\n<span class=\"hidden_text\">                                 2<\/span><\/p>\n<p>Court and the original record of the Trial Court has been<\/p>\n<p>requisitioned therein, after supplying of the particulars, the<\/p>\n<p>case file of Criminal Revision Petition No. 178\/2009 has been<\/p>\n<p>requisitioned from the office and it is noticed that the original<\/p>\n<p>record of the Trial Court is attached thereto.<\/p>\n<p>      It is noticed from the record of the Trial Court that the<\/p>\n<p>prosecutrix was indeed examined in the trial on 07.06.2008<\/p>\n<p>but then, her cross-examination was deferred for want of<\/p>\n<p>documents.     Thereafter, her cross-examination was further<\/p>\n<p>deferred on 21.07.2008 at the request of the counsel for the<\/p>\n<p>accused. The prosecutrix again appeared on 08.08.2008 but<\/p>\n<p>for the lawyers abstaining from work, the matter was<\/p>\n<p>adjourned. The prosecutrix again appeared before the Trial<\/p>\n<p>Court on 18.08.2008 but for the same reason, the case was<\/p>\n<p>adjourned again.     Then, on a few occasions, though the<\/p>\n<p>prosecutrix did not appear but the record of the proceedings<\/p>\n<p>shows that the counsel abstained from work. The prosecutrix,<\/p>\n<p>thereafter, appeared on 21.10.2008 when an application was<\/p>\n<p>moved on behalf of the accused under Section 190, 193, 204<\/p>\n<p>Cr.P.C. and the prayer was made for adjournment on behalf of<\/p>\n<p>the accused for the purpose of cross-examination. It appears<\/p>\n<p>that thereafter, the matter was considered on the application<\/p>\n<p>moved for taking cognizance against some other persons.<\/p>\n<p>The prosecutrix again appeared before the Trial Court on<br \/>\n<span class=\"hidden_text\">                                        3<\/span><\/p>\n<p>       29.01.2009, but again, for the request made by the counsel<\/p>\n<p>       for the accused, the matter was adjourned for her cross-<\/p>\n<p>       examination.\n<\/p>\n<p>             The cross-examination of the prosecutrix was not<\/p>\n<p>       carried out yet and after few more adjournments with<\/p>\n<p>       reference to filing of the revision petition in this Court, the<\/p>\n<p>       matter remained pending; and thereafter, as noticed, the<\/p>\n<p>       record has been requisitioned in the said revision petition.<\/p>\n<p>             In the given set of facts and circumstances, when the<\/p>\n<p>       examination-in-chief of the prosecutrix has been recorded in<\/p>\n<p>       the trial and her cross-examination has remained pending, this<\/p>\n<p>       Court, at this stage, does not feel inclined to grant indulgence<\/p>\n<p>       to the petitioner.\n<\/p>\n<p>             The bail application under Section 439 Cr.P.C. moved<\/p>\n<p>       on behalf of the petitioner Kesha Ram S\/o Puran Mal @ Purna<\/p>\n<p>       Ram stands rejected at this stage; but without prejudice to the<\/p>\n<p>       rights of the petitioner to apply for bail afresh after completion<\/p>\n<p>       of the statements of the prosecutrix and to take recourse to<\/p>\n<p>       other remedies in accordance with law.\n<\/p>\n<\/p>\n<p>                                           (DINESH MAHESHWARI), J.\n<\/p>\n<p>\/\/Mohan\/\/\n <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Rajasthan High Court &#8211; Jodhpur Kesha Ram vs State on 17 December, 2009 1 S\/1 S.B.
