Criminal Revision Petition under Section\n           397\/401 Cr.P.C.\n\nDate of Order :-                                     May 24, 2011\n\n                    PRESENT\n        HON'BLE MR. JUSTICE R.S. CHAUHAN\n\nNone present for the petitioner.\nMr.Anil Upadhyaya, Public Prosecutor.\nMr.Manish Sishodia, for the respondents.\n\n\nBY THE COURT:<\/pre>\n<p>          Yesterday on 23.05.2011, this matter was listed<\/p>\n<p>before this Court. However, no one appeared on behalf of<\/p>\n<p>the petitioner. Still in the interest of justice, this Court<\/p>\n<p>directed that the matter be listed today i.e. 24.05.2011. It<\/p>\n<p>was also made clear that in case the learned counsel for the<\/p>\n<p>petitioner does not appear on 24.05.2011, this Court shall<\/p>\n<p>have no other option, but to decide the case ex-parte. Even<\/p>\n<p>today, no one has appeared on behalf of the petitioner<\/p>\n<p>before this Court. Therefore, this Court has no other<\/p>\n<p>option, but to decide the case ex-parte.\n<\/p>\n<\/p>\n<p>          The      brief   facts   of   the   case   are   that   the<\/p>\n<p>petitioner-husband, Prahlad Das, and the respondent-wife,<br \/>\n<span class=\"hidden_text\">                              2<\/span><\/p>\n<p>Smt. Laxmi Devi Vaishnav, were married in 1988 according<\/p>\n<p>to the Hindu rites and customs. On 21.11.1990, the couple<\/p>\n<p>was blessed with a son. According to the respondent-wife,<\/p>\n<p>while she stayed at her matrimonial home, she was<\/p>\n<p>subjected to physical and mental cruelty. Since she had a<\/p>\n<p>child, she was unable to live anywhere else. However,<\/p>\n<p>subsequently the petitioner-husband moved a divorce<\/p>\n<p>petition. The said divorce petition was granted ex-parte.<\/p>\n<p>Thereafter, the petitioner-husband had married another<\/p>\n<p>lady from whom he already has a daughter. Unable to<\/p>\n<p>maintain herself, the respondent-wife filed an application<\/p>\n<p>under Section 125 Cr.P.C. In order to buttress her case, the<\/p>\n<p>respondent-wife examined herself and two other persons as<\/p>\n<p>witnesses; the petitioner-husband also examined himself<\/p>\n<p>and two more persons as witnesses. After going through<\/p>\n<p>the oral and documentary evidence, the learned Judge<\/p>\n<p>directed the petitioner-husband to pay a maintenance of<\/p>\n<p>Rs.2,000\/- per month to the respondent-wife and Rs.1,500\/-<\/p>\n<p>per month to the respondent-son. Aggrieved by this order,<\/p>\n<p>the petitioner has filed the present petition before this<\/p>\n<p>Court.\n<\/p>\n<\/p>\n<p>          A bare perusal of the impugned order clearly<\/p>\n<p>reveals that the learned Judge has noticed the fact that<\/p>\n<p>despite the fact that the petitioner-husband claimed that<br \/>\n<span class=\"hidden_text\">                                   3<\/span><\/p>\n<p>the respondent-wife was not his lawful married wife, the<\/p>\n<p>said contention has been rejected after meticulously<\/p>\n<p>examining the evidence. Moreover, the learned Judge has<\/p>\n<p>also noticed the fact that the respondent-wife is unable to<\/p>\n<p>maintain herself and her child. Although the petitioner had<\/p>\n<p>claimed that the respondent-wife was earning by stitching<\/p>\n<p>cloths, but the said claim could not be established by any<\/p>\n<p>cogent evidence.\n<\/p>\n<\/p>\n<p>                Lastly, the learned Judge has noticed the fact<\/p>\n<p>that according to the petitioner-husband, he was earning<\/p>\n<p>about Rs.10,000\/- per month. Considering the economic<\/p>\n<p>condition of the couple, the learned Judge was certainly<\/p>\n<p>justified in granting a maintenance of Rs.2,000\/- per month<\/p>\n<p>to the respondent-wife and Rs.1,500\/- per month to the<\/p>\n<p>respondent-son. Thus, the maintenance amount awarded by<\/p>\n<p>the learned Judge is just and reasonable.\n<\/p>\n<\/p>\n<p>                For the reasons stated above, this Court does not<\/p>\n<p>find any illegality or perversity in the impugned order. This<\/p>\n<p>petition being devoid of any merit is, hereby, dismissed.<\/p>\n<p>The stay petition also stands dismissed.\n<\/p>\n<\/p>\n<p>                                           (R.S.
