SHAH\n\t\t\n\t\n\n \n\nDate\n: 06\/08\/2010 \n\n \n\nORAL\nJUDGMENT<\/pre>\n<p>1.\tRULE.\n<\/p>\n<p> Shri M.R. Mengdey, learned AGP<br \/>\nwaives service of notice of rule on behalf of the respondents.\n<\/p>\n<p>2.\tIn<br \/>\nthe facts and circumstances of the case and with the consent of the<br \/>\nlearned advocates appearing on behalf of the respective parties, the<br \/>\npresent petition is taken up for final hearing today.\n<\/p>\n<p>3.\tBy<br \/>\nway of this petition under Article 227 of the Constitution of India<br \/>\nthe petitioner has prayed for an appropriate writ, order or direction<br \/>\nquashing and setting aside the order dated 08\/01\/1998 passed by the<br \/>\nDeputy Collector, Vadodara as well as the order passed by the<br \/>\nCollector, Vadodara dated 21\/04\/1999 in Appeal No. 1\/1998 dismissing<br \/>\nthe appeal confirming the order passed by the Deputy Collector,<br \/>\nVadodara dated 08\/01\/1998 as well as the impugned order passed  by<br \/>\nthe learned revisional authority i.e. the Secretary (Appeals),<br \/>\nRevenue Department, State of Gujarat dated 02\/02\/22010 in Revision<br \/>\nApplication No. 7\/1999.\n<\/p>\n<p>4.\tHaving<br \/>\nheard the learned advocates appearing on behalf of the respective<br \/>\nparties, it appears that vide order dated 08\/01\/1998, Deputy<br \/>\nCollector, Vadodara in exercise of suo<br \/>\nmotu powers<br \/>\nquashed and set aside the order of the Mamlatdar, Savli dated<br \/>\n03\/12\/1996, which came to be confirmed by the Collector, Vadodara as<br \/>\nwell as the learned Secretary (Appeals), Revenue Department, State of<br \/>\nGujarat by respective orders dated 21\/04\/1999 and 02\/02\/2010.<br \/>\nConsidering the fact that the order passed by the Deputy Collector<br \/>\nquashing and setting aside the order passed by the Mamlatdar, Savli<br \/>\ndated 03\/12\/1996 is in breach of principles of natural justice, the<br \/>\nsame deserves to be quashed and set aside on the aforesaid ground<br \/>\nonly and the matter is to be remanded to the Deputy Collector,<br \/>\nVadodara for passing a fresh order in accordance with law and on its<br \/>\nown merits after giving an opportunity to the petitioner.  It is<br \/>\nagreed by the learned advocate appearing on behalf of the petitioner<br \/>\nthat the petitioner shall now appear before the Deputy Collector,<br \/>\nVadodara for hearing on 26\/08\/2010 and the present order may be<br \/>\ntreated as notice informing the petitioner  with respect to the next<br \/>\ndate of hearing before the Deputy Collector and no further<br \/>\nnotice shall be issued upon the petitioner.\n<\/p>\n<p>5.\tIn<br \/>\nview of the above and for the reasons stated hereinabove,  the order<br \/>\npassed by the Deputy Collector, Vadodara dated 08\/01\/1998, the order<br \/>\npassed by the Collector, Vadodara dated 21\/04\/199 and the order<br \/>\npassed by the learned Secretary (Appeals), Revenue Department, State<br \/>\nof Gujarat dated 02\/02\/2010 are hereby quashed and set aside and the<br \/>\nmatter is remanded to the Deputy Collector, Vadodara for deciding the<br \/>\nsuo motu (Review.\n<\/p>\n<p>S.R. No. 17\/1997) Revision Application No. 69\/1998 to decide the same<br \/>\nafresh in accordance with law on its own merits.  As observed<br \/>\nhereinabove and as agreed by the petitioner that now the petitioner<br \/>\nshall appear before the Deputy Collector, Vadodara for making the<br \/>\nsubmissions, either in person or through his advocate, on 26\/08\/2010<br \/>\nand thereafter, the Deputy Collector, Vadodara to pass an appropriate<br \/>\norder in accordance with law on its own merits, without, in any way,<br \/>\nbeing influenced by the present order  as this Court has not<br \/>\nexpressed any opinion on merits in favour of either parties and the<br \/>\nimpugned order passed by the Deputy Collector, Vadodara is set aside<br \/>\nsolely on the ground that the same is in breach of principles of<br \/>\nnatural justice.\n<\/p>\n<p>6.\tWith<br \/>\nthis, the present petition is allowed.
