The petitioner herein instituted suit in_C5S.<\/p>\n
\u00a7b_Q@5\/1996 seeking specific performance of eontraeta<\/p>\n
at Sale dated 20.12.1993 executed meg, ehe\ufb02 idpi<\/p>\n
respondent i.e., 1″ defendant \u00bbhe\u00a3orei’the__Cour\ufb01<\/p>\n
below.\n<\/p>\n
2. During the pendenef of the’suit,}the 1″
\ndefendant sold the Vpropertyeeunderk the registered
\nSale Deed dated o4.06,;993 ed the 2% defendant. An<\/p>\n
application was filed\ufb02under the pre\ufb01isions of Order<\/p>\n
6 Rule ,17-pCPC.*to_ aeend\ufb02”thed plaint and seek a
\ndecietataen’ that ,the*,sa1e’ Deed dated 04.06.1998<\/p>\n
executed by the 1?’ defendant in favour of the 2″<\/p>\n
V defendant: is “null and void. The amendment was<\/p>\n
h_a11oked’ the 2″ defendant was impleaded as a party,<\/p>\n
ThereefQefprtEe”2″d defendant sold the suit property<\/p>\n
M’ to the 3″5 defendant under” a registered Sale Deed<\/p>\n
u'” dated. \u00e94p\u00a96.2005. In turn, the 3″i defendant has<\/p>\n
=.@3ecuted a registered Agreement of Sale dated<\/p>\n
a”ad15_11.2006 in favour’ of defendant No.4″ in the<\/p>\n
Dcircumstances, the plaintiff submitted an<\/p>\n
application under the provisions of Order 1 Rule<\/p>\n
10(2) r\/w. Section 151 CPC to implead defendant \/<\/p>\n
f<\/p>\n
Nos.3 and 4 and so also an application IKA. XVIII
\nunder the provisions of Order VI Rule 1? CPC seeking<\/p>\n
amendment to the plaint and.asking for a \u00a3a1:af5gf\u00bb<\/p>\n
declaration that the Sale Deed dated 24_d5i2Q\u00a75_and,V4<\/p>\n
the Agreement of Sale dated 15.}: EGGS as null and
\nvoid and is not binding upon atheifplaintiffo*<\/p>\n
Objections to these applications were filed [<\/p>\n
3. The matter was_heatd hy the learned Judge
\nand he has rejected the application tor amendment
\nfiled under’ Qrderl Vin Edie \ufb01l\u20ac1i\u00e9PCmiand\u00a2 allowed ‘the
\napplication riled to’i\ufb01plead’respendent Nos.3 and 4
\nas defendant*hoe\ufb01\u00a7\ufb01and;\ufb01 respectively in the suit.
\nAggrieved by the erder or rejection of I.A, XVIIE,
\nthe petitioner aag.\u00a3;i\u00e9d this petition.<\/p>\n
‘ep4, E1: have heard the learned counsel for the<\/p>\n
pe:i:i\u00a2nagSi andf also respondent No.2. The other<\/p>\n
Vi’ respendents though served are absent.<\/p>\n
n’w5. N The triai Court has taken into<\/p>\n
. consideration the provisions of Section 52 of the<\/p>\n
~d Transfer of Property Act, 1882 in rejecting the<\/p>\n
“application as the Sale Deed saidr to have been<\/p>\n
executed. by defendant $0.2 in faveur of defendant<\/p>\n
\u00abL.\n<\/p>\n
\\\/<\/p>\n
No.3 and the registered Sale Agreement executed by<\/p>\n
defendant No.3 in favour of defendant No.$ is during<\/p>\n
the pendency of the suit and that .:h\u00a2,Csgia_<\/p>\n
transaction was subgect to the result ofpthe\\suitQ i<\/p>\n
As could be seen from the provisions of Section 52<\/p>\n
of the said Act, which reads as under:<\/p>\n

which_is not collusive and in which any

\nm\ufb01t\ufb01erwise d\u00e9ai\u00a3V with by any party to
\nf”the,suih or proceeding so as to affect
\n“CpheVrights of any other party thereto
\n‘under any decree or order which may be
\nmade: therein, except under the
\nA’Wauthority of the Court and on such<\/p>\n
V”terms as it may impose.”\n<\/p>\n
6. The perusal of the provisions reveal that
\nfrom the date of presentation of the piaint under<\/p>\n
the Code till the complete satisfaction or discharge.<\/p>\n
of” the decree or order obtainedi in the suit, any
\ntransfer made during the pendency* is not binding<\/p>\n
upon the party and in case if the plaintiff succeed<\/p>\n
in the suit in getting the specific perfermaneeiofe<\/p>\n
the contract of sale executed hy_the–ig”‘defendant,u<\/p>\n
the subsequent transaction executed ‘bye defendant<\/p>\n

7. So, when underh the ‘prouisions of lis
\npendens, the sai\u00e9vtransfers are not binding upon the
\nplaintiff, the .r\u00e9iie:”.\u00a2\u00a3 seeking declaration that
\nthe deeds are not hinding upon him are redundant and<\/p>\n
there would be no end to the litigation in case if<\/p>\n
then each of the occasion if the sale transaction is<\/p>\n
executed by the parties in favour of a nonmparty,<\/p>\n
sueh applications will have to be filed aii along<\/p>\n
‘and there wiil be no end to the litigation. As in<\/p>\n
2ViewVQf the provisions of Section 52 of the Transfer<\/p>\n
.fofh\u00a7roperty Act, the transfer of the preperty is not<\/p>\n
p binding upon the interest of the piaintiff, the<\/p>\n
“question of seeking amendment of the plaint does not<\/p>\n
arise for consideration. In the circumstances, I am<\/p>\n
of the opinion, that the trial Court has taken a
\njust, decision j11 rejecting time application won the
\nground. of non–a\u00a7plicable of ‘the princigles of, lis<\/p>\n
pendens and 13 do not find any merit in this \ufb01rit<\/p>\n
petition. In the circumstances, the getition” gs’<\/p>\n
