            This appeal has been filed by the appellant, who<\/p>\n
is the owner of the vehicle, against the award of the Motor<\/p>\n
Accident     Claims      Tribunal,        Rajsamand     dated     19.3.1997,<\/p>\n
passing an award in the sum of Rs.75,000\/- on account of<\/p>\n
personal injury sustained by the claimant.<\/p>\n
            The brief facts of the case are, that on 3.7.1991<\/p>\n
the claimant respondent was travelling in the bus of the<\/p>\n
appellant as a passenger. In the Desuri Ki Naal on account<\/p>\n
of     negligent     driving    of   the    bus,   it   hit     against   the<\/p>\n
hillock, as a result of which, the claimant was thrown out,<\/p>\n
and sustained injury. He has claimed that he was student of<\/p>\n
9th standard.\n<\/p>\n
                                                                                           2<\/span><\/p>\n
              The appellant contested the claim by filing the<\/p>\n
written-statement, and only adopted a stand of denial for<\/p>\n
want of knowledge and proof. It was also pleaded that the<\/p>\n
appellant operates vehicles in public interest, from whom<\/p>\n
no   compensation,         or    interest        can     be     awarded.       In   other<\/p>\n
words, it can very safely been inferred, that the factual<\/p>\n
averments, about the happening of the accident, negligent<\/p>\n
driving      of   the    bus,    the     claimant’s            sustaining         personal<\/p>\n
injuries etc. were not at all denied, and are required to<\/p>\n
be taken to be admitted, on the principle of non-traverse.<\/p>\n
              However,     the       learned     Tribunal          framed     4   issues.<\/p>\n
Issue No.1 related to negligence. Issue No.2 related to<\/p>\n
quantum of compensation, and issue No.3 related to non-<\/p>\n
liability of the insurer, on the basis of the pleadings<\/p>\n
taken in the written-statement.\n<\/p>\n<\/p>\n
              I   am    constrained      to      observe,          that     the   learned<\/p>\n
Tribunal     has     proceeded        with   a      case      in   a    wholly      casual<\/p>\n
manner,    inasmuch       as,    neither       the       bus    is     alleged      to   be<\/p>\n
insured, nor insurer was at all a party, nor any reply was<\/p>\n
filed by the insurer, nor any decree was claimed against<\/p>\n
the insurer, still issue no. 3 has been framed. It appears<\/p>\n
that   the    Tribunal         had    prepared       a     standard         proforma     of<\/p>\n
issues, and by filling in the blanks, it was signed in the<\/p>\n
present      case.      This    practice       is    required          to    be   stopped
\n                                                                         3<\/span><\/p>\n
forthwith     by     all    the     Tribunals,      and    is   seriously<\/p>\n
deprecated. Copy of this order be circulated to all the<\/p>\n
Motor Accident Claims Tribunals, with a direction to stop<\/p>\n
this practice if they are also following it.<\/p>\n
            During    trial       claimant   examined      himself,   and<\/p>\n
deposed the facts alleged in the claim petition, and also<\/p>\n
deposed about the treatment administered on him. In cross-<\/p>\n
examination, he was suggested, that the bus was negotiating<\/p>\n
a down gradient, and he does not know that the brakes of<\/p>\n
the bus suddenly failed, and at that place, on one side was<\/p>\n
hillock, while on the other side, was a deep pit. Thus, it<\/p>\n
appears,    that   during   trial,    a   defence    was   sought   to be<\/p>\n
developed about sudden brake failure of the bus.<\/p>\n
            The learned Tribunal decided issue No.1 in favour<\/p>\n
of the claimant, by observing, that firstly no evidence has<\/p>\n
been led in this regard by the defense, the burden of proof<\/p>\n
of sudden failure of brakes was on the defendants, even the<\/p>\n
mechanical examination report of the vehicle has also not<\/p>\n
been produced; Even driver of the bus has not been examined<\/p>\n
by the defendant. Thus, there is no material whatever on<\/p>\n
record, on the basis of which it can be concluded, that the<\/p>\n
accident occurred on account of sudden brake failure. Thus,<\/p>\n
the issue was decided against the appellant, and in favour<\/p>\n
of the claimant.\n<\/p>\n
                                                                                         4<\/span><\/p>\n
              Arguing    the       appeal      it    was     contended,       that    the<\/p>\n
accident was unavoidable, for the simple reason, that the<\/p>\n
bus   was    negotiating       a    steep      down        gradient,    and    at that<\/p>\n
time, suddenly the brakes failed, and it was an act of<\/p>\n
carefulness     on    the   part        of    the     driver,      that      instead of<\/p>\n
allowing the bus to fall in the pit, he chose a lesser evil<\/p>\n
of allowing the bus to dash against the hillock, otherwise<\/p>\n
far   more    drastic    consequence               would    have   flown,      and    the<\/p>\n
learned      Tribunal    was       in   error       in     not   appreciating        this<\/p>\n
aspect of the things, and the overall situation.<\/p>\n
              I have heard learned counsel for the appellant,<\/p>\n
and have gone through the material on record, as nobody<\/p>\n
appeared on behalf of the respondent.\n<\/p>\n<\/p>\n
              In my view, may be that the accident may have<\/p>\n
occurred on account of failure of brakes. Obviously if the<\/p>\n
brakes were functioning perhaps the vehicle would have been<\/p>\n
controlled,     but     then,      in    the       legal     parlance,       projecting<\/p>\n
this defence, tantamounts to taking a defense of mechanical<\/p>\n
failure, or mechanical brake down. Obviously this is a plea<\/p>\n
of fact, which requires a bundle of facts to be pleaded,<\/p>\n
and proved, including, that it was the latent defect, which<\/p>\n
could not be noticed by the owner and\/or driver, and that<\/p>\n
the   vehicle    was    being       properly         maintained        from    time    to<\/p>\n
time, to be in a roadworthy condition, and despite taking<\/p>\n
all   care,    and    precaution,            and    undertaking        all    requisite
\n                                                                            5<\/span><\/p>\n
maintenance, the brakes had failed. In the present case,<\/p>\n
significantly,      as    noticed   above,   there     is    no    pleading<\/p>\n
whatever, even about the brakes having failed, much less<\/p>\n
the plea of mechanical failure, or mechanical brake down,<\/p>\n
had been taken in the manner as required by law. I may<\/p>\n
refer to celebrated judgment of this Court in Radha Devi &<\/p>\n
Anr. Vs. M\/s. Aaluman Gyanchand & Ors., reported in 1982<\/p>\n
ACJ 69, wherein the law in regard to the requirement of<\/p>\n
pleading,    in   cases    of   mechanical   failure        or    mechanical<\/p>\n
brake down, the facts required to be pleaded and to be<\/p>\n
proved, has been dealt with threadbare, even by considering<\/p>\n
various judgments of Hon’ble the Supreme Court, judgments<\/p>\n
of Privy Council, and the judgments of House of Lords, so<\/p>\n
also that of Kings Bench. To be precise, judgment in Radha<\/p>\n
Devi’s    case    fully   covers    the   present    case    against    the<\/p>\n
appellant.\n<\/p>\n<\/p>\n
            In the result, following the judgment in Radha<\/p>\n
Devi’s case, I do not find any force in the appeal. The<\/p>\n
same is, therefore, dismissed. The parties shall bear their<\/p>\n
own costs.\n<\/p>\n<\/p>\n
