Justice K.BALAKRISHNAN NAIR\n\n Dated :11\/06\/2007\n\n O R D E R\n                              K.BALAKRISHNAN NAIR, J.\n\n                              ------------------------------\n\n                        W.P.(C) No. 15921 of 2007-U\n\n                        -------------------------------------\n\n                   Dated this the 11th    day of June, 2007.\n\n\n                                         J U D G M E N T\n<\/pre>\n<p>           The   petitioner   is   a   Nurse   (Higher   Grade),   working   in   the<\/p>\n<p>Homoeopathy   Department.     He   was   working   at   the   Government<\/p>\n<p>Homoeopathy   Hospital   Neyyattinkara.     He   was   desirous   of   getting   a<\/p>\n<p>transfer   to   Ernakulam   District   and   he   has   filed   Ext.P3   representation<\/p>\n<p>praying that he may be posted to   one of the Homoeopathy Hospitals<\/p>\n<p>at   North   Paravur,   or     Ernakulam   or   Muvattupuzha.     But,   instead   of<\/p>\n<p>posting to Ernakulam he has been transferred to Thiruvananthapuram,<\/p>\n<p>by Ext.P4.  So, this writ petition is filed challenging Ext.P4 and seeking<\/p>\n<p>consequential   reliefs.       As   directed     by   this   Court,   a   statement   has<\/p>\n<p>been filed on behalf of the second respondent.  The relevant portion of<\/p>\n<p>the statement reads as follows:\n<\/p>\n<blockquote><p>                      &#8221;   Though the petitioner requested for a<\/p>\n<p>              transfer to the above three places in the order<\/p>\n<p>              of preference  he could not be given transfer to<\/p>\n<p>              these   places   as   there   was   no   existing<\/p>\n<p>              vacancies   in   these   places   at   the   time   of<\/p>\n<p>              processing the general transfer.  The petitioner<\/p>\n<p>              will  be transferred and posted to the district of<\/p>\n<p>              his   choice   as   and   when   vacancy   arises,   after<\/p>\n<p>              considering   the   various   claims   for   those<\/p>\n<p>              vacancies.\n<\/p><\/blockquote>\n<blockquote><\/blockquote>\n<blockquote><p>                      The   petitioner   was   transferred   and<\/p>\n<p>              posted          to          Govt.         Homoeo         Hospital,<\/p>\n<p>              Thiruvananthapuram   from   Govt.   Homoeo<\/p>\n<p>             Hospital,   Neyyattinkara   (Thiruvananthapuram<\/p>\n<p>             District)   due   to   the   following   administrative<\/p>\n<p>             reasons.\n<\/p><\/blockquote>\n<blockquote><\/blockquote>\n<pre>                    Thiruvananthapuram                Govt.\n\n                    Homoeo   Hospital   is     hundred\n\n                    bedded   and   the   total   posts   of\n\n<\/pre>\n<blockquote><p>                    Nurse is seven including a Nursing<\/p>\n<p>                    Superintendent.     But   the   existing<\/p>\n<p>                    Nurses   are   four   in   number   while<\/p>\n<p>                    on General Transfer-2007.  Among<\/p>\n<p>                    them   one   J.Chandrika,   Nurse<\/p>\n<p>                    below   two   years   to   retire   has<\/p>\n<p>                    requested   to   transfer   to   Govt.<\/p>\n<p>                    Homoeo   Hospital,   Neyyattinkara,<\/p>\n<p>                    her   native   place.     So   department<\/p>\n<p>                    entertained her request.\n<\/p><\/blockquote>\n<blockquote>\n<p>                    In   the   above   circumstances,   the<\/p>\n<p>              petitioner  was transferred  and posted to Govt.<\/p>\n<p>              Homoeo   Hospital,   Thiruvananthapuram.
