GOVERNMENT PLEADER for\nRespondents. \n=========================================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\n HONOURABLE\n\t\t\tMR.JUSTICE H.B.ANTANI\n\t\t\n\t\n\n \n\nDate\n: 27\/04\/2010 \n\n \n\n \n \n\n\n \n\n ORAL\nJUDGMENT<\/pre>\n<p>\tBy<br \/>\nfiling this writ petition under Article 227 of the Constitution of<br \/>\nIndia, the detenu has challenged the order of detention No.<br \/>\nPCB\/DTN\/PASA\/192\/2009 dated 18.09.2009 passed by the Commissioner of<br \/>\nPolice, Rajkot  respondent No. 2, in exercise of powers under<br \/>\nsub-section (1) of section 3 of the Gujarat Prevention of Anti Social<br \/>\nActivities Act, 1985 [hereinafter referred to as the PASA Act]<br \/>\ndetaining the detenu as a bootlegger, as being illegal, invalid,<br \/>\narbitrary, void ab-initio and suffers from total non-application of<br \/>\nmind and also in violation of the provisions of Articles 14, 21 and<br \/>\n22 of the Constitution of India.\n<\/p>\n<p>\tLearned<br \/>\nadvocate for the detenu, Ms. Subhadra Patel submitted that the<br \/>\ngrounds of detention do not indicate any satisfaction recorded by the<br \/>\ndetaining authority that the activities of the detenu are detrimental<br \/>\nto  public order , and, therefore, the detention order is bad and<br \/>\nillegal. She submitted that the detaining authority has placed<br \/>\nreliance on a solitary case under the Prohibition Act but the same do<br \/>\nnot indicate anything to support disturbance to  public order .<br \/>\nShe submitted that the offence was registered on 25.08.2009, the<br \/>\ndetenu was arrested on 25.08.2009, and the detenu was released on<br \/>\nbail 25.08.2009 but the detention order is passed on 18.09.2009.<br \/>\nLearned advocate therefore submitted that there is a delay in passing<br \/>\nthe order of detention and on this ground also, the detention order<br \/>\nrequires to be quashed and set aside.\n<\/p>\n<p>\tMs.\n<\/p>\n<p>Jirga Jhaveri,  learned AGP submitted that the detention order is<br \/>\njust and proper and detaining authority has passed the order after<br \/>\nconsidering all relevant aspects of the matter, and the same needs no<br \/>\ninterference.\n<\/p>\n<p>\tHeard<br \/>\nlearned counsel appearing for both the sides. I have also perused the<br \/>\nrecords available in the compilation.\n<\/p>\n<p>\tIt<br \/>\nappears that on the basis of a solitary case, viz. Prohibition C.R.<br \/>\nNo. 279 of 2009 dated 25.08.2009 registered at Gandhigram Police<br \/>\nStation, Rajkot for 52 bottles of foreign liquor against the detenu,<br \/>\nthe detaining authority held that the said activities of selling<br \/>\nliquor of the present detenu were harmful to the health of the<br \/>\npublic, and to restrain from carrying further illegal activities, the<br \/>\ndetenu has been detained. It further appears that the offence was<br \/>\nregistered on 25.08.2009, the detenu was arrested on 25.08.2009, the<br \/>\ndetenu was released on bail 25.08.2009 but the detention order is<br \/>\npassed on 18.09.2009, i.e. after 23 days from the date he was<br \/>\nreleased on bail. Hence there is a delay in passing the order of<br \/>\ndetention. On this ground alone, this petition requires to be<br \/>\nallowed.\n<\/p>\n<p>\tAnother<br \/>\nsubmission of the learned advocate for the detenu is that the grounds<br \/>\nof detention do not indicate any satisfaction recorded by the<br \/>\ndetaining authority that the activities of the detenu are detrimental<br \/>\nto  public order  and at the most it can be said to be breach of<br \/>\n law and order . Except the statements of some anonymous<br \/>\nwitnesses, there is no material on record which shows that the detenu<br \/>\nis carrying on activities of selling liquor which is harmful to the<br \/>\nhealth of the public. She further submitted that during the period of<br \/>\n33 days i.e.  from the date he was released on bail till he was<br \/>\ndetained, no offence is alleged against the detenu and therefore it<br \/>\ncannot be at all said that the<br \/>\nactivities of the detenu are detrimental to  public order .\n<\/p>\n<p>\tIn<br \/>\nthe case of Collector and  DIST. MAGISTRATE V\/S.  SULTAN<br \/>\nreported in AIR 2008 SC 2096 the Apex Court has distinguished<br \/>\nbetween  public order  and  law and order  and held that the<br \/>\ndistinction between the areas of &#8216;law and order&#8217; and &#8216;public order&#8217;<br \/>\nis one of the degree and extent of the reach of the act in question<br \/>\non society which would disturb the even tempo of life of the<br \/>\ncommunity and if the effect is confined only to a few individuals<br \/>\ndirectly involved as distinct from a wide spectrum of public, it<br \/>\ncould raise problem of law and order only.\n<\/p>\n<p>\tApplying<br \/>\nthe ratio of the above decision, it is clear that before passing an<br \/>\norder of detention of a detenu, the detaining authority must come to<br \/>\na definite finding that there is threat to the  public order  and<br \/>\nit is very clear that the present case would not fall within the<br \/>\ncategory of threat to  public order . Even the quantity involved<br \/>\nis small, i.e only 52 bottles of foreign liquor. In that view of the<br \/>\nmatter, when the order of detention has been passed by the detaining<br \/>\nauthority without having adequate grounds for passing the said order,<br \/>\nit cannot be sustained and, therefore, it deserves to be quashed and<br \/>\nset aside.\n<\/p>\n<p>\tFor<br \/>\nthe foregoing reasons, the petition is allowed. The impugned order of<br \/>\ndetention dated 18.09.2009 passed by the Police Commissioner, Rajkot<br \/>\nCity, respondent No.2 against  the detenu is hereby quashed and set<br \/>\naside.   The detenu is ordered to be set at liberty forthwith,  if<br \/>\nnot  required  in  any other case.    Rule is made absolute<br \/>\naccordingly.
