SHAH\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 22\/10\/2010 \n\n \n\n \n \n\n\n \n\nORAL\nJUDGMENT<\/pre>\n<p>1.\tBy<br \/>\nway of this petition under Article 227 of the Constitution of India<br \/>\nthe petitioner-IPCL has prayed for an appropriate writ, order or<br \/>\ndirection quashing and setting aside the judgement and award dated<br \/>\n19\/12\/2003 passed by the learned Presiding Officer, Labour Court,<br \/>\nVadodara in Reference (L.C.V) No. 391\/1997 by which in exercise of<br \/>\npowers under Section 11-A of the Industrial Disputes Act, the Labour<br \/>\nCourt has partly allowed the Reference directing the petitioner to<br \/>\nreinstate the respondent without back wages but with continuity of<br \/>\nservice.\n<\/p>\n<p>2.\tToday,<br \/>\nwhen the present petition is taken up for final hearing, Shri Keyur<br \/>\nGandhi, learned advocate appearing on behalf of the petitioner and<br \/>\nShri Rajesh Mankad, learned advocate appearing on behalf of the<br \/>\nrespondent have jointly stated at the  bar that the parties have<br \/>\nsettled the dispute amicably and it is agreed that the impugned<br \/>\njudgement and award passed by the Labour Court be modified to the<br \/>\nextent that in lieu of reinstatement  and wages from the date of the<br \/>\naward till reinstatement and the retirement benefits, the petitioner<br \/>\nto pay total sum of Rs. 5 lakhs to the respondent.\n<\/p>\n<p>3.\tIn<br \/>\nview of the above, it is requested to dispose of the present Special<br \/>\nCivil Application by modifying the impugned judgement and award to<br \/>\nthe aforesaid extent.  In view of the above broad consensus  and the<br \/>\nsettlement arrived at between the parties, the present petition is<br \/>\nallowed in part and the impugned judgement and award passed by the<br \/>\nLabour Court, Vadodara dated 19\/12\/2003 in Reference (L.C.V.) No.<br \/>\n391\/1997 is hereby modified to the extent that in lieu of<br \/>\nreinstatement and continuity of service and wages from the date of<br \/>\naward till reinstatement and the retirement benefits, as full and<br \/>\nfinal settlement of the claim of the respondent against the<br \/>\npetitioner, the petitioner to pay a total sum of Rs. 5 lakhs  to the<br \/>\nrespondent-workman to be paid by an account payee cheque within a<br \/>\nperiod of two weeks from today.  Rule is made absolute to the<br \/>\naforesaid extent.
