Justice ANTONY DOMINIC\n\n Dated :08\/11\/2010\n\n O R D E R\n                     ANTONY DOMINIC, J.\n                        -------------------------\n                  W.P (C) No.32401 of 2010\n                       --------------------------\n              Dated this the 8th November, 2010\n\n                         J U D G M E N T\n<\/pre>\n<p>      Petitioner made an application to the respondents for<\/p>\n<p>issuance of a passport. Along with the application, in proof<\/p>\n<p>of her date of birth, petitioner produced an extract of her<\/p>\n<p>S.S.L.C Book.    However, the second respondent returned<\/p>\n<p>her application, with the endorsement to produce birth<\/p>\n<p>certificate. Thereupon, this writ petition is filed seeking a<\/p>\n<p>direction to the second respondent to accept            S.S.L.C.<\/p>\n<p>certificate as proof of the date of birth of the petitioner and<\/p>\n<p>issue passport on the basis of Ext.P3 application.<\/p>\n<p>      2.    Learned counsel for the petitioner contends that<\/p>\n<p>Passports Act do not oblige an applicant to produce birth<\/p>\n<p>certificate as proof of date of birth. It is also his contention<\/p>\n<p>that an application for passport is to be made as per<\/p>\n<p>Section 5 of the Act which can be refused only on the<\/p>\n<p>grounds enumerated under Section 6 of the Act.             It is<\/p>\n<p>stated that Section 6 of the Act, does not authorise the<\/p>\n<p>second respondent to reject an application for passport on<\/p>\n<p>the ground that birth certificate issued by the Municipal<\/p>\n<p>W.P (C) No.32401 of 2010<br \/>\n<span class=\"hidden_text\">                              2<\/span><\/p>\n<p>Authority is not produced.\n<\/p>\n<p>      3.    A statement has been filed on behalf of the<\/p>\n<p>second respondent, producing circular dated 24th October<\/p>\n<p>1991 issued by the Ministry of External Affairs. Paragraph<\/p>\n<p>2 of the circular states that applicants born on or after<\/p>\n<p>26th January 1989 should produce attested copy of the<\/p>\n<p>birth certificate from Municipal Authorities if born within<\/p>\n<p>territorial   jurisdiction of a Municipal Authority or<\/p>\n<p>otherwise, from the office of the Registrar of Births and<\/p>\n<p>Deaths. It is also pointed out that along with the passport<\/p>\n<p>application     form,     respondents    supplied   Passport<\/p>\n<p>Information Booklet and that, as per Section 4 thereof,<\/p>\n<p>among the documents to be attached tin the application<\/p>\n<p>form, certificate issued by the Municipal Authority or<\/p>\n<p>District Office, Registrar of Births and Deaths is one of the<\/p>\n<p>documents specified. It is therefore stated that the action<\/p>\n<p>of the second respondent in returning the application of the<\/p>\n<p>petitioner cannot be faulted.\n<\/p>\n<p>      4.    Passports Act do not specify the nature of the<\/p>\n<p>document to be produced in proof of the date of birth of an<\/p>\n<p>W.P (C) No.32401 of 2010<br \/>\n<span class=\"hidden_text\">                                3<\/span><\/p>\n<p>applicant. Therefore, if the respondents have decided to<\/p>\n<p>insist on production of the birth certificate issued by the<\/p>\n<p>Registrar of Births and Deaths,        such a decision is well<\/p>\n<p>within their power and is not contrary to any of the<\/p>\n<p>statutory provisions. In that view, I do not find anything<\/p>\n<p>illegal in the stand taken by the 2nd respondent. If that be<\/p>\n<p>so, necessarily, it is has to be held that application made by<\/p>\n<p>the petitioner was a defective one.\n<\/p>\n<p>      5.    I do not also find any merit in the contention of<\/p>\n<p>the petitioner that passport can be refused only on the<\/p>\n<p>grounds enumerated under Section 6 of the Act and that<\/p>\n<p>since     non-production of a certificate issued by the<\/p>\n<p>Registrar of Births and Deaths is not a ground enumerated,<\/p>\n<p>respondents      could not    have returned the application.<\/p>\n<p>This, in my view, applies only in case where an application<\/p>\n<p>made is otherwise in satisfaction of all requirements laid<\/p>\n<p>down for the issue of passport. The application made by<\/p>\n<p>the petitioner being defective, Section 6 of the Act does not<\/p>\n<p>come into operation at all.\n<\/p>\n<p>W.P (C) No.32401 of 2010<br \/>\n<span class=\"hidden_text\">                               4<\/span><\/p>\n<p>      In that view of the matter. this Court will not be<\/p>\n<p>justified in finding fault with the action of the second<\/p>\n<p>respondent in returning the defective application made by<\/p>\n<p>the petitioner.
