Justice C.N.RAMACHANDRAN NAIR\n\n Dated :29\/08\/2008\n\n O R D E R\n                   C.N.RAMACHANDRAN NAIR, J.\n                        -------------------------\n                     W.P.(C) No.24158 of 2006\n                    ---------------------------------\n            Dated, this the 29th day of August, 2008\n\n                           J U D G M E N T\n<\/pre>\n<p>      The strange situation in this case is that while revenue<\/p>\n<p>recovery proceeding is initiated for recovery of arrears of sales tax<\/p>\n<p>and when the same is pending, the Commercial Tax officer has<\/p>\n<p>issued Ext.P3 stating that petitioner is not in arrears of tax. The<\/p>\n<p>notice produced does not give address of the requisitioning<\/p>\n<p>authority. In this circumstance, it is not known whether petitioner<\/p>\n<p>is in arrears of any other amount. Learned Government Pleader<\/p>\n<p>submitted that files are stated to be missing and there is something<\/p>\n<p>cloudy about Ext.P3 certificate obtained and produced by petitioner.<\/p>\n<p>This writ petition is, therefore, disposed of directing 2nd respondent<\/p>\n<p>to call for records from the concerned authority, and proceed for<\/p>\n<p>recovery only after giving details of the arrears due from petitioner.<\/p>\n<p>If false certificate is issued by the Commercial Tax Officer, the<\/p>\n<p>District Collector will request the Commissioner of Commercial<\/p>\n<p>Taxes to take disciplinary action against him.<\/p>\n<p>                        (C.N.RAMACHANDRAN NAIR, JUDGE)<br \/>\njg<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court P.R.Muraleedharan Nair vs State Of Kerala on 29 August, 2008 IN THE HIGH COURT OF KERALA AT ERNAKULAM WP(C).No. 24158 of 2006(A) 1.
