SHAH\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 25\/02\/2010 \n\n \n\nORAL\nJUDGMENT<\/pre>\n<p>Rule.\n<\/p>\n<p>\tMr.Asim Pandya, learned advocate for H.L. Patel Advocates waives the<br \/>\n\tservice of notice of rule on behalf of the respondents.\n<\/p>\n<p>In<br \/>\n\tthe facts and circumstances of the case and with the consent of the<br \/>\n\tlearned advocates appearing on behalf of the respective parties,<br \/>\n\tpresent petition is taken up for final hearing today.\n<\/p>\n<p>By<br \/>\n\tway of this petition under Article 226 of the Constitution of India,<br \/>\n\tthe petitioners   have prayed for appropriate writ, order and\/or<br \/>\n\tdirection restraining the respondents, their agents, servants etc.<br \/>\n\tpermanently from evicting and dispossessing any of the petitioners<br \/>\n\tfrom the subject premises i.e. from Plot  Nos.252 and 253 of Town<br \/>\n\tPlanning Scheme No. 29, Ward No.11 of Ahmedabad City, popularly<br \/>\n\tknown as  Bhaiyaji ni Chali , Naranpura, Ahmedabad. It is also<br \/>\n\tprayed for appropriate writ, order and\/or directions to quash and<br \/>\n\tset aside the notice issued under sec.212(2) of the BPMC Act.\n<\/p>\n<p>Ms.Ami<br \/>\n\tYajnik, learned advocate appearing<br \/>\n\ton behalf of the petitioners  has heavily relied upon the<br \/>\n\tdecision of the Division Bench of this Court in the case of <a href=\"\/doc\/1997798\/\">Killol<br \/>\n\tV. Shelat Vs. Municipal Corporation of City of Ahmedabad and Anr.<\/a><br \/>\n\treported in 2009(1) GLH 13.\n<\/p>\n<p>\tIt is submitted that as held by the Division Bench, before<br \/>\n\tCommissioner can prescribe a street line under clause (a) of<br \/>\n\tsub-section 1 of Section 210 of the Act, which is likely to be<br \/>\n\tadversely affected to any citizens i.e. land owner, or occupier with<br \/>\n\tor without building thereon, the Commissioner must give a fair<br \/>\n\thearing to such persons. It is submitted that in the aforesaid case<br \/>\n\twhen a street line was prescribed which resulted into road widening<br \/>\n\twithout following principles of natural justice, without inviting<br \/>\n\tand considering the objections of the persons who are likely to be<br \/>\n\tadversely affected by a such road widening, the Division Bench<br \/>\n\tquashed and set aside the same by further quashing and setting aside<br \/>\n\tthe consequent eviction notice. It is submitted that in the present<br \/>\n\tcase also the street line has been prescribed which resulted<br \/>\n\tinto road widening, without following principles of natural justice<br \/>\n\tand without inviting and considering the objections of the<br \/>\n\tpetitioners who are likely to be adversely affected by such road<br \/>\n\twidening. Therefore, it is requested to allow the present Special<br \/>\n\tCivil Application  and quash and set aside the impugned order\/<br \/>\n\tnotice.\n<\/p>\n<p>The<br \/>\n\tpetition is opposed by Mr.Asim Pandya, learned<br \/>\n\tadvocate appearing on behalf of the respondents.<br \/>\n\tIt is submitted that as such the impugned notices\/orders issued<br \/>\n\tpassed  after giving opportunity to the petitioners and after<br \/>\n\tconsidering their objections and therefore, it cannot be said that<br \/>\n\timpugned notices\/orders are in breach of principles of natural<br \/>\n\tjustice.\n<\/p>\n<p>Having<br \/>\n\theard the learned advocates appearing on behalf of the respective<br \/>\n\tparties and considering the facts and circumstances of the case, the<br \/>\n\tcontroversy raised in the present petition  is now not res-integra.<br \/>\n\tIn  view of the decision of the Division Bench in the case of<br \/>\n\tKillol V. Shelat<br \/>\n\t(supra) as well as the decision dtd.29\/12\/2009 rendered by this<br \/>\n\tCourt in Special<br \/>\n\tCivil Application No.12980<br \/>\n\tof 2009 and other allied matters, it was suggested that let the<br \/>\n\tnotices dtd.23\/9\/2008 issued under sec.212(1)(a) of the BPMC Act be<br \/>\n\ttreated as show cause notice and to that the petitioners   can<br \/>\n\tsubmit their objections and suggestions before the Commissioner,<br \/>\n\tAhmedabad Municipal Corporation.  To that, the learned advocate<br \/>\n\tappearing on behalf of the respective petitioners   have no<br \/>\n\tobjection.\n<\/p>\n<p>Ms.Amee<br \/>\n\tYajnik, learned advocate appearing on behalf of the petitioners<br \/>\n\tand Mr.Asim Pandya, learned<br \/>\n\tadvocate appearing on behalf of the respondents  have agreed<br \/>\n\tand jointly submitted that let the notices dtd.23\/9\/2008 be treated<br \/>\n\tas notices for hearing while prescribing the road line under clause\n<\/p>\n<p>\t(a) of sub-section 1 of Section 210 of the Act and let the<br \/>\n\tpetitioners appear before the Commissioner, Ahmedabad Municipal<br \/>\n\tCorporation on 22\/3\/2010 as agreed and submit their objections and<br \/>\n\tsuggestions and let the Commissioner,  Ahmedabad Municipal<br \/>\n\tCorporation give fair hearing and consider the objections of the<br \/>\n\tpetitioners   and pass an appropriate order in accordance with law.\n<\/p>\n<p>Ms.Amee<br \/>\n\tYajnik, learned advocate appearing<br \/>\n\ton behalf of the petitioners has submitted that the<br \/>\n<span class=\"hidden_text\">\tpetitioner  Nos.1 and 2<\/span><br \/>\n\tshall  represent and\/or appear before the Commissioner, Ahmedabad<br \/>\n\tMunicipal Corporation for themselves and for and on behalf of other<br \/>\n\tpetitioners.\n<\/p>\n<p>Accordingly<br \/>\n\tand in view of the above and considering the decision of the<br \/>\n\tDivision Bench in the case of  Killol<br \/>\n\tV. Shelat<br \/>\n\t(supra) as well as the decision dtd.29\/12\/2009 rendered by this<br \/>\n\tCourt in Special Civil Application No.12980 of 2009 and other allied<br \/>\n\tmatters,  the impugned notices\/orders issued under sec.212(1)(a)<br \/>\n\tdtd.23\/9\/2008 is hereby required to be quashed and set aside and the<br \/>\n\tsame is required to be treated as notice for hearing while<br \/>\n\tprescribing the<br \/>\n\troad line under clause (a) of sub-section 1 of Section 210 of the<br \/>\n\tAct and let the petitioner Nos.1 and 2 appear before the<br \/>\n\tCommissioner, Ahmedabad Municipal Corporation on 22\/3\/2010 as agreed<br \/>\n\tand submit their objections and suggestions  for themselves and for<br \/>\n\tother petitioners and let the Commissioner,  Ahmedabad Municipal<br \/>\n\tCorporation give fair hearing and consider the objections of the<br \/>\n\tpetitioners   and pass an appropriate order in accordance with law.\n<\/p>\n<p>For<br \/>\n\tthe reasons stated above,  the petition succeeds in part. As<br \/>\n\tagreed between the learned advocates appearing on behalf of the<br \/>\n\trespective parties, the impugned notices\/orders be treated as show<br \/>\n\tcause notice for prescribing<br \/>\n\tthe road line under clause (a) of sub-section 1 of Section 210 of<br \/>\n\tthe BPMC Act  while widening the road in question.\n<\/p>\n<p>Ms.Amee<br \/>\n\tYajnik, the learned advocate appearing on behalf of the petitioners<br \/>\n\thas submitted that  the petitioner Nos.1 and 2 for themselves and<br \/>\n\tfor and on behalf of the remaining petitioners   shall appear before<br \/>\n\tthe Commissioner, Ahmedabad Municipal Corporation for hearing on<br \/>\n\t22\/3\/2010, as held by the Division Bench in the case of Killol<br \/>\n\tV. Shelat<br \/>\n\t(supra) and thereafter, the Commissioner, Ahmedabad Municipal<br \/>\n\tCorporation to pass appropriate order with respect to prescription<br \/>\n\tand\/or widening of the road line in question as per sec.210(1)(a) of<br \/>\n\tthe BPMC Act, after considering the objections and submissions to be<br \/>\n\tmade by the respective petitioners. The said exercise to be<br \/>\n\tcompleted on or before 8\/4\/2010 and thereafter the Commissioner,<br \/>\n\tAhmedabad Municipal Corporation to follow the  procedure as required<br \/>\n\tunder secs.211 to 216 of the BPMC Act, 1949 on the basis of the<br \/>\n\tdecision that may be taken by the Commissioner, Ahmedabad Municipal<br \/>\n\tCorporation at the earliest.\n<\/p>\n<p>With<br \/>\n\tthese present Special Civil Application is allowed.<br \/>\n\tRule is made absolute to the aforesaid extent.
