PRAKASH TATIA, J.\n<\/pre>\n<p>Mr.SS Sharma, Public Prosecutor.\n<\/p>\n<p>                               &#8211; &#8211; &#8211; &#8211; &#8211;\n<\/p>\n<p>     Heard learned public prosecutor and perused<br \/>\nthe record.\n<\/p>\n<p>     This petition for leave to appeal has been<br \/>\npreferred by the appellant State being aggrieved<br \/>\nby the appellate judgment dated 10.10.2006 passed<br \/>\nby   the    Court     of       Sessions     Judge,      Jaisalmer        in<br \/>\ncriminal appeal no.21\/2005 whereby the appellate<br \/>\ncourt      set    aside    the     judgment       and     order      dated<br \/>\n5.7.2005     passed       by    the   Court     of    Chief     Judicial<br \/>\nMagistrate, Jaisalmer in criminal case no.143\/2003<br \/>\nconvicting the respondent under Section 304A IPC<br \/>\nand Section 122\/177 of the Motor Vehicles Act.\n<\/p>\n<p>     As     per     the        prosecution       itself,        deceased<br \/>\nRamesh, who was traveling on his scooter collided<br \/>\n<span class=\"hidden_text\">                                      2<\/span><\/p>\n<p>                                   S.B. Criminal Leave to <a href=\"\/doc\/1959806\/\">Appeal No.101\/2009<br \/>\n                                         State of Rajasthan. vs. Doongara Ram.<\/a>\n<\/p>\n<p>with stationery tractor trolley which was lying on<br \/>\nroad. This accident occurred on 8.8.2003 and FIR<br \/>\nwas lodged and case under Section 304A IPC and<br \/>\nSection    122\/177      of    the        Motor    Vehicles        Act    was<br \/>\nregistered      and   after        investigation,          challan       was<br \/>\nsubmitted      against      the     accused.        The    trial      court<br \/>\nconvicted the accused by judgment and order dated<br \/>\n5.7.2005       and    sentenced           him    under       the      above<br \/>\nprovisions.\n<\/p>\n<p>       The appellate court found that the allegation<br \/>\nlevelled against the accused was that he put his<br \/>\ntractor trolley on the road without there being<br \/>\nany    reflector      and    because        of    that     reason,       the<br \/>\naccident    was      caused.       The    appellate        court      found<br \/>\nthat from the site map prepared by the witness<br \/>\nPW10    Veer    Singh,      it     is    fully     proved        that    the<br \/>\ntractor trolley was lying on the road in the side<br \/>\nand 12 feet road was open. From the prosecution&#8217;s<br \/>\nown    document,      it     was     proved      that      the     tractor<br \/>\ntrolley was not standing so as to obstruct the<br \/>\nroad and which could not have been noticed by the<br \/>\nvictim himself. The appellate court was also of<br \/>\nthe view that the prosecution failed to prove that<br \/>\nthe tractor trolley has not reflectors even on the<br \/>\ntrolley because of the reason that the fact is not<br \/>\n<span class=\"hidden_text\">                                        3<\/span><\/p>\n<p>                                     S.B. Criminal Leave to <a href=\"\/doc\/1959806\/\">Appeal No.101\/2009<br \/>\n                                           State of Rajasthan. vs. Doongara Ram.<\/a>\n<\/p>\n<p>stated     by    PW10     Veer       Singh     in      the    site    report<br \/>\nEx.P\/4 and his statement that there were light red<br \/>\ncolour on the back side of the tractor is also not<br \/>\nthe statement recorded in Ex.P\/4. Reflectors were<br \/>\nnot fixed on tractor trolley is not mentioned in<br \/>\nthe seizure memo Ex.P\/6. From Ex.D\/4 to D\/8, the<br \/>\nappellate court reached to the conclusion that the<br \/>\ntrolley       had   reflectors          in    left      and    right      side<br \/>\nboth.    In     view     of    the     above     reasons,       the       first<br \/>\nappellate court based its conclusion on the basis<br \/>\nof   the        evidence           available        on       record        and,<br \/>\ntherefore, I do not find any illegality in the<br \/>\njudgment of the appellate court dated 10.10.2006<br \/>\nacquitting the respondent accused.\n<\/p>\n<p>     Otherwise also, Section 304A IPC is as under:-\n<\/p>\n<p>              &#8220;304A.           Causing              death            by<br \/>\n     negligence.-Whoever causes the death of<br \/>\n     any        person        by     doing       any     rash        or<br \/>\n     negligent act not amounting to culpable<br \/>\n     homicide,           shall         be      punished          with<br \/>\n     imprisonment of either description for a<br \/>\n     term which may extend to two years, or<br \/>\n     with fine, or with both.&#8221;\n<\/p>\n<p><span class=\"hidden_text\">                                4<\/span><\/p>\n<p>                             S.B. Criminal Leave to Appeal No.101\/2009<br \/>\n                                   State of Rajasthan. vs. Doongara Ram.\n<\/p>\n<p>       A perusal of Section 304A IPC clearly shows<br \/>\nthat it covers the cases where the death of any<br \/>\nperson is caused by doing any rash or negligent<br \/>\nact.    Here   in   this   case,    the    case     may    fall     in<br \/>\nnegligent act of the person but in the present<br \/>\nfacts of the case, it cannot be said that the<br \/>\nprosecution proved the fact of the negligence of<br \/>\nthe act of the accused resulting into the death of<br \/>\nthe accused.\n<\/p>\n<p>       In view of the above, I do not find any reason<br \/>\nto grant the leave to appeal.
