HEMA, J.\n\n               ---------------------------------------------------\n                   B.A .No. 2324 &amp; 2327 of 2010\n               ---------------------------------------------------\n                Dated this 31st day of May, 2010.\n\n\n                                   ORDER\n<\/pre>\n<p>      These petitions are for anticipatory bail.<\/p>\n<p>      2. The alleged offences are under Sections 452, 323, 427<\/p>\n<p>read with Section 34 IPC. According to prosecution, on 27.3.2010<\/p>\n<p>at about 6.40 p.m., petitioners committed trespass in to the<\/p>\n<p>shop building of de facto complainant&#8217;s husband and voluntarily<\/p>\n<p>caused hurt to him and also destroyed some soda bottle.<\/p>\n<p>      3. Learned counsel for petitioners submitted that petitioners<\/p>\n<p>have not committed any offence. De facto complainant&#8217;s husband<\/p>\n<p>arranged a loan for first accused on high rate of interest through a<\/p>\n<p>private financier. Though the amount was paid, de facto<\/p>\n<p>complainant&#8217;s husband demanded more amount which first was<\/p>\n<p>not prepared to pay. He told de facto complainant&#8217;s husband that<\/p>\n<p>the matter will be informed to the police and hence a false<\/p>\n<p>complaint is made. It is also pointed out that no injury is sustained<\/p>\n<p>by de facto complainant&#8217;s husband, though some persons have<\/p>\n<p>allegedly assaulted him.\n<\/p>\n<p>      4. Learned Public Prosecutor submitted that there is a motive<\/p>\n<p><span class=\"hidden_text\">B.A.Nos.2324 &amp; 2327\/2010]            2<\/span><\/p>\n<p>for the offence. De facto complainant&#8217;s husband had arranged a<\/p>\n<p>loan for first accused but he failed to pay the amount and when<\/p>\n<p>demands were made for return of money, he had committed the<\/p>\n<p>offence along with another.\n<\/p>\n<p>     5. On hearing both sides, considering the facts pointed out ,<\/p>\n<p>I am satisfied that anticipatory bail can be granted to petitioners on<\/p>\n<p>conditions. Hence, the following order is passed<\/p>\n<p>          1) Petitioners (A1 and A2) shall surrender before the<\/p>\n<p>               Magistrate   Court concerned within 7 days from<\/p>\n<p>               today.\n<\/p>\n<p>          2) In the event of arrest, petitioners shall be released<\/p>\n<p>               on bail on their executing Rs.25,000\/- (Rupees<\/p>\n<p>               Twenty five thousand only) each with two solvent<\/p>\n<p>               sureties each for the like sum to the satisfaction<\/p>\n<p>               of    the learned Magistrate on the following<\/p>\n<p>               conditions:\n<\/p>\n<p>                  (i)  Petitioners   shall report  before     the<\/p>\n<p>                        Investigating Officer on every Monday<\/p>\n<p>                        between 10 a.m. and 1p.m.\n<\/p>\n<p>                  (ii)  Petitioners   shall  not  influence    or<\/p>\n<p><span class=\"hidden_text\">B.A.Nos.2324 &amp; 2327\/2010]            3<\/span><\/p>\n<p>                        intimidate any witness or tamper with<\/p>\n<p>                        evidence.\n<\/p>\n<p>                  (iii) In case petitioner is involved in similar<\/p>\n<p>                        offence, bail is liable to be cancelled.<\/p>\n<p>      Petitions are allowed.\n<\/p>\n<\/p>\n<p>                                            K.
