Jani appearing on behalf of applicant.\n<\/p>\n<p>\tThis<br \/>\nCourt has passed an order on 2nd<br \/>\nDecember, 2010, which is quoted as under :\n<\/p>\n<p>\t&#8220;Registry<br \/>\nhas notified this matter by showing name of learned advocate Mr. RC<br \/>\nJani for appellant. However, looking to the file, no vakalatnama of<br \/>\nlearned advocate Mr. RC Jani is found and there is no signature of<br \/>\nlearned Advocate Mr. RC Jani found on the memo of appeal. Mr. RC Jani<br \/>\nhas pointed out that the appellant has never contacted during this<br \/>\neighteen years and, therefore, looking to facts of matter, it seems<br \/>\nthat the learned advocate Mr. Jani is not appearing on behalf of<br \/>\nappellant and appellant also seems to have lost interest in<br \/>\nprosecuting the matter. Looking<br \/>\nto lapse of eighteen  years of time, matter has become infructuous.\n<\/p>\n<p>\tIn<br \/>\nlight of this back ground, according to my opinion, appellant must<br \/>\nhave lost interest in prosecuting this matter  has become infructuous<br \/>\nand, therefore, same is disposed of as having become infructuous with<br \/>\na liberty in favour of appellant to file note in registry of this<br \/>\nCourt for revival of this appeal in case if the cause of action for<br \/>\nthis appeal is still surviving. Therefore, this appeal stands<br \/>\ndisposed of accordingly with liberty as aforesaid in favour of<br \/>\nappellant.&#8221;\n<\/p>\n<p>\tThis<br \/>\nCourt has disposed of second appeal having become infructuous, but,<br \/>\nsubsequently, on 20th<br \/>\nJanuary, 2011, a note has been filed by learned advocate Mr. Jani,<br \/>\nwhere, following averments are made :\n<\/p>\n<p>\t&#8220;The<br \/>\nabove mentioned Second Appeal was disposed of on want of instructions<br \/>\nand as observed in the order by the Hon&#8217;ble Court. It is also<br \/>\nobserved that the liberty is given in favour of the applicant to file<br \/>\na note in registry of this Court for revival of second appeal in<br \/>\ncase if the cause of action for this appeal is still survive.\n<\/p>\n<p>\tUpon<br \/>\nthe written letter to the client, who contracted yesterday i.e. on<br \/>\n19.01.2011 and instructions have been given that even today, the<br \/>\ncause is survive and therefore, matter is required to be agitated on<br \/>\nmerits.\n<\/p>\n<p>\tIn<br \/>\nview of this, kindly circulate the matter before the appropriate<br \/>\nCourt at the earliest.&#8221;\n<\/p>\n<p>\tIn<br \/>\nview of aforesaid averments made in note dated 20th<br \/>\nJanuary, 2011 and considering submissions made by learned advocate<br \/>\nMr. Jani, order passed by this Court on 2nd<br \/>\nDecember, 2010 in Second Appeal No.20 of 1992 is hereby recalled and<br \/>\nsecond appeal is restored to its original file with all attached<br \/>\norders.\n<\/p>\n<p>\tAccordingly,<br \/>\nnote dated 20th<br \/>\nJanuary, 2011 filed by learned advocate Mr. Jani is disposed of.\n<\/p>\n<p>[H.K.\n<\/p>\n<p>RATHOD, J.]<\/p>\n<p>#Dave<\/p>\n<p>\t\t   \u00a0\u00a0\u00a0<\/p>\n<p>\t\t   Top<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Gujarat High Court Darbar vs Gujarat on 22 February, 2011 Author: H.K.Rathod,&amp;Nbsp;
