No. 930 of 2008\n             ................................................\n         Dated this the 24th day of March, 2008\n\n                             O R D E R\n<\/pre>\n<p>      In this Revision Petition filed under Section 397 read with<\/p>\n<p>Sec. 401     Cr.P.C. the petitioner who was the accused in<\/p>\n<p>S.T.No.2298     of   2005     on    the     file   of   the   J.F.C.M-IV,<\/p>\n<p>Thiruvananthapuram, challenges the conviction entered and<\/p>\n<p>the sentence passed against          him for an offence punishable<\/p>\n<p>under     Sec. 138 of the Negotiable Instruments Act, 1881<\/p>\n<p>(hereinafter referred to as &#8216;the Act&#8217;).\n<\/p>\n<p>      2.   I heard the learned counsel for the Revision Petitioner<\/p>\n<p>and the learned Public Prosecutor.\n<\/p>\n<p>      3.   The learned counsel appearing for the Revision<\/p>\n<p>Petitioner re-iterated the contentions in support of the Revision.<\/p>\n<p>The courts below have concurrently held that the cheque in<\/p>\n<p>question was drawn by the petitioner                  in favour of the<\/p>\n<p>complainant on the drawee bank, that the cheque was validly<\/p>\n<p>presented to the bank, that it was dishonoured for reasons which<\/p>\n<p><span class=\"hidden_text\">Crl.R.P.No.930\/2008             -:2:-<\/span><\/p>\n<p>fall under Section 138 of the Act, that the complainant made a<\/p>\n<p>demand for payment by a notice in time in accordance with<\/p>\n<p>clause (b) of the proviso to Section 138 of the Act and that the<\/p>\n<p>Revision Petitioner\/accused failed to make the payment within<\/p>\n<p>15 days of receipt of the statutory notice.  Both the courts have<\/p>\n<p>considered and rejected the defence set up by the revision<\/p>\n<p>petitioner while entering the above finding.     The said finding<\/p>\n<p>has been recorded on an appreciation of the oral and<\/p>\n<p>documentary evidence. I do not find any error, illegality or<\/p>\n<p>impropriety in the finding so recorded concurrently by the courts<\/p>\n<p>below.     The conviction was thus rightly entered against    the<\/p>\n<p>petitioner.\n<\/p>\n<p>      4.       What now survives for consideration is the question<\/p>\n<p>as to whether      what should be the      proper sentence to be<\/p>\n<p>imposed on the revision petitioner. Having regard to the facts<\/p>\n<p>and circumstances of the case, I am inclined to modify the<\/p>\n<p>sentence imposed on the revision petitioner. In the light of the<\/p>\n<p>recent decision of the Supreme Court in              Ettappadan<\/p>\n<p>Ahammedkutty         v. E.P. Abdullakoya (2008(1)KLT 851),<\/p>\n<p>default sentence cannot be imposed for the enforcement of an<\/p>\n<p>order for compensation under Sec. 357 (3) Cr.P.C. Accordingly,<\/p>\n<p><span class=\"hidden_text\">Crl.R.P.No.930\/2008             -:3:-<\/span><\/p>\n<p>for the conviction under Section 138 of the Act the revision<\/p>\n<p>petitioner is sentenced to pay a fine of Rs.61,000\/-(Rupees<\/p>\n<p>sixty one thousand only) The said          fine shall be paid as<\/p>\n<p>compensation under Section 357 (1) Cr.P.C.          The revision<\/p>\n<p>petitioner is permitted either to deposit the said fine amount<\/p>\n<p>before the Court below or directly pay the compensation to the<\/p>\n<p>complainant within four months from today and produce a<\/p>\n<p>memo to that effect before the trial Court in case of direct<\/p>\n<p>payment. If he fails to deposit or pay the said amount within<\/p>\n<p>the aforementioned period he shall suffer simple imprisonment<\/p>\n<p>for three months by way of default sentence.<\/p>\n<p>      In the result, this Revision is disposed of confirming the<\/p>\n<p>conviction entered but modifying the sentence imposed on the<\/p>\n<p>revision petitioner.\n<\/p>\n<\/p>\n<p>                                      V.
