Chelameswar, CJ.\n<\/p>\n<p>          Aggrieved by judgment dated 08.06.2010 in W.P.<\/p>\n<p>(C)No. 13291 of 2009, the unsuccessful petitioner therein<\/p>\n<p>preferred the instant appeal.                The petitioner is an Additional<\/p>\n<p>Director of Information and Public Relations in the service of<\/p>\n<p>the State of Kerala. The conditions of the said service are<\/p>\n<p>regulated by Special Rules made by the State of Kerala, in<\/p>\n<p>exercise of the powers under Section 2 of sub-section (1) of<\/p>\n<p>the Kerala Public Service Act, 1968. The prevailing rules<\/p>\n<p>are made in the year 2002.                     Rule 2 describes the service<\/p>\n<p>consisting of 10 categories . In the first category there is<\/p>\n<p>only one   post called the Director of Public                                    Relations.<\/p>\n<p>Rule 3 deals with the method of appointment to the various<\/p>\n<p>categories of posts and in so far as the post of Director of<\/p>\n<p>Public Relations is concerned, the method of appointment is<\/p>\n<p>W.A. No. 1220 OF 2010<br \/>\n<span class=\"hidden_text\">                                    2<\/span><\/p>\n<p>stipulated as follows:\n<\/p>\n<blockquote><p>       &#8220;&#8230;&#8230;.. 3. Appointment:-(a) Appointment to the several<\/p>\n<p>       categories shall be made as follows<\/p>\n<p>               Category            Method of appointment<br \/>\n       Director of Public (i) By promotion from the category of<br \/>\n       Relations           Additional Director of Public Relations.\n<\/p><\/blockquote>\n<blockquote><p>                                           OR\n<\/p><\/blockquote>\n<blockquote><p>                           (ii) By transfer from any other service<br \/>\n                                             OR\n<\/p><\/blockquote>\n<blockquote><p>                           (iii) By Direct recruitment including<br \/>\n                           appointment on contract basis.<\/p><\/blockquote>\n<p>             2. It can be seen from the above extract that the<\/p>\n<p>post of Director of Public Relations can be filled up either<\/p>\n<p>by promotion from the category of Additional Director of<\/p>\n<p>Public Relations or by transfer from any other service or by<\/p>\n<p>Direct Recruitment, including appointment on contract basis.<\/p>\n<p>             3. The appellant, who is an Additional Director of<\/p>\n<p>Public Relations aspires        to be promoted to the post of<\/p>\n<p>Director of Public Relations in view of the above extracted<\/p>\n<p>rule, which does provide for promotion as one of the<\/p>\n<p>methods of appointment to the post of the                   Director of<\/p>\n<p>Public Relations.\n<\/p>\n<p>W.A. No. 1220 OF 2010<br \/>\n<span class=\"hidden_text\">                                     3<\/span><\/p>\n<p>           4. Complaining that by an order dated 28.04.2009<\/p>\n<p>marked as Ext. P4 in the Writ Petition, the third respondent<\/p>\n<p>was illegally appointed as the Director of Public Relations,<\/p>\n<p>the appellant herein approached this Court by way of the<\/p>\n<p>above mentioned Writ petition with the prayers as follows:<\/p>\n<blockquote><p>               &#8220;(A) a writ of certiorari or any other appropriate writ,<\/p>\n<p>        order or direction quashing Ext. P4 order to the extent<\/p>\n<p>        relating to the appointment of the 3rd respondent as<\/p>\n<p>        Director of Public Relations.\n<\/p><\/blockquote>\n<blockquote><p>               (B) a writ of mandamus or any other writ, order or<\/p>\n<p>        direction commanding the 1st and 2nd respondents to<\/p>\n<p>        consider the claims of the petitioner for promotion to the<\/p>\n<p>        post of Director under the provisions of Ext.P2 Special<\/p>\n<p>        Rules and the representation referred to as Ext. P5.<\/p>\n<\/blockquote>\n<blockquote><p>               (C)  such other writ, order or direction as may be<\/p>\n<p>        deemed just and expedient in the circumstances of the<\/p>\n<p>        case; and<\/p>\n<p>               (D)  to allow the Writ Petition with costs.&#8221;<\/p><\/blockquote>\n<p>           5.    By the judgment under appeal,                  a learned<\/p>\n<p>Judge of this Court dismissed the Writ Petition, holding that<\/p>\n<p>the post of the Director of Public Relations is a post borne<\/p>\n<p>on the cadre of Indian Administrative Service and therefore<\/p>\n<p>W.A. No. 1220 OF 2010<br \/>\n<span class=\"hidden_text\">                              4<\/span><\/p>\n<p>could not be filled up by a person not borne by the cadre of<\/p>\n<p>Indian Administrative Service.\n<\/p>\n<p>          6. The learned Counsel for the appellant, Adv. Mr.<\/p>\n<p>A.N.Kuttan argued that though      under the relevant rules<\/p>\n<p>governing the cadre of Indian Administrative Service, the<\/p>\n<p>post of Director of Public Relations in the State of Kerala is<\/p>\n<p>required to be filled up by appointment of an officer<\/p>\n<p>belonging to the Indian Administrative Service allotted to<\/p>\n<p>the State of Kerala, the Special Rules governing the<\/p>\n<p>&#8216;Service&#8217; known as Kerala Public Relations Service gave<\/p>\n<p>a discretion to the State of Kerala to make appointment to<\/p>\n<p>the post of Director of Public Relations by resorting to any<\/p>\n<p>one of the three alternate methods of appointment. The<\/p>\n<p>learned counsel, therefore, submitted that the stand of the<\/p>\n<p>State of Kerala that they are obliged to appoint only an<\/p>\n<p>officer belonging to the cadre of Indian Administrative<\/p>\n<p>Service is not legally tenable. By taking such a stand, the<\/p>\n<p>State of Kerala failed to exercise the discretion legally<\/p>\n<p>vested in it under the Kerala Public Relations Service<\/p>\n<p>W.A. No. 1220 OF 2010<br \/>\n<span class=\"hidden_text\">                               5<\/span><\/p>\n<p>Special Rules, 2002, thereby rendering the appointment<\/p>\n<p>of the third respondent illegally. The learned Counsel also<\/p>\n<p>submitted that in the year 2005, even after coming into<\/p>\n<p>force of the Kerala Public Relations Service Special Rules<\/p>\n<p>2002, the State of Kerala promoted one of the Additional<\/p>\n<p>Directors one Mr. K.C.Venu to the post of Director of Public<\/p>\n<p>Relations in exercise of the discretion vested in the State of<\/p>\n<p>Kerala under the above mentioned Rule 3 of the State of<\/p>\n<p>Kerala. Therefore the stand of the State of Kerala that they<\/p>\n<p>are obliged to appoint only an officer of the cadre of the<\/p>\n<p>Indian Administrative Service is only a stand taken to suit<\/p>\n<p>their convenience in the present case to justify the illegal<\/p>\n<p>appointment of the third respondent.\n<\/p>\n<p>          7. Part XIV of the Constitution of India deals with<\/p>\n<p>the Services under the Union and the States. Article 309 of<\/p>\n<p>the Constitution authorises the appropriate Legislation to<\/p>\n<p>regulate the recruitment and conditions of service of<\/p>\n<p>persons appointed, to public services and posts in<\/p>\n<p>connection with the affairs of the Union or of any State.<\/p>\n<p>W.A. No. 1220 OF 2010<br \/>\n<span class=\"hidden_text\">                                     6<\/span><\/p>\n<p>However, Article 312* contemplates the establishment of<\/p>\n<p>certain All India Services by law made by the Parliament.<\/p>\n<p>    &#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8211;<\/p>\n<p>      &#8220;312. All India Services:- (1) Notwithstanding anything in<\/p>\n<p>      Chapter VI of Part VI or Part XI , if the Council of States has<\/p>\n<p>      declared by resolution supported by not less than two-thirds<\/p>\n<p>      of the members present and voting that it is necessary or<\/p>\n<p>      expedient in the national interest so to do, Parliament may by<\/p>\n<p>      law provide for the creation of one or more all-India services<\/p>\n<p>      including an all-India Judicial service common to the Union<\/p>\n<p>      and the States, and, subject to the other provisions of this<\/p>\n<p>      chapter, regulate the recruitment, and the conditions of<\/p>\n<p>      service of persons appointed, to any such service.<\/p>\n<p>            (2) The services known at the commencement of this<\/p>\n<p>      Constitution as the Indian Administrative Service and the<\/p>\n<p>      Indian Police Service shall be deemed to be services created<\/p>\n<p>      by Parliament under this article.\n<\/p>\n<\/p>\n<p>            (3)    The all-India judicial service referred to in clause<\/p>\n<p>      (1) shall not include any post inferior to that of a district judge<\/p>\n<p>      as defined in article 236.\n<\/p>\n<p>            (4)    The law providing for the creation of the all-India<\/p>\n<p>      judicial service aforesaid may contain such provisions for the<\/p>\n<p>      amendment of Chapter VI of Part VI as may be necessary for<\/p>\n<p>      giving effect to the provisions of that law and no such law<\/p>\n<p>      shall be deemed to be an amendment of this constitution for<\/p>\n<p>      the purposes of article 368&#8243;.\n<\/p>\n<p>W.A. No. 1220 OF 2010<br \/>\n<span class=\"hidden_text\">                              7<\/span><\/p>\n<p>Sub-clause (2) of Article 312 declares that the service<\/p>\n<p>known at the commencement of the Constitution as the<\/p>\n<p>Indian Administrative Service and the Indian Police Service<\/p>\n<p>shall be deemed to be services created by Parliament under<\/p>\n<p>the said Article. Apart from the mandatory requirement<\/p>\n<p>that the above mentioned two services are required to be<\/p>\n<p>legally treated as All India Services, clause (1) of Article<\/p>\n<p>312 authorises the Parliament to create other services<\/p>\n<p>common to the Union and        the States, and regulate the<\/p>\n<p>process of recruitment and the conditions of such services.<\/p>\n<p>          8. In exercise of the authority conferred under<\/p>\n<p>Article 312 of the Constitution, the Parliament made the All<\/p>\n<p>India Services Act 1951, which authorises the Union of<\/p>\n<p>India, under Section 3, to make rules for the regulation of<\/p>\n<p>recruitment and the conditions       of service of   persons<\/p>\n<p>appointed to an All India Service. In exercise of the powers<\/p>\n<p>conferred under sub section (1) of Section 3 of the All India<\/p>\n<p>Services Act,1951, the Government of        India  made the<\/p>\n<p>Indian Administrative        Service (Cadre) Rules,1954.<\/p>\n<p>W.A. No. 1220 OF 2010<br \/>\n<span class=\"hidden_text\">                                      8<\/span><\/p>\n<p>Under Rule 3, it is stipulated that there shall be constituted<\/p>\n<p>for each State or group of States an Indian Administrative<\/p>\n<p>Service cadre. Rule 4 of the said Rules provides that the<\/p>\n<p>strength and composition of each of the cadres constituted<\/p>\n<p>under Rule 3 shall be as determined by the Regulations<\/p>\n<p>made by the Central Government in consultation with the<\/p>\n<p>State Government. Under Rule 8 of the said Rules, it is<\/p>\n<p>provided that every cadre post shall be filled by a cadre<\/p>\n<p>officer. Rule 8(1) of the Rules reads as follows:<\/p>\n<p>       &#8220;Save as otherwise provided in the rules, every cadre posts<\/p>\n<p>       shall be filled by a cadre officer.&#8221;\n<\/p>\n<p>The expression &#8216;cadre officer&#8217; and &#8216;cadre post&#8217; are defined<\/p>\n<p>under Rule 2 (a) and (b) respectively of the said rules as<\/p>\n<p>follows:\n<\/p>\n<blockquote><p>        &#8220;a)   &#8216;cadre officer&#8217; means a member         of the Indian<\/p>\n<p>        Administrative Service.\n<\/p><\/blockquote>\n<blockquote><\/blockquote>\n<blockquote><p>        (b)   &#8216;cadre post&#8217; means any of the post specified under<\/p>\n<p>        Item I of each cadre       in the schedule   to the Indian<\/p>\n<p>        Administrative Service (Fixation    of   Cadre   Strength)<\/p>\n<p>        Regulations, 1955.&#8221;\n<\/p><\/blockquote>\n<p>W.A. No. 1220 OF 2010<br \/>\n<span class=\"hidden_text\">                                      9<\/span><\/p>\n<p>             9. Rule 9 categorically declares that a Cadre Post<\/p>\n<p>in a State shall not be filled by a person who is not a cadre<\/p>\n<p>officer barring exceptional situations. Rule 9 clause (1) in<\/p>\n<p>so far as, is relevant and reads as follows:<\/p>\n<blockquote><p>               &#8220;(1) A Cadre post in a State shall not be filled by a<\/p>\n<p>       person who is not a cadre officer except in the following<\/p>\n<p>       cases, namely: &#8211;\n<\/p><\/blockquote>\n<blockquote><p>               (a) if there is no suitable cadre officer available, for<\/p>\n<p>       filling the vacancy:\n<\/p><\/blockquote>\n<blockquote><p>               Provided that when a suitable cadre officer becomes<\/p>\n<p>       available, the person who is not a cadre officer shall be<\/p>\n<p>       replaced by the cadre officer.\n<\/p><\/blockquote>\n<blockquote><p>               Provided further that if it is proposed to continue the<\/p>\n<p>       person who is not a cadre officer beyond a period of three<\/p>\n<p>       months, the State Government shall             obtain the prior<\/p>\n<p>       approval of the Central Government for such continuance.<\/p>\n<\/blockquote>\n<blockquote><p>       (b)    if the vacancy is not likely to last or more than three<\/p>\n<p>       months.\n<\/p><\/blockquote>\n<blockquote><p>               Provided that if the vacancy is likely to exceed a<\/p>\n<p>       period of three months the State Government shall obtain<\/p>\n<p>       the prior approval of the Central Government for continuing<\/p>\n<p>       the person who is not a Cadre Officer, beyond the period<\/p>\n<p>       of three months&#8221;.<\/p><\/blockquote>\n<p>             10. In exercise of the powers under sub rule (1)<\/p>\n<p>of Rule 4 mentioned above, the Government of India, in<\/p>\n<p>W.A. No. 1220 OF 2010<br \/>\n<span class=\"hidden_text\">                               10<\/span><\/p>\n<p>consultation with the State Governments made the<\/p>\n<p>Regulations known as Indian Administrative Service<\/p>\n<p>(Fixation of Cadre Strength)Regulations, 1955. With<\/p>\n<p>reference to the State of Kerala, under entry 9 (KERALA),<\/p>\n<p>the various posts in the State of Kerala which are required<\/p>\n<p>to be filled up by cadre officers and the total number of such<\/p>\n<p>posts    are specified.  Admittedly, the post of Director of<\/p>\n<p>Public Relations is a cadre post contemplated under the<\/p>\n<p>above Regulations. By notification dated 10th June, 1999 of<\/p>\n<p>the Government of India, the existing item &#8216;9&#8217; of the above<\/p>\n<p>mentioned Regulations in so far as it deals with the State of<\/p>\n<p>Kerala, was amended by including the Director of Public<\/p>\n<p>Relations in the cadre of Indian Administrative Service in so<\/p>\n<p>far as the State of Kerala is concerned. Therefore, on the<\/p>\n<p>basis of the declaration made under Rules 8 and 9 that a<\/p>\n<p>cadre post shall be filled up only by a cadre officer and not<\/p>\n<p>by any other officer, except in an exceptional situation.<\/p>\n<p>           11. Therefore, we do not see any illegality in the<\/p>\n<p>W.A. No. 1220 OF 2010<br \/>\n<span class=\"hidden_text\">                              11<\/span><\/p>\n<p>decision of the State of Kerala to appoint the third<\/p>\n<p>respondent to the post of the Director of Public Relations.<\/p>\n<p>          12. The other submission of the learned Counsel<\/p>\n<p>for the appellant that in view of the fact that the Special<\/p>\n<p>Rules of the State of Kerala, known as &#8220;Kerala Public<\/p>\n<p>Relations Service Special Rules, 2002&#8221;, have been framed<\/p>\n<p>at a later point of time than the Indian Administrative<\/p>\n<p>Service (Fixation of Cadre Strength) Regulations, 1955, the<\/p>\n<p>latter rules shall prevail cannot be accepted in view of the<\/p>\n<p>constitutional mandate under Article 312 of the Constitution<\/p>\n<p>of India, which opens with a non-obstante clause. The<\/p>\n<p>authority of the Parliament to legislate upon the subject of<\/p>\n<p>All India Services is declared to be overriding the<\/p>\n<p>arrangement made in Part XI of the Constitution which<\/p>\n<p>deals with the legislative relations between the Union and<\/p>\n<p>the States.\n<\/p>\n<p>          13. Therefore, in so far as the services which are<\/p>\n<p>either deemed to be or declared to be All India Services,<\/p>\n<p>are concerned, the authority of the Parliament to legislate<\/p>\n<p>W.A. No. 1220 OF 2010<br \/>\n<span class=\"hidden_text\">                               12<\/span><\/p>\n<p>upon the subject is plenary and the concerned State<\/p>\n<p>Legislatures are denuded of the authority to make any law<\/p>\n<p>in that regard once the authority to deal with, either the<\/p>\n<p>process of recruitment or conditions of service of the post<\/p>\n<p>which is declared to be a post borne by the cadre of an All<\/p>\n<p>India Service.\n<\/p>\n<p>           14.   Coming to the other submission of the<\/p>\n<p>learned Counsel for the appellant that in the year 2005, an<\/p>\n<p>officer who did not belong to the Indian Administrative<\/p>\n<p>Service was in fact appointed to the post of      Director of<\/p>\n<p>Public Relations, we are of the opinion that Rule 9 of the<\/p>\n<p>Indian    Administrative Service (Cadre) Rules 1954 does<\/p>\n<p>contemplate the possibility of appointment of a person not<\/p>\n<p>belonging to the cadre of the Indian Administrative Service<\/p>\n<p>for a limited period in exceptional circumstances and subject<\/p>\n<p>to certain restrictions made in the Rule 9 of the above<\/p>\n<p>mentioned rules. We do not know under what circumstance<\/p>\n<p>such appointment came to be made in the year 2005. In the<\/p>\n<p>absence of any specific challenge to such an appointment<\/p>\n<p>W.A. No. 1220 OF 2010<br \/>\n<span class=\"hidden_text\">                              13<\/span><\/p>\n<p>and an appropriate pleading, the mere fact that such<\/p>\n<p>appointment was made in the year 2005, does not create<\/p>\n<p>any right in favour of the appellant herein nor constitute any<\/p>\n<p>precedent in making a further appointment in violation of<\/p>\n<p>the mandate under Rules 8 and 9 of the                 Indian<\/p>\n<p>Administrative Service (Cadre) Rules 1954.<\/p>\n<p>          In the result, we do not see any merit in the<\/p>\n<p>appeal and it is dismissed.
