The facts relevant for the purpose of this\n\npetition are as under:\n\nThe respondent herein is the wife \u00abof, the ,1&#039;:\n\npetitioner, who is accused No.1 before the Trial Courts\n\nand the other yetitioners are accused Nos\u00a72 to 121 It\n\nis the allegation of the complainant that her eorriage\ntook place with accused deg} about 4 years prior to\nthe complaint. It ois also aalleged &#039;thati dowry of\nRs.50,000-O0 was given in addition to two tola of gold\nand later accused \ufb01oiidxatyjthel instigation of his\nmother\/accosedu:\u00a7oi3;t,sister$roocused Nos.5 and 10\nstarted harassing the complainant insisting for demand\nof more do\ufb01ry aed as she did not fulfil the demand,\n\nstarted _harassment and cruelty and therefore she was\n\n&#039;tompei1ea to go to her parent&#039;s home. It is further\n\nialieged ithat; accused No.1 married accused No.2 on\n\no1{o\u00a7}2eQ6\u00a5jgt about 12.30 p.m. in the temple at\n\nh\ufb01amkhandi, in the presence of accused Nos.3 to 12. It\n\n\u00bbis her allegation that during her life time, accused\n\n-Is\u00a7g1 &quot;has married the second accused and therefore,\n\n* committed an offence punishable under Section 494 IPC.\n\nThe complaint lodged on these facts was registered by\n\n54,,\n\n \n\n\n\n&#039;;_\u00a3e5p\u00a7nd\u00e9\ufb01: and though this matter was oosted today for\n\n&quot;V absent.\n\nUeykthe petitioners. Para 1 deals with the relationship\nlief\u00bb: the accesed amongst each other and their\n\nld&quot;relationship with the complainant. Para 3 refers to\n\nthe Trial Court in P.C. No.27\/2006 {C.C. No.56\/2007\nafter the Order impugned]. The said Order of taking\ncognizance has been challenged before this *Court&#039; by\nthe accused\/petitioners herein on the idronnd lthat\nthere is no material before the_$rial c\u00e9pgg \ufb01g eakel\nthe cognizance and that the provisions of Section_a94l\nIPC are not attracted. has heen filed to\ncause harassment to th\u00e9.\u00a7e\u00e9i\u00a3#0\ufb02%re\ufb02o3It is also his\n\ncontention that the oomplainant does not disclose the\nceremonie\u00e9 of the second marriage said to have been\n\nperformed end that the oroceedings are liable to be\n\nquashed.\n\nV39\" , I heye\" heard the learned counsel for the\n\nhearingre,\u00a7heV_learned counsel for the petitioners\n\n'\".\ufb01\u00a7. \"The copy of the complaint has been produced\n\n54\n\n \n\n\n\n7\n\nmarriage, I do not think that in the absence of any\nsuch allegation, which constitute an offence, ,the\n\nTrial Court was wrong in taking the cognizance agains\ufb01\n\nthe said accused. So far as accused Nos,r,and 2 are *\n\nconcerned, it is alleged by the cooplainant that the\nmarriage was performed between then on \ufb01h$ said data,\nin the temple, whereas accused No.3 is concerned, she\nis the mother of accssed.5No}io;andr ma\u00a77\"be\" that her\ncresence would indicate ;same? instigation to accused\nMos.1 and 2 \"to. undergo: theg sarriage. In the\n\ncircumstances, aas\ufb02 fare as taking \"cognizance of the\noffence against accused Nos;l to 3, I do not think any\nillegality in the Order impugned. As regards the rest\n\nof the accused,g there; are no allegations, which\n\n__constitute$i anwgioffence and therefore taking of\n\nl=oognizance_.against the said accused is illegal and\n\nieproper;i,in the circumstances, I proceed to pass the\n\nV_followingE'.f\n\nORDER\n<\/pre>\n<p>The petition is partly allowed.
