Justice THOMAS P.JOSEPH\n\n Dated :27\/01\/2011\n\n O R D E R\n                   THOMAS P.JOSEPH, J.\n           ====================================\n                   W.P(C) No.30149 of 2010\n           ====================================\n         Dated this the   27th day of January,     2011\n\n\n                        J U D G M E N T\n<\/pre>\n<p>     Petitioner&#8217;s son, Binu was found dead in a paddy field on<\/p>\n<p>09.08.2010. The Manner police registered crime No.388 of 2010<\/p>\n<p>and started investigation.    Petitioner  says that investigation is<\/p>\n<p>nothing but and eye wash meant to save the real culprits. The first<\/p>\n<p>formation statement was given by none other than the brother of a<\/p>\n<p>suspected culprit and claiming himself to be related to the<\/p>\n<p>deceased.    Petitioner says that the first informant is not in any<\/p>\n<p>way related to the deceased and that the attempt is to mislead<\/p>\n<p>investigation and save the real culprits. Petitioner gave Exts.P2<\/p>\n<p>and P3 to the Chief Minister and the Director General of Police<\/p>\n<p>seeking proper investigation but that did not yield      result and<\/p>\n<p>hence this petition. Petitioner prayed that respondent Nos.1 and<\/p>\n<p>2 may be directed to constitute a special team to investigate the<\/p>\n<p>case or entrust the investigation to the State Crime Branch.<\/p>\n<p>     2.     As directed by this Court respondent No.5, Circle<\/p>\n<p>Inspector of Police    has filed a statement where details of<\/p>\n<p>investigation so far conducted       is stated.   It is stated that<\/p>\n<p>W.P(C) No.30149 of 2010<br \/>\n<span class=\"hidden_text\">                                 -: 2 :-<\/span><\/p>\n<p>witnesses related to the deceased apart from others also were<\/p>\n<p>questioned and investigation conducted so far revealed that<\/p>\n<p>deceased had illicit abkari business with certain persons and that<\/p>\n<p>one Sabu had availed a loan of Rs.50,000\/- from the deceased.<\/p>\n<p>While so apprehending that the excise officials might apprehend<\/p>\n<p>the    deceased he had been to some other place and later<\/p>\n<p>returned from that place.       Thereafter deceased was found<\/p>\n<p>missing. There was a search for the deceased and the search<\/p>\n<p>team included the suspected persons as well. While so the body<\/p>\n<p>of the deceased was found in the paddy filed.         The body was<\/p>\n<p>subjected to postmortem examination by the medical officer who<\/p>\n<p>opined that there is no antimortem injuries on the body of the<\/p>\n<p>deceased.    Chemical examination (of the Viscera) indicated that<\/p>\n<p>cause of death is      drowning.    It was further revealed that<\/p>\n<p>pheonothiazenes derivatives were      found in the viscera.      On<\/p>\n<p>further questing,     the doctor who conducted          postmortem<\/p>\n<p>examination opined that if a person consumes drugs in sufficient<\/p>\n<p>quantity to affect his body function, it is possible that the person<\/p>\n<p>may die of drowning if he falls into water even if he is a swimmer.<\/p>\n<p>Respondent No.5 has summed up his findings as a result of<\/p>\n<p>investigation in page 5 of the statement and concluded that as<\/p>\n<p>W.P(C) No.30149 of 2010<br \/>\n<span class=\"hidden_text\">                                   -: 3 :-<\/span><\/p>\n<p>part of investigation     the main suspects may be subjected for<\/p>\n<p>polygraph and brain mapping tests.\n<\/p>\n<p>      3.    Learned counsel for petitioner contends that the said<\/p>\n<p>observations itself would reveal      that involvement of the said<\/p>\n<p>persons is suspected by the investigating officer        but nothing<\/p>\n<p>further has been done. It is also submitted by the learned counsel<\/p>\n<p>that if body of the deceased was found in the paddy field, mud<\/p>\n<p>particles must have been seen in the viscera. Learned Public<\/p>\n<p>Prosecutor submitted that investigation has proceeded on the<\/p>\n<p>correct line and as seen from the report,       investigation is not<\/p>\n<p>concluded, it is still on and at this stage there is no necessity to<\/p>\n<p>change hands so far as investigation is concerned.<\/p>\n<p>      4.    I have gone through the statement of respondent<\/p>\n<p>No.5 and seen the steps taken by him in the course of<\/p>\n<p>investigation. I am not persuaded to think that as matters now<\/p>\n<p>stand that there should be a change of investigation. I must also<\/p>\n<p>bear in mind that any         investigation cannot be to the full<\/p>\n<p>satisfaction of all concerned. Investigating Officer is concerned<\/p>\n<p>with proving the crime and he has to take all steps necessary for<\/p>\n<p>the purpose.    Respondent No.5 states that polygraph or brain<\/p>\n<p>mapping test of the suspect is required. If it is so, it is for him to<\/p>\n<p>W.P(C) No.30149 of 2010<br \/>\n<span class=\"hidden_text\">                                 -: 4 :-<\/span><\/p>\n<p>take appropriate steps in the matter as per law and he shall do<\/p>\n<p>so.\n<\/p>\n<\/p>\n<p>     5.    I also make it clear that if any further direction or<\/p>\n<p>monitoring of investigation is required it is open to the petitioner<\/p>\n<p>to approach the appropriate court     as and when circumstances<\/p>\n<p>required that.\n<\/p>\n<\/p>\n<p>     Writ Petition is disposed of as above.\n<\/p>\n<\/p>\n<p>                                  THOMAS P.
