SHAH\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 23\/10\/2008 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>1.\tBy<br \/>\nway of this petition under Article 227 of the Constitution of India<br \/>\nthe petitioners-third parties have prayed for an appropriate writ,<br \/>\norder or direction quashing and setting aside the order passed by the<br \/>\nlearned 3rd Additional Civil Judge, Modasa  dated<br \/>\n25\/09\/2008 below Exh. 8 in Regular Civil Suit No. 62\/2007 by which<br \/>\nthe application submitted by the petitioners-third parties under<br \/>\nOrder 1 Rule 10 of the Code of Civil Procedure  for joining them as<br \/>\ndefendants in the aforesaid suit is dismissed.\n<\/p>\n<p>2.\tShri<br \/>\nChhablani, learned advocate appearing on behalf of the petitioners<br \/>\nhas submitted that the petitioners are necessary and interested<br \/>\nparties in the aforesaid suit as the petitioners claim  to be owners<br \/>\nof the property in question for which the suit has been filed and<br \/>\nrespondent no. 1 original plaintiff also claim to be the owner of the<br \/>\nsaid property and in the suit filed by the petitioners, order with<br \/>\nrespect to possession  has been passed and, therefore, if any decree<br \/>\nis passed in favour of respondent no. 1-original plaintiff, the order<br \/>\nof possession passed by the other Court will directly go into<br \/>\nconflict and, therefore, the learned trial Court ought to have<br \/>\nallowed the application  submitted by the petitioners.\n<\/p>\n<p>3.\tHaving<br \/>\nheard Shri Chhablani, learned advocate appearing on behalf of the<br \/>\npetitioners and considering the nature of the suit filed before the<br \/>\nlearned trial Court  by respondent no. 1-original plaintiff and the<br \/>\nimpugned order, it appears that  the suit has been filed against<br \/>\nrespondent no. 2-original defendant for recovery of possession, which<br \/>\naccording to respondent no.1-original plaintiff, respondent<br \/>\nno.2-original defendant is occupying as a tenant.  Now, if the<br \/>\npetitioners are permitted to be joined as defendants in the  suit for<br \/>\nrecovery of possession from respondent no. 2-original defendant, the<br \/>\nsuit should be converted into the suit for title.  In the said suit,<br \/>\ndispute between the petitioners herein-third parties and respondent<br \/>\nno. 1-original plaintiff with respect to  title is not  subject<br \/>\nmatter of the suit.\n<\/p>\n<p>4.\tConsidering<br \/>\nthe decision of the Hon&#8217;ble Supreme Court in the case of KASTURI<br \/>\nVs IYYAMPERUMAL AND ORS reported in  (2005) 6 SCC 733, the<br \/>\nimpugned order passed  by the learned trial Court does not warrant<br \/>\nany interference in exercise of powers under  Article 227 of the<br \/>\nConstitution of India.\n<\/p>\n<p>5.\tFor<br \/>\nthe aforesaid reasons and looking to the nature and the prayer in the<br \/>\nsuit, the application of the petitioners to be joined as a party<br \/>\ndefendant is rightly rejected by the learned trial Court.  No<br \/>\ninterference of this Court is called for in exercise of powers under<br \/>\nArticle 227 of the Constitution of India.
