MALLU\n\n\tVs.\n\nRESPONDENT:\nPURANACHANDRA RAO &amp; ANR.\n\nDATE OF JUDGMENT:\n16\/12\/1966\n\nBENCH:\nHIDAYATULLAH, M.\nBENCH:\nHIDAYATULLAH, M.\nBHARGAVA, VISHISHTHA\nMITTER, G.K.\n\nCITATION:\n 1967 AIR 1363\t\t  1967 SCR  (2) 209\n\n\nACT:\n    Code   of  Criminal\t Procedure  (Act  5  of\t 1898),\t  s.\n562(1.A)--If applies only to offences relating to property.\n\n\n\nHEADNOTE:\n    The\t accused  was convicted of the offence\tof  wrongful\nconfinement under s. 342 I.P.C., and was released after\t due\nadmonition under s. 562(1-A), Criminal Procedure Code.\nOn the question whether the latter section is concerned only\nwith  offences\trelating to property and was  therefore\t not\napplicable in the present case,\nHELD  : The clause \"any offence under the Indian Penal\tCode\npunishable with not more than two years' imprisonment\" in s.\n562(1-A)  Cr.P.C., stands by itself and indicates  that\t all\noffences   punishable\twith  not  more\t than\ttwo   years'\nimprisonment  are  capable  of being dealt  with  under\t the\nsection.   The\twords \"any offence under  the  Indian  Penal\nCode\"  cannot be read ejusdem generis with the\toffences  of\ntheft etc. mentioned earlier in the section.  Those offences\nhad to be specifically mentioned so as to be included in the\nsection,  because,  they are offences- punishable  with\t im-\nprisonment of more than two years. No. 243\/64).<br \/>\nThe Judgment of the Court was delivered by<br \/>\nHidayatullah, J. These are two appeals, one (Criminal Appeal<br \/>\nNo.  243  of  1964) by one Purna Chandra Rao  who  has\tbeen<br \/>\nconvicted under S. 342, Indian Penal Code by the High  Court<br \/>\nof Andhra Pradesh but in lieu of the sentence the High Court<br \/>\nreleased  him  under s. 562(1-A) of the\t Criminal  Procedure<br \/>\nCode  after due admonition, and the other  (Criminal  Appeal<br \/>\nNo,  65 of 1964) by one A. K. Mallu against the judgment  of<br \/>\nthe Andhra Pradesh High Court releasing the respondent\t(who<br \/>\nis the appellant<br \/>\n<span class=\"hidden_text\">310<\/span><br \/>\nin the other appeal) after admonition under s. 562 (1-A)  of<br \/>\nthe  Code of Criminal Procedure.  The two appeals have\tbeen<br \/>\nrespectively  filed  by\t the complainant who  had  lodged  a<br \/>\ncomplaint against him on which the conviction resulted,\t and<br \/>\nby  the accused.  In so far as the appeal of the accused  is<br \/>\nconcerned, we have recorded an order separately which  shows<br \/>\nthat  Mr. K. R. Chaudhary, advocate of this  Court  appeared<br \/>\nbefore\tus and told us that he would like to  withdraw\tfrom<br \/>\nthe  case.   As the accused is not  represented\t before\t us,<br \/>\nthere  is  no  alternative  but to  dismiss  his  appeal  in<br \/>\ndefault.\n<\/p>\n<p>As  regards  the other appeal, Mr. S. C.  Aggarwal  contends<br \/>\nthat S. 562 (I -A) is not applicable to an offence under  s.<br \/>\n342 of the Indian Penal Code.  His reasons are: that s.\t 562<br \/>\n(1-A)  is  concerned with offences concerning  property\t and<br \/>\noffences  not so concerned cannot be subjected to  treatment<br \/>\nunder that section.  Section 562 (1-A) reads as follows:&#8211;\n<\/p>\n<blockquote><p>\t       &#8220;In  any case in which a person is  convicted<br \/>\n\t      of  theft,  theft\t in  a\tbuilding,  dishonest<br \/>\n\t      misappropriation,\t cheating  or  any   offence<br \/>\n\t      under  the Indian Penal Code  punishable\twith<br \/>\n\t      not  more than two years&#8217; imprisonment and  no<br \/>\n\t      previous conviction is proved against him\t the<br \/>\n\t      Court  before whom he is so convicted may,  if<br \/>\n\t      it  thinks  fit,\thaving regard  to  the\tage,<br \/>\n\t      character,  antecedents or physical or  mental<br \/>\n\t      condition\t of the offender and to the  trivial<br \/>\n\t      nature  of  the  offence\tor  any\t extenuating<br \/>\n\t      circumstances  under  which  the\toffence\t was<br \/>\n\t      committed,  instead of sentencing him  to\t any<br \/>\n\t      punishment, release him after due admonition.&#8221;\n<\/p><\/blockquote>\n<p>Mr.  Aggarwala contends that the Code has mentioned  several<br \/>\noffences  by description, such as theft, theft in  building,<br \/>\ndishonest  misappropriation and cheating which are  offences<br \/>\nconnected  with property and, therefore, words &#8220;any  offence<br \/>\nunder the Indian Penal Code&#8221; which follow, must be given  an<br \/>\ninterpretation,\t confining  them to those  sections  of\t the<br \/>\nPenal  Code where property is either directly or  indirectly<br \/>\ninvolved.   In our opinion, this submission is\tnot  correct<br \/>\nand Mr. Aggarwala is not right in reading the section as  he<br \/>\ncontends.   The offences which are earlier mentioned in\t the<br \/>\nsection\t are punishable with imprisonment of more  than\t two<br \/>\nyears and, therefore, it was necessary to mention them so as<br \/>\nto  include  them in addition to offences under\t the  Indian<br \/>\nPenal  Code  punishable\t with  not  more  than\ttwo   years&#8217;<br \/>\nimprisonment.  The words &#8220;any offence under the Indian Penal<br \/>\nCode&#8221;  therefore  cannot be read ejusdem  generis  with\t the<br \/>\noffences which are mentioned earlier.  This clause stands by<br \/>\nitself\tand indicates that all offences punishable with\t not<br \/>\nmore than two years&#8217; imprisonment are also capable of<br \/>\n<span class=\"hidden_text\">\t\t\t    311<\/span><br \/>\nbeing  dealt  with  under  s.562  (1-A).   Offences  against<br \/>\nproperty are all included in Ch. 17 of the Indian Penal Code<br \/>\nand if it was desired to limit the operation of s.  562(1-A)<br \/>\nto offences against property, it would have been the easiest<br \/>\nthing to have mentioned the Seventeenth Chapter of the Code.<br \/>\nFor these reasons, we do not accept the argument.<br \/>\nAs  a  result,\tboth the appeals  fail\tand  are  dismissed.\n<\/p>\n<pre>V.P.S.\t\t    Appeals dismissed.\n<span class=\"hidden_text\">312<\/span>\n\n\n\n<\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Supreme Court of India A.K.
