BASANT, J.\n\n           ````````````````````````````````````````````````````\n                   B.A. No. 1618 OF 2008 F\n           ````````````````````````````````````````````````````\n            Dated this the 25th day of March, 2008\n\n                             O R D E R\n<\/pre>\n<p>           Application for anticipatory bail. Petitioner is the 4th<\/p>\n<p>accused. Altogether there are six accused persons. They<\/p>\n<p>face allegations in a crime registered alleging offences<\/p>\n<p>punishable, inter alia, under sections 326 and 307 read with<\/p>\n<p>149 IPC. The incident took place on 20.2.08. The petitioner<\/p>\n<p>has not been arrested so far. He was born on 13.2.1991.<\/p>\n<p>Investigation is in progress.           The petitioner apprehends<\/p>\n<p>imminent arrest.\n<\/p>\n<p>      2.   The learned counsel for the petitioner submits that<\/p>\n<p>the petitioner is innocent.       In any view of the matter, the<\/p>\n<p>petitioner, who was a juvenile\/child on the date of occurrence,<\/p>\n<p>may be granted anticipatory bail, it is submitted.               The<\/p>\n<p>petitioner is writing his examinations now as a plus two<\/p>\n<p>student. In these circumstances, a lenient view may be taken<\/p>\n<p>and anticipatory bail may be granted to the petitioner, it is<\/p>\n<p>BA.1618\/08<br \/>\n<span class=\"hidden_text\">                                : 2 :<\/span><\/p>\n<p>prayed.\n<\/p>\n<p>      3.   The learned Public Prosecutor does not oppose the<\/p>\n<p>application. The learned Public Prosecutor only submits that<\/p>\n<p>appropriate conditions may be imposed.<\/p>\n<p>      4.   I am satisfied, in the facts and circumstances of the<\/p>\n<p>case, that the petitioner can be granted anticipatory bail<\/p>\n<p>subject to appropriate terms and conditions.<\/p>\n<p>      5.   In the result, this petition is allowed.   Following<\/p>\n<p>directions are issued under Section 438 Cr.P.C in favour of<\/p>\n<p>the petitioner.\n<\/p>\n<p>      i)   Petitioner shall surrender before the learned<\/p>\n<p>Magistrate having jurisdiction at 11 a.m on 1.4.2008. He shall<\/p>\n<p>be released on regular bail on condition that he executes a<\/p>\n<p>bond for Rs.25,000\/-(Rupees twenty five thousand only) with<\/p>\n<p>two solvent sureties each for the like sum to the satisfaction of<\/p>\n<p>the learned Magistrate.\n<\/p>\n<p>      ii)  The petitioner shall make himself available for<\/p>\n<p>interrogation before the investigating officer between 10 a.m<\/p>\n<p>and 3 p.m on 2.4.2008 and 3.4.2008. During this period, the<\/p>\n<p>BA.1618\/08<br \/>\n<span class=\"hidden_text\">                                : 3 :<\/span><\/p>\n<p>investigating officer shall be at liberty to interrogate the<\/p>\n<p>petitioner in custody and take all necessary steps for the<\/p>\n<p>proper conduct of the investigation in this crime. Thereafter,<\/p>\n<p>he shall so appear on all Mondays between 10 a.m and 12<\/p>\n<p>noon for a period of one month and subsequently as and<\/p>\n<p>when directed by the investigating officer in writing to do so.<\/p>\n<p>      (iii) If the petitioner does not appear before the learned<\/p>\n<p>Magistrate as directed in clause (i), directions issued above<\/p>\n<p>shall thereafter stand revoked and the police shall be at liberty<\/p>\n<p>to arrest the petitioner and deal with him in accordance with<\/p>\n<p>law, as if these directions were not issued at all.<\/p>\n<p>      (iv) If he were arrested prior to 1.4.2008, he shall be<\/p>\n<p>released from custody on his executing a bond for<\/p>\n<p>Rs.25,000\/- (Rupees twenty five thousand only) without any<\/p>\n<p>sureties, undertaking to appear before the learned Magistrate<\/p>\n<p>on 1.4.2008.\n<\/p>\n<\/p>\n<p>                                           (R.BASANT, JUDGE)<br \/>\naks<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Nithin G.K. vs State Of Kerala Represented By on 25 March, 2008 IN THE HIGH COURT OF KERALA AT ERNAKULAM Bail Appl No. 1618 of 2008() 1.
